AN ORDINANCE granting to the Northern Texas Traction Company, a corporation and its successors and assigns the right, privilege and franchise to construct, equip, maintain and operate by elec- tricity, or some motive power other than steam,a line of street railway over and upon certain streets in the City of Fort (forth, and to erect and maintain poles and overhead trolley and other necessary wires thereon. BE IT ORDAIN? BY THE BOARD OF 001MISSIONERS OF THE CITY OF FORT WORTH: Section 1: That in consideration of the stipulations and agreements hereinafter contained, to be kept and performed by the Northern Texas Traction Company, its successors and assigns, the City of Fort Worth, a municipal corporation, has given and granted, and does hereby give and grant unto the said Northern Texas Traction Company, a corporation domiciled in Fort Worth, Tarrant County, Texas, and its successors and assigns, the right, license and franchise to construct, equip, maintain and operate a line of single or double -track street railway for the carriage of pas- sengers and freight, together with all necessary switches, side tracks un� turn outs, Y's, frogs, connecticns, poles, wires, and ctrer c(--nvenier: OF, fixt a.- f; or appurtauu_. -ces _,rd belor.g:rgs re:i!ai ; i te, necessary or convenient for the const-,-ucti on, operation . and maintenance of said line of street railway on, through and over the following streets, alleys or public thoroughfares of the City of Fort Worth as an extension of and connection with the present lines of street railway owned and operated by said Northern Texas Traction Company over train and Weatherford Streets in said City,viz: From a point or connection with the present line of tracks at the intersec- tion of Commerce and Weatnerford Streets; thence eastward over weather- ford Street to a point near its intersection with Calhoun Street;thence continuing over Weatherford Street^uu and onto the east half of a block of ground lying north of w eathertord Street and west of Calhoun Street; and from a point on the north property line of the east half of said uA, -&n " WW VA 4, olock above referred to,�to and onto and over zelknap Street to a point of connection with the present line of the said lvorthern Texas fraction Company 's tracks on said nelknap street; also the right to make such switches and connections to ana from the lines of tracks aforesaid and the said half block of ground as may be necessary or convenient in the operation of the said lines of track. This franchise and grant of the right to extend said lines over the streets just above mentioned is to be subject to and run con- current with the original franchise heretofore granted by the City of Fort 'north to the 14ortnern Texas Tr action Company aiu its assigns to construct aria maintain and uperate its lines oY street railway over said Main Street in the city of r ort �vorth. Section 2: All the tracks laid under the provisions of this ordinance axcept swi.tci.es, ara turf, nuts, arm except; p -aces wi;era tu=ns are Made, shall oe lala ai a kept as neariy in the middle of e r 3 the street as is practicable, and the top of each rail of each and every part of said track and the space between the rails shall be kept level with the street alongside; and the tracks, wires, poles and all other equipment shall be of standard quality and so constructed and maintained i that travel upon said streets shall not be unnecessarily obstructed or endangered at any place, and all matters of construction and maintenance shall be subject to the approval of the City Engineer and the City Electrician and the Board of City Commissioners; all tracks on portions of streets that are now or shall hereafter be paved shall be of first class rails of such kind as shall be designated by the City Engineer and shall be laid in such manner as to make the least possible obstruction to vehicles and shall be maintained in that condition. Section 3; Said Northern Texas Traction Company and its successors or assigns shall at its or their sole cost and expense pave and repave or otherwise surface and resurface and keep con. stantly in good order and condition with the same sort of material with which the street on the outside is paved and surfaced, all that part of each street occupied by it, or that which lies between the rails of said tracks and for eighteen inches on each side there- of, and said NortY:e:rn Texas Traction Company, :,r it: space: s :r: or as. igus, s-r.all col its or their track:, or any k: Lrt th reof to the i:ra�,er grade of each street and c}.._..�.e the level of such tracks 4 as often and whenever the grade of such street is changed so that every part of each track shall always be kept at the duly estab. lished grade line, or as near thereto as the surface of the grade of the street outside thereof will permit. Section 4: Said Northern Texas Traction Company and its successors and a;:signs do hereby agree to indemnify and hold the City of Fort Worth harmless because of, and promptly pay off and discharge or repay to the said City all damages,claims, attorneys fees and other costs and expenses rendered against or incurred or paid out by the said City by reason of injuries either to persons or property occasioned as the proximate result of anything done or permitted, or in any way proximately arising out of the construction, operation or maintenance, upon the above mentioned streets and throroughfares, or the tracks, poles or wires of the said company. Section 5: The City Engineer shall direct and point out the places at which poles erected under this ordinance shall be set; provided, always that no poles shall be set in violation of any City ordinance. Section 6: All the limitati -)ns, provisions and conditions contained in the ordinance referred to granting the franchise on said ',lain Street shall continue in force, and shall govern and co,.trol, in addit'.on to the provisions of this ordinance, the operation and constraction of the contemplated extension of the present line as hereby granted.
