AN ORDINANCE WITI; RESPECT TO CERTAIN BUILDING
- 'TCROACD14-ENTS OF THE BUILDING LOCATED 011 LOTS
5.6,7,8, in RLOCX D-6 OF DAGGETT'S ADDITION TO
FORT WORTH, TARRANT COUNTY, TEXAS (SAME BEING
LOCATED AT THE SOUTHEAST CORNER OF THE. INTFR-
SF.CTION OF TENTH STREET AND HOUSTIF STREET IN
SAID CITY OF FORT WORTH, TEXAS; PERMITTING
ERNEST CLOSUIT, HIS HEIRS AND ASSIGNS, TO LEAVE
THE EXISTING BUILDING ENCROACHMENT BY THE NORTH
WALL OF 9 INCHES ON SAID TENTH STREET AND BY THE
CORNICE OF SAID NORTH WALL OF 21 INCHES OVER
SAID TENTH STREET, BND BY THE OORNIC E OF THE
WEST WALL OF SAID BUILDING OF 7-2/10 INCHES OnR
SAID HO"STOIT STREET: AND PROVIDIND THAT SAID
ERNEST CLOSUIT, NOR HIS HEFIRS OR A7ISIGNS, SHALL
NOT BE CHARGED ANY AMOUNT FOR SUCH USE OF SAID
PORION (TF' SAID TWO STRFFTS COVERED BY SADI
ENCROACHMENTS, ABOVE SET OUT; REPEALING ALL
ORDINANCES IN CONFLICT AND SPECIFYING AND ER-
FECTIVE DATE.
Whereas, Ernest Closuit9f Fort Worth, Texas, is the owner of Lots 5,6,7,8 in Block B-6 of Daggett's
Addition to Fort Worth, Tarrant County, Texas (Situated at the Southeast corner of the intrersection of
Houston Street and Tenth Street in said City of Fort Worth. Texas(; together with the three-story building
located thereon; along the North and West lines of which property there exist building encroachments on
said Tenth Street and Houston Street respectively.
NOW THEREFORE: BE IT ORDINACCD BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEYAS:
SECTION I
That Yrnest Closuit, the owner of said land above described and the improvements thereon, his heirs
and assigns, be permitted to leave the following existing building encroachments of said building, above re-
ferred to, namely: the encroachment by the North wall of said building of Nine (9) inches on said Tenth
Street and the encroachment by the cornice of said North pall of said building of twenty-one (21) inches over
said Tenth Street, and the encroachment by the cornice of the West Wall of said building of seven and two-
tenths (7 2/10) inches over said Houston Street; and that said Ernest Clnsuit, nor his heirs or assigns, shall

ti not be charged any amount for such use of portion of said Tenth Street and said Houston Street so encroadhed
„ upon as above set out; and that said improvements on said above described land be allowed to stand durina the �
life of said building as same to now constructed; provided however, that in the event such building be demo-
lished or maf or alterations and repairs be made to said building in the future, that such encroachments be
eliminated.
SECTION II.
That all ordinances or parts of ordinances in conflict with the Drovisions of this ordinance are
hereby expressly repealed.
SECTION III.
That this ordinance shall take effect and be in full force and effect from and after the date of its
passage, and it is so ordained.

TO THS HONORABLE MAYOR AND CITY COUNCIL OF CITY OF FORT WORTH:
Comes Ernest Closuit,a resident of Fort Worth,Texas,and
would show and represent as follows:
That he is the owner of the following described property,
including the three-story building located thereon, situated
at the Southeast corner of the intersection of Houston Street
and Tenth Street in the City of Fort Worth,Texas,namely:
Lots 5,6,7,8 in Block B-6 of Daggett's
Addition to Fort Worth,Tarrant County,
Texas;
That a recent survey of the above property disclosed:
that the North wall of said building encroaches nine(9)inches
on said Tenth Street,and that the cornice of said North wall
of said building(which extends upward from the top of its
first f loor)encroaches twenty-one(21)inches over said Tenth
Street; that the cornice of the West wall of said building
(which extends upward from the top of its first f loor)en-
croaches seven and two-tenths(7-2/10)inches over said Houston
Street.
That said building has been so erected and used,and said
encroachments have so existed for some fifty(50)years to the
best of Petitioner's understanding; during all of which period
of time there has never been an objection made by the Authorities
of the City of Fort Worth with respect to said encroachments and
the use of said portions of said streets so encroached upon,in
so far as Petitioner knows.

Petitioner requests your Honorable Body to grant and enact
an ordinance permitting said encroachments to continue to exist
and providing that Petitioner,nor his heirs or assigns,shall not
be charged any amount for such use of said portion of said streets
covered by said encroachments above set out.
