A8s3 AN ORDINANCE CLOSING AND VACATING CERTAIN DEDI- CATED SANITARY SEWER EASEMENTS RELATING TO SANITARY SEWERS M-37 AND M-70 ACROSS PROPERTY LOCATED NORTH OF I-20 AND WEST OF FOREST PARK BOULEVARD; AND PROVIDING FOR THE REVERSION OF THE FEE TO SAID LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the hereinafter described dedicated sanitary sewer easements relating to Sanitary Sewers M-37 and M-70 across prop- erty located north of I-20 and west of Forest Park Boulevard be and the same are hereby extinguished, vacated, closed and permanently abandoned as easements for sanitary sewer facilities: (1) The easement across a portion of Block 2, Towers Addition, as recorded in Vol. 388-62, page 33, of the Plat Records of Tarrant County, Texas; (2) The easement across Block 31-R, Edwards Heirs Addition, as recorded in Vol. 388-51, page 39, of the Plat Records of Tarrant County, Texas; (3) The easement across Lot A, Block 34, Edwards Heirs Addition, as recorded in Vol. 388-48, page 385, of the Plat Records of Tarrant County, Texas; (4) The easement across Lots B and C, Block 34, Edwards Heirs Addition, as recorded in Vol. 388-58, page 464, of the Plat Records of Tarrant County, Texas; (5) The easement across the tract as recorded in Vol. 4779, page 883, of the Deed Records of Tar- rant County, Texas; and (6) The easement across the tract as recorded in Vol. 4178, page 35, of the Deed Records of'.'Tarrant County, Texas. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said easements above described is hereby released and shall revert to the adjacent owners of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. APPROVYC TO FORM AND LEGALITY: V�' City Attorney Adopted June Z; 1Q7.3 City of Fort Worth, Texas Mayor and Council Communication LINE ROBINSuN DATE REFERENCE SUBJECT: Release of Easements Across PAGE GRAHAM NUMBER Towers Addition and Edwards Heirs 6/18/73 L-4332 Addition for —1 HANCOCK R� On August 11, 1969 (M&C C-1540) the City Council authorized the awarding of a contract on the project titled "Rehabilitation of Sanitary Sewer Mains M-37 and M-70" (1968 CIP C-64). On December 15, 1969 (M&C FP-681) the City Council authorized final payment for the construction. This construction was a new line located in highway right-of-way along the front of the properties adjoining the north side of the East-West Freeway at Forest Park Boulevard which was to replace two partly deteriorated mains located over and across the central portion of the properties. On May 17, 1971 (M&C L-3612) the City Council adopted Ordinance No. 6484 closing and vacating a portion of the easements occupied by the abandoned sewer lines in Blocks 1 and 2 of Towers Addition. On November 6, 1972 (M&C PZ-528) the City Council adopted Ordinance No. 6755 closing and vacating the easements occupied by the abandoned sewer lines in Lot 1, Block 34-R, Edwards Heirs Addition. Subsequent to Ordinances No. 6484 and No. 6755 easements occupied by the abandoned sewer lines still encumber the following properties: (1) a por- tion of Block 2, Towers Addition, Volume 388-62, Page 33, Plat Records, Tarrant County, Texas; (2) Block 31-R, Edwards Heirs Addition, Volume 388-519 Page 39, Plat Records, Tarrant County, Texas; (3) Lot A, Block 34, Edwards Heirs Addition, Volume 388-48, Page 385, Plat Records, Tarrant County, Texas; (4) Lots B & C, Block 34, Edwards Heirs Addition, Volume 388-589 Page 464, Plat Records, Tarrant County, Texas; (5) Tract as - —y recorded in Volume 4779, Page 883, Deed Records, Tarrant County, Texas; (6) Tract as recorded in Volume 4178, Page 35, Deed Records, Tarrant County, Texas. These encumbrances are shown on the attached map, and the release of same is requested to clear title to all of the affected properties. None of the original sanitary sewer line installations are being used, and the Water Department has no objection to the release of the easements. Recommendations: It is recommended that an ordinance be adopted closing and vacating the subject easements to clear title to the properties.
