HEARING.
SUBJECT: Authorize Execution of a Contract with Jackson Construction,Ltd.,in the Amount of$659,077.50 for
�. the Scott-Sunset Drainage Improvements(COUNCIL DISTRICT 7)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of a contract with Jackson
Construction,Ltd.,in the amount of$659,077.50 for construction of the Scott-Sunset Drainage
Improvements project.
DISCUSSION:
The construction contract recommended by this Mayor and Council Communication is for the
installation of storm drain pipe,inlets and curb and gutter improvements to correct street flooding on
Scott Road and Nursery Lane.
Costs for the implementation of this project will be funded by the Storm Water Capital Projects Bond
Fund.
The project was advertised for bid on May 3,2012 and May 10,2012 in the Fort Worth Star-
Telegram.On June 14, 2012,the following bids were received:

It is recommended that a contract be awarded in the amount of$659,077.50 to Jackson Construction,
Ltd.
Funding in the amount of$86,500.00 is included for associated construction survey,project
management,materials testing,and inspection.The contingency fund for possible change orders is
$25,000.00.
Jackson Construction,Ltd.,is in compliance with the City's MANBE ordinance by committing to eight
percent MIWBE participation and documenting good faith effort.Jackson Construction,Ltd., identified
several subcontracting and supplier opportunities.However,the MNVBEs contacted in the areas
identified did not submit the lowest bids.The City's goal on this project is 18 percent.
This project is located in COUNCIL DISTRICT 7, Mapsco 61W and 61X.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current capital
budget,as appropriated,of the Stone Water Capital Projects Bond Fund.

The Specifications, Contract Documents and Drawings for the above mentioned project are revised and
amended as follows:
GENERAL CLARIFICATIONS AND CHANGES:
1. The bid opening date has been revised. In an effort to provide further geotechnical information the
bid opening date has been rexlicAri t� li ine 14, 2 112. Bids:".'III b rAceived by the�`H. of Fart
Worth Purchasing Office until 1:39pm CST and will be opened publicly and read aloud at 2:00pm
CST in the Council Chambers.A separate addendum will follow including geotechnical
information gathered by soil bores collected at the project location.
CONSTRUCTION PLANS:
2. Remove and replace plan sheet No.8 with the sheet in this addendum. The following revisions
have been made:
a. The dimensions of the proposed concrete block mattress and temporary sheet piling have
been revised.
b. The block size for the concrete block mattress has been specified as CC 35. Refer to the
Product Requirements section of the Project Manual Appendix for information on block
sizes.
.� c. The bottom of the junction box at Sta. 5+64.09 has been raised from 563.53 to 565.53.
CONTRACT DOCUMENTS:
~ 3. Remove and replace the bid proposal with the proposal in this addendum. The following revisions
have been made:
a. Line Item 1-07"Special Riprap"has been revised from 85 SY to 45 SY.
b. Line Item 1-20"48" HDPE Pipe" has been revised from 976 LF to 972 LF.
c. Line Item I-39"Trench Safety" has been revised from 1301 LF to 1297 LF.
d. Line Item 1--53"Post-CCTV Inspection" has been added.All proposed storm drain shall
have Post-CCTV Inspection performed per City Specification 33 01 31.
INFORMATION TO BIDDERS:
This Addendum No. 1, forms part of the Specifications & Contract Documents for the above referenced
project and modifies the original Specifications &Contract Documents of the same.
Acknowledge your receipt of this Addendum No. 1 by completing the requested information at the
following locations:

2 AGREEMENT
3 THIS AGREEMENT,authorized on A U G _-7 012 is made by and between the C iffy of Forth
4 Worth, a Texas home rule municipality,acting by and through its duly authorized City Manager,
5 ("City"), and Jasckson Construction, Ltd., authorized to do business in Texas, acting by and
6 through its duly authorized representative, ("Contractor'').
7 City and Contractor, in consideration of the mutual covenants hereinafter set forth, agree as

9 Article 1.WORD
to Contractor shall complete all work as specified or indicated in the Contract Documents for the

18 3.1 Time is of the essence.
19 All time limits for Milestones, if any, and Final Acceptance as stated in the Contract
20 Documents are of the essence to this Contract.
21 3.2 Final Acceptance.
22 The work will be complete for Final Acceptance within 1180) days after the date when the
23 Contract Time commences to run as provided in Paragraph 2.03 of the General Conditions.
24 3.3 Liquidated damages
25 Contractor recognizes that time is of the essence of this Agreement and that City will
26 suffer financial loss if the Work is not completed within the times specified in Paragraph
27 3.2 above, plus any extension thereof allowed in accordance with Article 12 of the
28 General Conditions. The Contractor also recognizes the delays, expense and difficulties
29 involved in proving in a legal proceeding the actual loss suffered by the City if the Work
30 is not completed on time. Accordingly, instead of requiring any such proof, Contractor
31 agrees that as liquidated damages for delay (but not as a penalty), Contractor shall pay
32 City Six Hundred Fifty-Nine Thousand Seventy-Seven and 5W100 Dollars
33 ($g2&77..50 for each day that expires after the time specified in Paragraph 3.2 for Final
34 Acceptance until the City issues the Final Letter of Acceptance.

74 6.1 Contractor covenants and agrees to indemnify, hold harmless and defend, at its own
75 expense, the city, its officers, servants and employees, from and against any and all
76 claims arising out of,or alleged to arise out of, the work and services to be performed
77 by the contractor, its officers, agents, employees, subcontractors, licenses or invitees
78 under this contract. This indemnification Rrov_s on is sgecifcaft intended to overate
79 and be effective even if it is alleged or Broven that all or some of the damages heirs
80 soht were caused in whole or in�art. by any act;omission or negligence of the city.
81 This indemnity provision is intended to include, without limitation, indemnity for
82 costs,expenses and legal fees incurred by the city in defending against such claims and
83 causes of actions.

95 7.1 Terms.
96 Terms used in this Agreement which are defined in Article 1 of the General Conditions will
97 have the meanings indicated in the General Conditions.
98 7.2 Asslgmnent of Contract.
99 This Agreement, including all of the Contract Documents may not be assigned by the
+� 100 Contractor without the advanced express written consent of the City.
101 7.3 Successors and Assigns.
142 City and Contractor each binds itself, its partners, successors, assigns and legal
103 rcpresentatives to the other party hereto, in respect to all covenants, agreements and
104 obligations contained in the Contract Documents.
105 7.4 Severability.
106 Any provision or part of the Contract Documents held to be unconstitutional, void or
�,. 147 unenforceable by a court of competent jurisdiction shall be deemed stricken, and all
108 remaining provisions shall continue to be valid and binding upon CITY and
109 CONTRACTOR.
+P 110 7.5 Governing Law and Venue.
111 This Agreement, including all of the Contract Documents is performable in the State of
112 Texas. Venue shall be Tarrant County, Texas, or the United States District Court for the

114 7.6 Other Provisions.
#,. 115 The Contractor agrees to pay at least minimum wage per hour for all labor as the same is
116 classified, promulgated and set out by the City, a copy of which is attached hereto and
117 made a part hereof the same as if it were copied verbatim herein.

119 Contractor shall attach evidence of authority to sign Agreement, if other than duly
120 authorized signatory of the Contractor.
