AN ORDINANCE AMENDING ORDINANCE No. 3647, BEING
AN ORDINANCE REGULATING JUNK DEALERS AND SECOND-
HAND DEALERS, PASSED AND ADOPTED ON THE 29TH DAY
OF MAY, 1957, BY ADDING SECTION 15b, PRESCRIBING
A SEVERABILITY CLAUSE, PROVIDING A PENALTY AND
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That Ordinance No. 3647, passed and adopted on the 29th day of May, 1957,
and amending Ordinance No. 3162, be amended by adding thereto the following section:
Section 15b. Provided, however, that the foregoing section wherein it re-
quires the taking of a thumbprint shall not be applicable to transactions wherein a
junk dealer or secondhand dealer shall purchase junk or merchandise from a person,
firm or corporation having a valid license or permit to transact and engage in a
lawful business or occupation, whether such license or permit be issued by the City
of Fort Worth, the State of Texas or the United States of America, and in such trans-
actions the identification of the seller of the junk or merchandise shall be deemed
sufficient if the junk dealer or secondhand dealer shall make a notation of the type
and number of such license or permit! The requirement for the taking of a thumb-
print by a ,junk dealer or secondhand dealer shall not be applicable in any trans-
action wherein the junk dealer or secondhand dealer purchases merchandise or material
from a householder in the City of Fort Worth when such householder sells or delivers
the merchandise to the junk dealer or secondhand dealer at the residence of the
householder, and in such cases, the identification required shall be sufficient if
the junk dealer or secondhand dealer shall make a'record showing the name and address
Of the householder and the address where the merchandise was purchased by said junk
dealer or secondhand dealer.
SECTION 2.
If any provision, section, subsection, clause or phrase of this ordinance,
or the application of same to any person or set of circumstances, is for any reason
held to be unconstitutional, void or invalid, or for any reason unenforceable, the
validity of the remaining portions of this ordinance or their application to other

persons or sets of circumstances shall not be affected thereby, it being the intent
of the City Council of the City of Fort Worth in adopting this ordinance that no
portion thereof or provision or regulation contained herein shall become inoperative
or fail by reason of any unconstitutionality or invalidity of any portion, provision
or regulation, and to this end all provisions of this ordinance are declared to be
severable.
SECTION 3•
Any person who violates, disobeys, omits, neglects or refuses to comply
with or who resists the enforcement of any of the provisions of this ordinance shall
be fined not to exceed Two Hundred Dollars ($200.00) for each offense, and each day
that a violation is permitted to exist shall constitute a separate offense.
SECTION 4.
This ordinance shall take effect and be in full force and effect from and
after its passage and publication as provided by law.
