AN ORDINANCE AMENDING SECTION 328 OF CHAPTER 14 OF THE CODE OF THE CITY OF FORT WORTH, 1950, BEING A PROVISION FOR THE PROTECTION OF PROPERTY AND OF THE HEALTH AND WELFARE OF THE PUBLIC, BY REGULATING THE USE OF TENTS IN THE CITY; PRESCRIBING CERTAIN RE- QUIREMENTS FOR THE LOCATION AND ERECTION THEREOF; MAKING CERTAIN USES OF TENTS UNLAWFUL; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF OTHER FIRE PREVENTION AND PROTECTION ORDINANCES; PROVIDING A PENALTY FOR THE VIOLATION THEREOF; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 328 of Chapter 14 of the Code of the City of Fort Worth, 1950, be amended so that hereafter the same shall be and read as follows: Section 328. Tents -- Location, Erection and Use Requirements. (a) No tent or tents shall be erected to cover more than seventy-five per cent of the premises on which same are erected, nor shall any tent be erected closer than ten feet from other structures, except as here- inafter provided. Stake lines of adjacent tents shall be sufficiently distant from each other to provide an area to be used as a means of emergency egress. (b) Concession tents or other tents not occupied by the public need not be separated from each other and may be erected less than ten feet from other structures with the approval of the Chief of the Bu- reau of Fire Prevention. (c) Tents not exceeding twelve hundred square feet in area, when located on Fair grounds or in similar open spaces, may be erected less than ten feet from each other or from other structures with the approval of the Chief of the Bureau of Fire Prevention. (d) No tent shall be erected and used to house any manufacturing concern or warehouse. (e) No tent shall be erected and used to house, in whole or in part, any establishment engaged in re- tail business; provided however, that a tent may be used for such purpose during not more than two (2) non-consecutive periods, each not to exceed ten (10) days in duration, during any calendar year, when the use of such tent is incidental to the or operation of a permanent business establishment lo- cated on the same premises or on premises contiguous thereto. The ten day period herein provided shall include the time necessary to erect, use, and re- move from the premises any such tent. The use of tents for business purposes shall be subject to all requirements for the use of tents as places of as- sembly prescribed by ordinance of the City or by order of the Bureau of Fire Prevention. SECTION 2. Should any section, clause or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of this ordinance as a whole or any part thereof other than the part so declared to be invalid. SECTION 3. That this ordinance shall repeal every prior ordinance in con- flict herewith, but only insofar as the portion of such prior ordinance shall be in conflict, and as to all other sections of ordinances not in direct conflict herewith, this ordinance shall be and is hereby made cumulative except as to such ordinances or portions thereof as are expressly repealed hereby. SECTION 4. That any person who violates, disobeys, omits, neglects or refuses to comply with any provision of this ordinance shall be guilty of a misdemeanor and shall be punished by a fine not to exceed Two Hundred Dollars ($200.00). SECTION 5. That this ordinance shall become effective and be in full force and effect from and after its passage and publication as required by law. APPROVED AS TO FORM AND LEGALITY: 5, City Attorney City of Fort Worth, Texas Mayor or and Council Communication `O' DATE NUFMBERCE sus.1ECT:Amendment to Fire Prevention Code PAGE 4/13/64 G-630 Use of Tents 1of 1 As requested by the City Council on April 6, 1964, attached is an amendment to Sec. 328 of the Fire Prevention Code which permits the use of tents for retail sales purposes for limited periods of time, and subject to the same requirements relating to the use of tents for places of outdoor assembly as contained in the Fire Prevention Code and other City ordinances. The proposed amendment has been prepared by the Legal Department, and reviewed by the Fire Marshal and Building Commissioner. Under the provisions of the Fire Prevention Code, as may be amended by this pro- posal, a permit for the use of tents for retail sales purposes may be issued by the Building Commissioner and the Fire Marshal, subject to the .fol- -lowing conditions: 1) Use of the tent shall not be for more than two non-consecutive periods during any calendar year, each period not to exceed 10 days in duration. h 2) Use of the tent must be incidental to the operation of a permanent busi- ness establishment located on the same premises, or contiguous thereto. 3) Use of the tent must conform to all requirements of the Fire Prevention Code regarding use of tents for places of outdoor assembly, including: (a) size, location, structure, and erection requirements; F (b) requirements prescribed for fire resistance of the tent; (t) provision of adequate fire lanes, aisles, passageways and exits; (d) provision of police and fire details, if deemed necessary. 4) Use of the tent must conform to any other City ordinance relating to the use of tents for places of outdoor assembly.
