AN ORDINANCE AMENDING CHAPTER 2 OF EXHIBIT "B" OF ORDINANCE NO. 6408, AS
AMENDED, OF THE CITY OF FORT WORTH, SUCH ORDINANCE NO. 6408, AS AMENDED,
BEING THE MECHANICAL CODE OF THE CITY OF FORT WORTH; PROVIDING A SEVER-
ABILITY CLAUSE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF
ALL ORDINANCES AFFECTING MECHANICAL, AIR CONDITIONING AND OTHER APPLI-
ANCE SYSTEMS FOR BUILDINGS AND STRUCTURES IN THE CITY OF FORT WORTH;
PROVIDING FOR REPEAL; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE;
AND NAMING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That Section 208 of Chapter 2 of Exhibit "B" of Ordinance No. 6408,
as amended, be, and the same is hereby amended to read as follows:
"Sec. 208. Heating and Air Conditioning
Contractors, licensed by the City of
Fort Worth, may install any and all forms
of gas-fired heating equipment, all gas-
fired absorption cooling equipment and
all gas-fired boilers. Also such con-
tractors may extend and connect to such
equipment any gas piping that may be re-
quired for the operation of such
equipment.
"PROVISO: All L.P. gas piping installa-
tions shall conform to the applicable
Texas Railroad Commission regulations
governing such piping."
SECTION 2.
It is hereby declared to be the intention of the City Council that
the sections, paragraphs, sentences, clauses and phrases of this ordinance
are severable, and if any phrase, clause, sentence, paragraph or section
hereof shall be declared void, ineffective or unconstitutional by the
valid judgment or decree of any court of competent jurisdiction, such
voidness, ineffectiveness or unconstitutionality shall not affect any of
the remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City Council
without the incorporation herein of any such void, ineffective or uncon-
stitutional phrase, clause, sentence, paragraph or section.
SECTION 3.
That this ordinance shall repeal every prior ordinance in conflict
herewith, but only insofar as the portion of such prior ordinance shall
be in conflict, and as to all other provisions of existing ordinances
regulating mechanical, air conditioning and other appliance systems for
buildings and structures in the City of Fort Worth, this ordinance
shall be cumulative.
SECTION 4.
Any person violating any of the provisions of this ordinance shall
be deemed guilty of a misdemeanor, and each such person shall be deemed
guilty of a separate offense for each day or portion thereof during
which any violation of any of the provisions of this ordinance is com-
mitted, continued or permitted, and each violation shall be punishable
by a fine not to exceed Two Hundred Dollars ($200.00).
SECTION 5.
All litigation and existing violations, both civil and criminal,
whether pending in court or not, under existing ordinances shall not be
affected by this ordinance but may be prosecuted until final disposition
by the courts.
SECTION 6.
This ordinance shall be in full force and effect from and after
the date of its passage and publication as required by law, and it is
so ordained.

The Plumbing and Mechanical Codes of the City of Fort Worth do not permit
mechanical contractors to tie on to gas systems in order to extend gas
piping to units installed under the Mechanical Code. The Plumbing and
Mechanical Boards met jointly on November 6, 1973, and recommended that
both codes be amended to permit heating and air conditioning contractors
licensed by the City of Fort Worth to make connections to existing gas
lines to extend service to units installed by them. The proposed amend-
ments will result in a reduction in construction cost.
Recommendation
It is recommended that ordinances be adopted amending the Plumbing Code
(Ordinance 6407) and the Mechanical Code (Ordinance 6408) to permit
mechanical contractors to make connections to existing gas lines as outlined
above.
