SNELL, THEIR HEIRS, EXECUTORS, ADMINISTRATORS AND ASSIGNS, TO LEAVE THEIR EXISTING APARTMENT BUILDING FOR A MAXIMUM DISTANCE OF 2.8 FEET IN THE ALLEY ADJA- CENT TO THE SOUTH PROPERTY LINE OF THE EAST 100'x46' OF LOT 9, BLOCK 2, SMITH, JONES AND DAGGETT ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EF- FECTIVE IMMEDIATELY. WHEREAS, Harry E. Whitley and Charles E. Snell are the owners of the East 100 feet by 46 feet of Lot 9, Block 2, Smith, Jones and Daggett Addition to the City of Fort Worth, Tarrant County, Texas, along the south property line of which a property encroachment exists in the alley; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Harry E. Whitley and Charles E. Snell, the owners of said land above described and the improvements situated there- on, and their heirs, executors, administrators and assigns, be permitted to leave the existing building for a maximum dis- tance of 2.8 feet as said building now exists and is located in the alley adjacent to said tract of land, and that said im- provements be allowed to stand on said East 100'x46' of Lot 9, Block 2, Smith, Jones and Daggett Addition, during the life of said building, but in no event for a period in excess of twenty-five years; provided, however, that in the event such building be demolished or major alterations and repairs be made to same in the future, said building shall be reconstructed or repaired so as not to encroach upon the alley and so as to be in compliance with the then existing ordinances, rules and regulations of the City of Fort Worth, Texas. SECTION 2. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. APPROVED 'ArSI To FORM AND LEGALITY: City Attorney Mr. Thalia City of Fort Worth, Texas Mayor and Council Communication DATE NUMBER EncroachmentSUBJECT: Encroachment of Public Alley - PACE 3-11-63 L-44 304 St. Louis I Iof L On February 11, 1963, the Council approved the sale of 304 St. Louis, the east 100 feet of the south 46 feet of Lot 9, Block 2, Smith, Jones and Daggett Addi- tion, and all improvements thereon to Harry E. Whitely for $4,252. This sale is pursuant to Council action on April 9, 1962, wherein the Council authorized the sale of the property and stated its intentions to permit the present encroachment of the improvements (located 2.8 feet in the public alley south of the improvements) to remain in its present location so long as the building is used for its present use. In order to complete this transaction, it is recommended that the Council adopt an ordinance granting permission for the improvements at 304 St. Louis located on the east 100 feet of the south 46 feet of Lot 9, Block 2, Smith, Jones and Daggett Addition, to remain in their present location and extend 2.8 feet into the public alley so long as the improvements are used as they are presently.
