AN ORDINANCE AMENDING ORDINANCE NO. 2082, BEING AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND'LAND FOR TRADE, INDUSTRY, RESIIENCE, OR OTHER PURPOSE, THE HEIGHT, NUMBER OF STORIES, AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, AND THE DENSITY OF POPULATION, AND FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO SUCH DISTRICTS OF NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST BY FIXING DEFINITE USES OF THE BUILDINGS HEREINAFTER ERECTED IN SAID DESCRIBED AREAS FROM THE USES AS SHORN ON THE MAPS CONTAINED IN SAID ORDINANCE NO. 2082: PRE- SCRIBING A SAVINGS CLAUSE; PROVIDING A FINE OF NOT LESS THAN $5.0o NOR MORE THAN $50.00'FOR EACH OFFENSE, AND THAT EACH DAY THAT A VIOLATION IS PERMITTED TO EXIST SHALL CONSTITUTE A SEPARATE OFFENSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Ordinance No. 2082 be amended so that the following described uses in the hereinafter described areas be altered, changed and amended as follows to wit: RECOMMENDED CHANGE AREAS FROM TO Lots 25, 26 and 27, Block 45, Chamberlin Arlington Heights First Filing "C" "F° (4930 Collirvrood Avenue) The 3200t of Tracts 55, 56, 57 A and 57 in the J. L. Purvis Survey; and, Lots 13, 14, 15 and 16, Turner's Subdivision "B" "C" (4500 & 4600 Blka. E. Lancaster - North aide) That part annexed to the City, July 20, 1949, being part of the T. & P. Railaray Survey, T. B. Taylor Survey and J. Armandaris Survey, to South Hills Addition "Annexed Area" "B" (South of Kellis Park Addition) That part annexed to the City, November 2, 1949 and being 38.42 acre tract of land out of the L. Westmore Survey "Annexed Area" "B" (Seminary Drive and U. S. Hxy_,#81) Lot A, Pitts Subdivision "A" "E" (N.W. corner Berry & Lubbock Ave.) Lots 1, 2 and 3, Block 2, College Hill Addition "D" "G" (1000 Blk. Pennsylvania Ave. - South side) Lots 21 through 40, Block 55; and, Lots 1 through 20, Block 82, Chamberlin Arlington Heights, First Filing "B" "A" (5700 Block E1 Campo Avenue) r t A part of the S. J. Callaway tract in the N. H. Carroll Survey, described as follows: beginning at the northwest corner of Highway #183 and Callaway Road, thence northwesterly along the northerly line of said road a dis- tance of 750 feet to a point, thence North 67 degrees, East 585 feet to a point, thence East 186 feet to a point, thence South 506 feet to a point, thence southwesterly along the northerly right-of-ray line of Highway #183 a dis- tance of 306 feet to the place of beginning "B" "E" (Northwest corner Highway #183 & Callaway Rd.) That paragraph and exception No. 4 of SECTION 19 of Ordinance No. 2082 be and amended, and after being amended, it shall hereafter read as follows: (4) a. To permit a public garage or public parking area in a Commercial District under special conditions where it is deemed necessary for the public convenience or welfare. b. To permit as auxiliary use, a parking area for passenger automobiles only on a lot or lots in Districts "A", "B", "C", or "D" which adjoin a lot in a Commercial or Industrial District, for use by customers of business establishments, pro- viding such parking area is developed as follows: Such parking area shall be provided with permanent type of hard surface and shall be properly enclosed with a fence, or other suitable enclosure, having a height of not less than three (3) feet. Such fence, or enclosure shall observe the required yard regulations of the district in which it is located. Any lights used to illuminate said parking area shall be so arranged as to direct the light away from any adjoining premises in a District "C" or "D". Amend Line 61 of SECTION 7 to read as follows: 61. Tar or asphalt roofing or waterproofing manufacture. Amend Lines 26, 29 and 30 of SECTION 8 to read as follows: 26. Smelting or reclamation (by reduction) of tin, copper, lead, zinc or iron ores. 29. Tannery, curtiery or storage or raw hides or skins. 30. Tar or asphalt roofing or waterproofing manufacture. SECTION 2. Should any section, clause or provision of this ordinance be declared by the Court to be invalid, the same shall not affect the validity of the Ordinance as a whole or arq part thereof, other than the part so declared to be invalid. SECTION 3• Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five and no/100 Dollars ($5.00) nor more than Fifty and no/100 Dollars ($50.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 4.
