AN ORDINANCE AMENDING CHAPTER 28, ARTICLE I OF THE FORT
WORTH CITY CODE (1964); PROVIDING FOR THE CREATION'OF A
ZONING COMMISSION AND REDEFINING TERMS; SETTING FORTH
THE POWERS, JURISDICTION AND SCOPE OF ACTIVITIES OF THE
ZONING COMMISSION AND ADOPTING ALL OF THE POWERS
CONTAINED IN ARTICLES 1011a TO 1011k REVISED CIVIL
STATUTES OF -TEXAS, TOGETHER WITH ALL AMENDMENTS THERETO;
PROVIDING FOR THE REPEAL OF ALL ORDINANCES AND
RESOLUTIONS IN CONFLICT HEREWITH; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1
That Chapter 28,Article I of the Fort Worth City Code (1964) be and the same
is hereby amended so that said Article I of Chapter 28 shall hereafter be and read
as follows:
"CHAPTER 28.
PLANNING
ARTICLE I. ZONING COMMISSION
Sec. 28-1. Creation and Appointment
There is hereby created a Zoning Commission of the City of Fort Worth, Texas. to
be composed of nine (9) qualified electors of the City of Fort Worth. It is the
declared policy that the City Council will. consider for appointment to the Commission
only those persons who have demonstrated their civic interest, general knowledge of
the community, independent judgment, understanding of zoning and planning, and avail-
ability to prepare for and attend meetings, and who, by reason of diversity of their
individual occupations, constitute a Commission which is broadly representative of the
Community.
Sec. 28-2. Terms of Office
The terms of all Commission members appointed under the provisions of Ordinance
No. 3748 shall terminate upon the adoption of this Ordinance and the City Council
shall appoint nine (9) members of the Commission, four (4) of whom shall be designated
by the Commission to serve a term ending October 31, 1968, and five (5) of whom shall
be designated by the Commission to serve a tern ending October 31, 1967, and shall
report same to the City Council. Thereafter the terms of five (5) of the members
shall expire on October 31 of each odd numbered year and the terms of four (4) of the
members shall expire on October 31 of each even numbered year. The members of the
Commission shall be identified by place numbers one (1) through nine (9). The odd
numbered places shall expire in the odd numbered years and the even numbered places
shall expire in the even numbered years. Commission members may be appointed to succeed
themselves. Vacancies shall be filled for unexpired terms, but no member shall be
appointed for a term in excess of two years.
Sec. 28-3. Organization
The Commission shall hold an organizational meeting in November of each even
numbered year and shall elect a Chairman and Vice-Chairman from among its members
before proceeding to any other matters of business. The Planning Director of the
City of Fort Worth, or his designated representative, shall be the Secretary of the
Commission. The Commission shall meet regularly and shall designate the time and
place of its meetings. The Commission shall adopt its own rules of procedure and
keep a record of its proceedings in accordance with the provisions of this ordinance
and the Charter and comprehensive Zoning Ordinance of the City of Fort Worth. Newly
appointed members shall be installed at the first regular meeting after their appoint-
ment.

SAC. 28-4. Meetings and Quorum '
Six (6) members of the Commission shall constitute a quorum for the conduct of
-business. The members of the Commission shall regularly attend meetings and public
hearings of the Commission and shall serve without compensation, except for reim-
bursement for authorized expenses attendant to the performance of their duties.
Sec. 28-5. Duties and Powers
The City Zoning Commission is hereby charged with the duty and invested with
the authority to:
A. Inspect the property and premises where required in the discharge of
its responsibilities under the laws of the State of Texas and the
City of Fort Worth.
B. Advise the City Council relating to the creation and amendment of zodigg
regulations and districts as said Commission may deem beneficial and in
the best interests of the City of Fort Worth; it shall consult with the
City Plan Commission as necessary to insure proper coordination of zoning
with the long-range planning of the City.
C. Procure information, hold public hearings and make recommendations to the
City Council relating to the creation, amendment and implementation of
zoning regulations and districts as provided in Articles 1011a to 1011k
of the Revised Civil Statutes of Texas, together with all amendments
thereto, authorizing cities and incorporated villages to pass regulations
and all powers granted under said Act are specifically adopted and made
a part hereof as contemplated by Section 35 of Chapter XXVIII of the
Charter of the City of Fort Worth.
D. Insure that all of its recommendations are in accordance with the pro-
visions of Article 1011c, Revised Civil Statutes of Texas, and to that
end shall refer all proposals for initial zoning classification of newly
annexed areas to the City Plan Commission and shall not make its final
recommendation thereon until the City Plan Commission recommendation is
received, and shall refer such other matters to the City Plan Commission
as may be necessary to insure that its recommendations shall be in
accordance with such comprehensive plans as the City Council may approve.
A copy of the City Plan Commission's recommendation on newly annexed areas
shall be forwarded to the City Council as a preliminary report prior to the
Zoning Commission's public hearing.
Sec. 28-6. Staff Responsibilities
The Planning Director and his designated representatives shall be the regular
technical advisors to the Commission. When the Commission deems it necessary to
obtain information from other city departments it shall transmit such request through
the Planning Director.
Sec. 28-7. Attendance Reports
Each month a report shall be submitted to the City Council showing the cumulative
attendance of each member with notation of members who have been absent from three (3)
consecutive meetings."
SECTION 2
All ordinances or resolutions in conflict with the provisions of this ordinance
are hereby expressly repealed.
SECTION 3
If any section, subsection, sentence, clause or phrase.of this ordinance is
for any reason held to be unconstitutional, such holding shall not affect the
validity of the remaining portions of this ordinance, ,and the remainder of this
ordinance not so held to be unconstitutional shall continue to be in full force
and effect.
SECTION 4
This ordinance shall be in full force and effect from and after the date of
its passage.
