AMENDMENT N0. 2 TO CITY SECRETARY CONTRACT NO, 38056
This amendment to City Secretary Contract No. 38056 is made and entered into
by and between the City of Fort Worth ("City"), a home rule municipal corporation
organized under the laws of the State of Texas, acting by and through Tom Higgins, it's
duly authorized Assistant City Manager, and the Housing Authority of the City of Fort
Worth d/b/a the Fort Worth Housing Authority ("FWHA"), a Texas municipal housing
authority, acting by and through its duly authorized President and CEO, Barbara Holston.
The City and the FWHA may be referred to herein individually as a "Party" and
collectively as the "Parties".
Recitals
A. The City and FWHA previously entered into an agreement, recorded in a
public document on file in the City Secretary's Office as City Secretary Contract No.
38056 (the "Agreement"), pursuant to which FWHA agreed to provide assistance with
the City's Homelessness Plan, Directions Home: Malting Homelessness Rare, Short -
Term and Non -Recurring in Fort Worth, more specifically providing services for the
rental assistance program called the Directions Home Voucher Program (the
"Program").
B. The Parties subsequently amended the Agreement, recorded in a public
document on file in the City Secretary's Office as City Secretary Contract No. 38056-A1,
in which they agreed to pay an administrative fee of 8% to FWHA and agreed that if any
funds remained after providing rental assistance for 100 individuals, that the additional
funds would be used to provide for additional individuals.
C. Section 2 of the Agreement allowed the Parties to renew the Agreement
up to twelve months by mutual written agreement if necessary for the completion of the
program.
D. The Parties agree that it is necessary for the completion of the program to
renew the Agreement for twelve months. The city has appropriated sufficient funds in its
current fiscal year budget to pay FWHA for work undertaken in the extended period of
the term, and the Parties wish to extend the term until December 18, 2010, in order for
FWHA to complete a second year of work in the Program.
NOW, THEREFORE, in consideration of the mutual benefits and
promises contained herein and for other good and valuable consideration, the receipt and
sufficiency of which if hereby acknowledged, the City and FWHA agree as follows:
1. The term of the Agreement is hereby extended to expire on December 18,
2010 unless terminated earlier in accordance with the Agreement.

2. All provisions of the Agreement that are not specifically amended by this
Amendment shall remain in full force and effect. All capitalized terms used but not
defined in this Amendment shall have the meanings ascribed to them in the Agreement.
