ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF SOUTH HENDERSON STREET AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH SRO ASPHALT, INC., ARLINGTON, TEXAS FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO- PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with SRO ASPHALT, INC., ARLINGTON, TEXAS for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: 1. SOUTH HENDERSON STREET From Broadus Street to Seminary Drive, known and designated as Unit 1,, Project No. 104-24000-181. 2. WEST ALLEN STREET From Enderly Place to Eighth Avenue,, known and designated as Unit 29 Project No. 104-24000-181. 3, BRYAN AVENUE From Magnolia Avenue to Morphy Street, known and designated as Unit 3, Project No. 104-24000--181. 4. FIFTH AVENUE From Beddell Street to Gambrell Street,, known and designated as Unit 4, Project No. 104-24000-181. 5. MORPHY STREET From South Main Street to Crawford Street, ]mown and designated as Unit 5, Project No. 104-24000-181. 6. BALDWIN AVENUE From Broadus Street to Seminary Drive, known and designated as Unit 6, Project No. 104-24000-181. 7. BALDWIN AVENUE From Seminary Drive to Flint Street, known and designated as Unit 7, Project No. 104-24000 181. 8. FULLER STREET From James Avenue to Stanley Avenue, known and designated as Unit 8, Project No. 104-24000-181. The City Council deleted from the contract this unit only at Benefit Hearing, November 11, 1968, M & C G-1307, and all prior proceedings in connection with same are hereby cancelled as provided for in Sec. 10, Art. 1105b, of the Revised Civil Statute of Texas as amended. 9. JOYCE DRIVE From the North line of Lot 12, Block 10, Highland Homes Addition to U. S. Highway 80 West. 10. SANDAGE AVENUE From the North Line of Lot 5, Block 18, to the North Line of Lot 4, Block 18, Prospect Heights Addition (East side of street onl9. WHEREAS, by sundry proceedings heretofore ej by the City Council of the City of Fort Worth, Texas, including Ordinance Nog- � , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance Nos. 6019 & 6023 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOWg THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT- I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II, The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows- III. When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the .caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. SOUTH HENDERSON FROM BROADUS STREET TO SEMINARY DRIVE, PROJECT NO. 104-24000-181, to be improved by constructing a six-inch thick hot-mix asphaltic concrete pavement on a lime stabilized subgrade with seven-inch high reinforced concrete curbs and two-foot wide reinforced concrete gutters, and by reconstructing an existing driveway to proper align- ment and grade, and by constructing five-inch thick concrete sidewalks where specified, so that the finished street will consist of one thirty-foot wide roadway.
