AN ORDINANCE VACATING, ABANDONING AND CLOSING
THE 15 FOOT WIDE SANITARY SEWER EASEMENT IN
LOTS 9 -RA - 9 -RB FROM THE ACCESS AND UTILITY
EASEMENT SOUTH OF AND ADJACENT TO NORTHPARK DRIVE
(A PRIVATE STREET), SOUTHWESTERLY TOWARD THE
COMMON SOUTH CORNER OF LOTS 9 -RA AND 10 -RA,
EXCLUDING THE NORTH /SOUTH 26 FOOT WIDE EMERGENCY
ACCESS AND UTILITY EASEMENT ALONG THE COMMON LOT
LINE OF LOTS 9 -RA AND 9 -RB; PROVIDING FOR THE
REVERSION OF THE FEE IN SAID LAND; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the 15 foot wide sanitary sewer easement in Lots 9 -RA and
9 -RB from Northpark Drive (a private street) southwesterly toward the
common south corner of Lots 9 -RA and 10 -RA, excluding the north /south
26 foot wide emergency access and utility easement along the common
lot line of Lots 9 -RA and 9 -RB, the same being more particularly
described as:
SECTION ONE (Being that portion located in
Lot 9 -RA
BEGINNING at a point in said center of said easement
and in the westerly line of a 26 foot wide access
and utility easement centered on the common line be-
tween said Lot 9 -RA and Lot 9 -RB, in the Northpark
Business Center, said point being 129.5 feet South
12 degrees, 03 minutes, 45 seconds East and 17.17
feet South 37 degrees, 09 minutes, 30 seconds West
from the northeast corner of said Lot 9 -RA:
THENCE South 37 degrees, 09 minutes, 30 seconds West
with said center of sewer line and easement, 177.25
feet; and
SECTION TWO (Being that portion located in Lot 9 -RB)
BEGINNING at a point in said center of said easement
and in the easterly line of a 26 foot wide access and
utility easement centered on the common line between
said Lot 9 -RB and Lot 9 -RA, in the Northpark Business
Center, said point being 127.93 feet South 12 degrees,
03 minutes, 45 seconds East and 15.14 feet North 47
degrees, 04 minutes, 53 seconds East from the northwest
corner of said Lot 9 -RB;
THENCE North 47 degrees, 04 minutes, 53 seconds East
with said center of sewer line and easement, 208.94
feet to a point in the southerly line of a 26 foot wide
access and utility easement along the northerly line of
said Lot 9 -RB.
be and the same is hereby vacated, abandoned and permanently closed
as a sanitary sewer easement.
SECTION 2.
That the fee to the land in the above described sanitary
sewer easement is hereby released and shall revert to the adjacent
owners as provided by law, SAVE AND EXCEPT that easements are
retained for any and all existing utilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force
and effect from and after the date of its passage and it is so ordained.

Four -Way Properties, Inc., owner of Lots 9 -RA and 9 -RB, North Park Business
Center, has requested that the City vacate the 15' wide sanitary sewer easement
in Lots 9 -RA and 9 -RB from North Park Drive (a private street) southwesterly
toward the common south corner of Lots 9 -RA and 10 -RA, excluding the north /south
26' wide Emergency Access and Utility Easement along the common lot line of
Lots 9 -RA and 9 -RB, as shown on the attached map, and more fully described in
the attached metes and bounds description and designated as Parcel A, Section
One, and Parcel A, Section Two.
The subject easement, acquired by dedication, presently contains a 39" sanitary
sewer facility, but no other underground utility facilities or surface improve-
ments,
Reviewing City departments and private utility companies have raised no objec-
tion to this request provided the existing sanitary sewer line is relocated at
the property owner's expense. The Water Department has stated that a contract
has been awarded and a Letter of Credit has been submitted by the property owner
assuring the relocation of the sanitary sewer within already existing utility
easements.
Recommendation
It is recommended that the subject easement be vacated.
