ORDINANCE NO. 77 426
AN ORDINANCE VACATING, ABANDONING AND CLOSING
PORTIONS OF FOREST AVENUE AND HART STREET ADJACENT
TO BLOCKS 4, 5 AND 21 OF THE ORIGINAL TOWN OF HANDLEY,
LOCATED IN THE CITY OF FORT WORTH, TARRANT COUNTY,
TEXAS; PROVIDING FOR THE REVERSION OF THE FEE IN SAID
LAND; SAVE AND EXCEPT EASEMENTS ARE RESERVED FOR ANY
AND ALL EXISTING OR PROSPECTIVE UTILITIES; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING THAT
THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the portions of Forest Avenue and Hart Street adjacent
to Blocks 4, 5 and 21 of the Original Town of Handley, located
in the City of Fort Worth, Tarrant County, Texas, and being
more particularly described as follows:
Parcel No. 1
Beginning at a point for the Northeast corner of Lot
1-R, Block 4, Original Town of Handley, located in
the City of Fort Worth, which point for corner is in
the Westerly line of Forest Street;
THENCE Southwesterly along and with the Easterly line
of said Lot 1-R and the Westerly line of Forest Street
135' to a point for the Southeast corner of Lot 1-R;
THENCE Southeasterly along and with the Southerly
line of Block 4 produced 20' to a point for corner;
THENCE Northeasterly 20' from and parallel to the
Westerly line of Forest Street 135' to a point for
corner;
THENCE Northwesterly 20' to the point of beginning.

Beginning at a point for the Southwest corner
of Lot 12, Block 5, Original Town of Handley,
located in the City of Fort Worth;
THENCE Southwesterly with the Westerly line
of Block 5 produced 20' for a point for corner;
THENCE Southeasterly 20' from and parallel to the
Southerly line of Block 5, 200' to a point for
corner;
THENCE Northeasterly 20' to a point for the Southeast
corner of Lot 5, Block 5, Original Town of Handley
in the Northerly line of Hart Street;
THENCE Northwesterly with the Northerly line of
Hart Street and the Southerly line of Lots 5
through 12, Block 5, to the place of beginning.
Parcel No. 3
Beginning at a point for the Northwest corner
of Lot 12, Block 21, Original Town of Handley,
located in the City of Fort Worth, which point
for corner is also in the Southerly line of
Hart Street;
THENCE Northeasterly with the Westerly line of
Block 21 produced 20' to a point for corner;
THENCE Southeasterly 20' from and parallel to
the Southerly line of Hart Street 300' to a
point for corner;
THENCE Southwesterly 20' to the Northeast corner
of Lot 1, Block 21, being in the Northerly line
of Block 21and the Southerly line of Hart Street
300' to the place of beginning.
be and the same are hereby vacated, abandoned and closed as a
street or public thoroughfare of any kind or character whatever;
SAVE AND EXCEPT easements are reserved for any and all existing
or prospective utilities.
SECTION 2.
That the fee to the land in the above described vacated
streets is hereby released and will revert to the adjacent
owners as provided by law, SAVE AND EXCEPT that easements are
reserved for any and all existing or prospective utilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage and
it is so ordained.

Charles R. Mulkey, owner of Lot 1-R, Block 4; Lots 8-12, Block 5; and Lots
1-6 and the north 85' of Lots 7 thru 12, Block 21, with the consent of Bill B.
Bladwin, owner of Lots 5-7, Block 5, all in the Original Town of Handley, has
requested that the City vacate extra right-of-way of. Forest Avenue in the
7�-wQ,-ro 1000 block a width of 20 feet on the west side and a length of 135 feet adjacent,
to Lot 1R, Block 4, from the north line of Lot 1-R, Block 4, south to the
P" - line of Hart Street, reducing the right-of-way to 60 feet, and to vacate extra
right-of-way of Hart Street in the 6500 block a width of 20 feet and a length
of 200 feet on the north side of the street adjacent to Lots 5 thru 12, Block
5 from the east line of Forest Avenue eastward to the east line of Lot 5,
Block 5, and on the south side of the 6500 block a width of 20 feet for a
length of 300 feet adjacent to Lots 1 thru 12, Block 21, Original Town of
Handley, reducing the right-of-way from 100 feet to 60 feet.
Subject rights-of-way, acquired by dedication, are partially improved with
some street paving, curb and gutter. A fire plug, water, sewer, gas, electric
and telephone facilities are all contained within portions of area to be
vacated. The agencies responsible for these various facilities have requested
that appropriate easements be retained.
Reviewing City departments and private utility companies have reviewed this
request and have no objections provided the vacated rights-of-way are replatted
with the adjacent property, the vacated right-of-way is retained as an ease-
ment for existing utilities and provisions are made for future paving, curb
and gutter.
The Plan Commission has reviewed this request and recommends that an ordinance
be adopted vacating subject right-of-way as requested. A satisfactory replat
has been submitted to City staff and assessment paving petitions have been
received for all property included in the replat.
Recommendation
It is recommended that an ordinance be adopted vacating subject rights-of-way
as recommended by the City Plan Commission.
