AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR
THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF
FORT WORTH, TEXAS, AND THE ANNEXATION OF 4.2 ACRES
(0.007 SQUARE MILES) OF LAND, MORE OR LESS, WHICH SAID
TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT
BOUNDARY LIMITS OF FORT WORTH, TEXAS; PROVIDING THAT
THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF
TAXES; PROVIDING THAT THE INHABITANTS THEREOF SHALL
HAVE ALL THE PRIVILEGES OF ALL THE CITIZENS OF FORT
WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND
EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING
THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR
ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING FOR
SEVERABILITY AND NAMING AN EFFECTIVE DATE.
WHEREAS, a public hearing before the City Council of
the City of Fort Worth, Texas, wherein all interested
persons were provided with an opportunity to be heard on the
proposed annexation of the territory hereinafter described,
was held at the City Council Chambers in the Municipal
Office Building of Fort Worth, Texas, on the 21st day of
March, 1978, which date is not more than twenty (20) nor
less than ten (10) days prior to the institution of annexation
proceedings; and
WHEREAS, notice of such public hearing was published
prior thereto in a newspaper having general circulation in
the City of Fort Worth, Texas, and in the hereinafter described
territory on the loth day of March, 1978, which date was not
more than twenty (20) nor less than ten (10) days prior to
the date of the public hearing; and
WHEREAS, the population of the City of Fort Worth,
Texas was in excess of 367,000 inhabitants on January 1,
1963 and in excess of 400,000 inhabitants on January 1,
1978; and
WHEREAS, the corporate area of the City of Fort Worth,
Texas was 152.580 square miles on January 1, 1963 and was
241.838 square miles on January 1, 1978; and
WHEREAS, the hereinafter described territory lies
within the exclusive extraterritorial jurisdiction of the
City of Fort Worth, Texas; and
WHEREAS, the hereinafter described territory lies
adjacent to and adjoins the City of Fort Worth, Texas; and
WHEREAS, the hereinafter described territory contains
4.2 acres (0.007 square miles) of land, more or less;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That the following described land and territory lying
adjacent to and adjoining the City of Fort Worth, Texas is
hereby added to and annexed to the City of Fort Worth,
Texas, and said territory hereinafter described shall
hereafter be included within the boundary limits of the City
of Fort Worth, Texas, and the present boundary limits of
said City, at the various points contiguous to the area
hereinafter described, are altered and amended so as to
include said area within the corporate limits of the City of
Fort Worth, Texas, to-wit:
BEING a part of the Peterson Pate Survey, Abstract No.
1202, and a part of a "Second Tract" as conveyed to J.
M. Leonard, Trustee, by deed recorded in Volume 2952,
Page 578 of the Deed Records of Tarrant County, Texas,
and being more particularly described as follows :
BEGINNING at the southwest corner of Lot 10, Block 15,
Westover Hills, as recorded in Volume 388-97, Page 17,
Deed Records of Tarrant County, Texas, said point also
being in an existing east-west city limit line;
THENCE N 89' 421 W, with the existing east-west city
limit line and the north line of Tracts A and D, West-
over Ridge, as recorded in Volume 388-31, Page 61, Deed
Records of Tarrant County, Texas, 526.4 feet to an
existing westerly southwest corner of the Village of
Westover Hills;
THENCE N 00 33' E, with an existing north-south city
limit line, 425.2 feet to the southwest corner of Lot
20, Block 15, Westover Hills;
THENCE with the back lines of Lots 10, 11, 18, 19 and
20, Block 15, Westover Hills, with the following
courses and distances: S 75' 231 E, 342.9 feet; S 611
521 E, 217.4 feet; and S 00 18' W, 238.9 feet to the
place of beginning and containing a total of 4.2 acres,
includes 0.5 acres in Plaza Parkway.
SECTION 2.
That the above described territory is shown on Exhibit
Map A which is attached hereto and expressly incorporated
herein by reference for the purpose of illustrating and
depicting the locations of the hereinabove described territory.

SECTION 3.
That the above described territory and the area annexed
shall be part of the City of Fort Worth, Texas, and the
property so added hereby shall bear its pro rata part of the
taxes levied by the City of Fort Worth, Texas, and the
inhabitants hereof shall be entitled to all of the rights
and privileges of all the citizens and shall be bound by the
acts, ordinances, resolutions and regulations of the City of
Fort Worth, Texas.
SECTION 4.
That thereafter the City Limit Line of Fort Worth shall
be:
A part of the Peterson Pate Survey, Abstract No. 1202,
and a part of a "Second Tract" as conveyed to J. M.
Leonard, Trustee, by deed recorded in Volume 2952, Page
578 of the Deed Records of Tarrant County, Texas, and
being more particularly described as follows:
BEGINNING at the southwest corner of Lot 10, Block 15,
Westover Hills, as recorded in Volume 388-97, Page 17,
Deed Records of Tarrant County, Texas, and said point
also being in an existing east-west city limit line.
THENCE with the back lines of Lots 10, 11, 18, 19 and
20, Block 15, Westover Hills, with the following
courses and distances: N 00 181 E, 238.9 feet; N 610
521 W, 217.4 feet; and N 750 23' W, 342.9 feet to a
point for corner in said city limit line.
SECTION 5.
That this ordinance shall and does amend every prior
ordinance in conflict herewith, but as to all other ordin-
ances or sections of ordinances not in direct conflict, this
ordinance shall be, and the same is hereby made cumulative.
SECTION 6.
That it is hereby declared to be the intent of the City
Council that the sections, paragraphs, sentences, clauses
and phrases of this ordinance are severable, and if any
phrase, clause, sentence paragraph or section of this ordin-
ance shall be declared unconstitutional by the valid judgment
or decree of any court of competent jurisdiction, such
unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs and sections of this

ordinance, since the same would have been enacted by the
City Council without the incorporation in this ordinance of
any unconstitutional phrase, clause, sentence, paragraph or
section.
SECTION 7.
That this ordinance shall take effect and be in full
force and effect from and after its passage, and it is so
ordained.

0n January 24, 1978, the City Council adopted a joint resolution providing
for realignment of the boundaries between Fort Worth and Westover Hills
(M&C PZ-833) . The City Council also authorized and directed the staff
to submit boundary adjustment ordinances as necessary to effectuate the
terms of the agreement.
The Westover Hills Town Council adopted an ordinance which discontinues
the area to be annexed by Fort Worth at its meeting on February 7, 1978.
The area is now in the extra-territorial jurisdication of Fort Worth
and annexation proceedings may now begin.
A map of the area to be annexed and a timetable are attached.
Recommendation
It is recommended that City Council set a public hearing on the proposed
annexation for March 21, 1978 and authorize and direct the City Secretary
to publish the required Notice of Public Hearing on Contemplated Annexation.
