AN ORDINANCE APPROVING THE REPORT OF THE PUBLIC WORKS DEPARTMENT: AWARDING THE CONTRACT OF THE IMPROVEMENT OF SYLVANIA AVENUE, SYLVANIA AVENUE EXTENSION, AND RIVERSIDE DRIVE, IN THE CITY OF FORT WORTH, TEXAS, AJD AUTHORIZING ITS EXECUTION; AND DIRECT- ING THE CITY ENGINEER TO PREPARE ESTIMATES WHEREAS, by Ordinances Nos. 2811 and 4109 passed and approved by the City Council of the City of Fort Worth, the City Council determined the necessity for and ordered the improvement of a portion of the following streets, to-wit: SOUTH SYLVANIA AVENUE: from the southerly line of East Fourth Street to the northerly ]wine of Fisher Avenue, known and desig- nated as Unit No. f; SYLVANIA AVENUE EXTENSION: from the northerly line of Fisher Avenue to the westerly line of Riverside Drive, known and desig- nated as Unit No. 2; RIVERSIDE DRIVE: from 110 feet South of the northerly line of Lot 8 Adams Heirs Subdivision, to the northerly line of line of Lot 34, Lincoln Place Addition, known and designated as Unit No. 3 of the Sylvania Avenue Extension. WHEREAS, subsequent to the passage and approval of said Ordinance, Plans and Specifications for said improvements were submitted by the Public Works Director and said Plans and Specifications were approved and adopted by the City Council; and, WHEREAS, Notice to Bidders was given as required by the City Charter; and, WHEREAS, the bid of Texas Bitulithic Company was found to be the lowest and best bid for the making and construction of said improvements, to-wit; Excavation of present streets, construction of 7" Reinforced Concrete Pavement with combined curb and gutter and necessary appurtenances, all as provided by said Plans and Specifications; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT,WORTH, TEXAS: SECTION.1. That the work of making and constructing such improvements and contracts therefor is hereby awarded to Texas Bitulithic Company, at and for the prices stated in the proposal of the said Company and as reported and recommended by the Public Works Department. The City Manager and City Secretary are hereby directed to execute the said contract in the name of the City of Fort Worth, Texas, and to impress the corporate seal of the City thereon, the said contract embracing therein, among other things, the prices for the work. SECTION 2. That to provide for the payment of the indebtedness incurred by the City of Fort Worth by said Contract, there is hereby appropriated out of available funds, which have been set aside for said purpose an amount sufficient to pay said indebtedness so incurred. SECTION 3. That the Public Works Director of the City of Fort Worth be, and he is hereby ordered and directed to file with the City Council estimates of the cost of such improvements in accordance with the terms of the powers and pro- visions of Chapter 106 of the acts of the First called session of the Fortieth Legislature of the State of Texas, now shown as Article 1105b of Vernon's Civil Statutes of the State of Texas, Annotated, which law has been adopted as an ammndment to and made a part of the Charter of the City of Fort Worth.
