ORDINANCE NO.
AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR THE
EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT
WORTH, TEXAS, AND THE ANNEXATION OF 388.68 ACRES (0.622
SQUARE MILES) OF LAND, MORE OR LESS, WHICH SAID TERRITORY
LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS
OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED
SHALL BEAR ITS PRO RATA PART OF TAXES; PROVIDING THAT THE
INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL
THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS
ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT
HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE
CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT;
PROVIDING FOR SEVERABILITY AND NAMING AN EFFECTIVE DATE.
WHEREAS, a public hearing before the City Council of the City
of Fort Worth, Texas, wherein all interested persons were provided
with an ,opportunity to be heard on the proposed annexation of the
territory hereinafter described, was held at the City Council
Chambers in the Municipal Office Building of Fort Worth, Texas, on
the 22nd day of May, 1979, which date is not more than twenty (20)
nor less than ten (10) days prior to the institution of annexation
proceedings; and
WHEREAS, notice of such public hearing was published prior
thereto in a newspaper having general circulation in the City of
Fort Worth, Texas, and in the hereinafter described territory on
the 10th day of May, 1979, which date was not more than twenty
(20) nor less than ten (10) days prior to the date of the public
hearing; and
WHEREAS, the population of the City of Fort Worth, Texas was
in excess of 367,000 inhabitants on January 1, 1963 and in excess
of 400,000 inhabitants on January 1, 1979; and
WHEREAS, the corporate area of the City of Fort Worth, Texas
was 152.580 square miles on January 1, 1963 and was 243.779 square
miles on January 1, 1979; and
WHEREAS, the hereinafter described territory lies within the
exclusive extraterritorial jurisdiction of the City of Fort Worth,
Texas; and
WHEREAS, the hereinafter described territory lies adjacent to
and adjoins the City of Fort Worth, Texas; and
WHEREAS, the hereinafter described territory contains 388.68
acres (0.622 square miles) of land, more or less;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS:
SECTION 1.
That the following described land and territory lying adjacent
to and adjoining the City of Fort Worth, Texas, is hereby added to
and annexed to the City of Fort Worth, Texas, and said territory
hereinafter described shall hereafter be included within the
boundary limits of the City of Fort Worth, Texas, and the present
boundary limits of said City, at the various points contiguous to
the area hereinafter described, are altered and amended so as to
include said area within the corporate limits of the City of Fort
Worth, Texas, to -wit:
Being 388.68 acres, located in Tarrant County, Texas 9.1 miles
Northwest of the Tarrant County Courthouse out of the Heirs of
Benjamin Thomas Survey, Abstract 1497 and the G. T. Walters
Survey, Abstract 1696, and being more particularly described
as follows:
BEGINNING at a point in the East right -of -way line of Wag -
ley- Robertson Road (County Road No. 4108), which point is also
in the Fort Worth and Saginaw common boundary line;
THENCE West along and with a line 804.1 feet North from and
parallel to the centerline of Haltom - Bailey - Boswell Road
(County Road No. 4040), and along and with the Fort Worth and
Saginaw common boundary line, to a point for corner at its
intersection with the West right -of -way line of Old Decatur
Road (County Road No. 4107);
THENCE South along and with the West right -of -way line of Old
Decatur Road (County Road No. 4107), to a point for corner in
the South right -of -way line of County Road No. 4040;
THENCE West along and with the South right -of -way line of
County Road No. 4040, to a point for corner which is the
intersection of the West right -of -way line of County Road No.
4040 projected Southerly;

THENCE Northerly along and with the West right -of -way line of
County Road No. 4040 projected South, to a line which bears
South 89 Degrees 56 Minutes 30 Seconds East and is North No
Degrees 8 Minutes 25 Seconds West 2727.27 feet from the
centerline intersection of County Road Nos. 4040 and 4040;
THENCE South 89 Degrees 56 Minutes 30 Seconds East 560.99
feet, from the West right -of -way line projected North to its
intersection with the said line bearing South 89 Degrees 56
Minutes 30 Seconds East, to an iron rod;
THENCE South No Degrees 55 Minutes 35 Seconds East 124.2 feet
to an iron rod;
THENCE North 89 Degrees 40 Minutes 25 Seconds East 31.51 feet
to an "X" in concrete in the West line of County Road No.
4107, continuing 4081.39 feet to a pipe, and continuing
further to the East right -of -way line of Wagley- Robertson Road
(County Road No. 4108) to a point for corner;
THENCE South along and with the East right -of -way line of
Wagley- Robertson Road (County Road No. 4108) to the point of
beginning and containing 388.68 acres of land.
Section 2.
That the above described territory is shown on Exhibit Map A
which is attached hereto and expressly incorporated herein by
reference for the purpose of illustrating and depicting the
locations of the hereinabove described territory.
SECTION 3.
That the above described territory and the area annexed shall
be part of the City of Fort Worth, Texas, and the property so
added hereby shall bear its pro rata part of the taxes levied by
the City of Fort Worth, Texas, and the inhabitants thereof shall
be entitled to all of the rights and privileges of all the
citizens and shall be bound by the acts, ordinances, resolutions
and regulations of the City of Fort Worth, Texas.
SECTION 4.
That thereafter the City Limit Line of Fort Worth shall be:

A part of the Heirs of Benjamin Thomas Survey, Abstract
1497 and the G. T. Walters Survey, Abstract 1696, Tarrant
County, Texas, and being more particularly described as
follows:
BEGINNING at a point in the East right -of -way line of
Wagley- Robertson Road (County Road No. 4108), which point
is also in the Fort Worth and Saginaw common boundary
line;
THENCE West along and with a line 804.1 feet North from
and parrallel to the centerline of Haltom - Bailey - Boswell

of County Road No. 4040 projected South, to a line which
bears South 89 Degrees 56 Minutes 30 Seconds East and is
North No Degrees 8 Minutes 25 Seconds West 2727.27 feet
from the centerline intersection of County Road Nos. 4040
and 4040;
THENCE South 89 Degrees 56 Minutes 30 Seconds East 560.99
feet, from the West right -of -way line projected North to
its intersection with the said line bearing South 89
Degrees 56 Minutes 30 Seconds East, to an iron rod;
THENCE South No Degrees 55 Minutes 35 Seconds East 124.2
feet to an iron rod;
THENCE North 89 Degrees 40 Minutes 25 Seconds East 31.51
feet to an "X" in concrete in the West Line of County Road
No. 4107, continuing 4081.39 feet to a pipe, and
continuing further to the East right -of -way line of Wagley
Robertson Road (County Road No. 4108) to a point for
corner.
SECTION 5.
That this ordinance shall and does amend every prior ordinance
in conflict herewith, but as to all other ordinances or sections
of ordinances not in direct conflict, this ordinance shall be, and
the same is hereby made cumulative.

SECTION 6.
That it is hereby declared to be the intent of the City Coun-
cil that the sections, paragraphs, sentences, clauses and phrases
of this ordinance are severable, and if any phrase, clause, sen-
tence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation in this ordinance of
any unconstitutional phrase, clause, sentence, paragraph or
section.
SECTION 7.
That this ordinance shall be in full force and effect from and
after the date of its passage on second reading as provided for in
Section 40 of Chapter XXVIII of the Charter of the City of Fort
worth and it is so ordained.

Mr. M. B. Fleet, owner of 305.66 acres of the northwest quadrant of the inter-
section of County Road Nos. 4040 and 4107, is requesting that this property be
annexed into the City of Fort Worth through voluntary annexation procedures in
order to provide City services to the proposed Twin Mills Additon. The property
is located in Fort Worth's extraterritorial jurisdiction (ETJ) and is currently
not contiguous with Fort Worth's corporate limits. In order to annex non- conti-
guous property,it is necessary that additional property be considered for annexa-
tion which is iocated east of the initial request. With this addition, the
total area being considered for annexation is 388.68 acres (See attached Exhibit
Map "All).
In considering this request, a service feasibility and fiscal impact analysis
was prepared utilizing City dpeartmental comments to assist in determining the
suitability of the area for annexation. Following receipt of the analysis report
the City Plan Commission held a public hearing on the area recommended for
annexation as shown on the attached Exhibit Map "A ". All affected property
owners were notified and appeared before the City Plan Commission Hearing on
March 28, 1979.
The City Plan Commission, following the hearing, recommended approval of the
recommended annexation area outlined on Exhibit Map "A ".
Plan Commission
The following were major factors considered by the City Plan Commission in
arriving at their recommendation to the City Council:
1. The Plan Commission had previously approved development plans on this
property in the form of a Concept Plan (C- 78 -10) and Preliminary Plat
(P- 78 -42).
2. The Plan Commission had previously requested that the developer annex
the property as a final plat requirement in order to serve the
development with water and sewer.
3. Responding City departments and the Development Review Committee did
not identify any significant problem& with the annexation and subse-
quent service to the proposed annexation area.
4. Fiscal impact of the annexation area on the City is positive and
consistent with City annexation policy by being ready for development.

Recommendation
It is recommended that the City Council accept the recommendation of the City
Plan Commission and initiate proceedings to annex the 388.68 acres as shown on

REPORT ON
ANNEXATION: TWIN MILLS ADDITION
Request
Mr. M. B. Fleet, owner of 305.66 acres at the northwest quadrant of the
intersection of County Road No. 4040 and County Road No. 4107, is requesting
that this property be annexed into the City of Fort Worth through our voluntary
annexation procedure in order to provide City services to the proposed Twin Mills
Addition. The property is located in Fort Worth's extraterritorial jurisdiction
(ETJ) and currently not contiguous with Fort Worth's corporate limits. In order
to annex contiguous property, it is necessary that additional property be
considered for annexation which is located east of the initial request. With this
addition, the total area being considered for annexation is 388.68 acres. (See
attached Exhibit Map "A").
Jurisdiction
The subject property is within the exclusive extraterritorial jurisdiction of the
City of Fort Worth and not subject to annexation by any other city. There are no
ordinance conflicts existing and no common boundary adjustments with other
cities required for annexation.
We have not met our maximum allowable annual 10 percent of our corporate area
eligible to annex in this 1979 calendar year.
Sector and District Plan
The subject area's development proposal is located in and generally conforms to
the Districts J and E plans. The Plan Commission approved a Concept Plan (C-
78-10) and Preliminary Plat (P- 78 -42) which indicates the anticipated develop-
ment to be single - family residential, apartments, commercial, and an elementary
school.
Project Scope
If developed according to the Concept Plan, 853 residential lots or a population
of 2,133 and 29.7 acres of apartments or a populatoon of 1,337 are expected with
ultimate development. The first phase or Section I of Twin Mills is expected to
have 223 lots developed into single - family residences with an estimated
population of 558 and construction anticipated to begin in 1979. The current land
use of the subject property is vacant and agricultural.
Police
The proposed area is smaller than the average police beat, but the projected
population density requires full beat considerations. The next adjoining beat is
not currently being manned with a primary beat car, but new construction has
been started and coverage is being extended during the night time hours. If the
area is annexed, similar coverage will begin as soon as construction is started.
These costs are based on providing full police protection 24 -hours a day, 7 days a
week which should begin to phase in coincident with the completion of Section I.
Full coverage should be planned for the estimated project completion date. The
following are projected costs:
Total recurring costs $140,139.20
Total non - recurring costs 32, 374.00
Total costs (first year) 5166,969.20
Planning
Annexation of the Twin Mills Addition should not have any foreseeable negative
impacts. This is primarily a residential subdivision that would not adversely
affect the surrounding area. The existing traffic corridors, once improved,
should prove to be adequate for proper traffic flow.
The area surrounding Twin Mills has recently experienced more development.
The indications are that this area will continue to develop. Som a of the
indications are for example, the completion of the northwest portion of Loop 820
and the expected improvements of Boat Club Road and County Road #4107. It is
likely that any anticipated future development will want to be annexed by the
City of Fort Worth in order to receive city service. Since the developer will
share the cost of developing through the City's development policies, it becomes
economically feasible for the City to annex these areas.
Public Works
Sanitation - The Division of Sanitation foresees no problems in providing
service to this proposed annexation area in 1979. However, when ultimate
development is completed, an additional IYz crews will be required with the
following costs.

Total (first year of ultimate
developm ent) $127,000
Street - The study area contains 2.92 lane miles of county or rural type
roadways. Of this amount 1.07 lane miles are surfaced with penetration
paving and 1.85 lane miles have a hot -mix asphaltic concrete surface on a
flexible base. The area also contains 3.46 linear miles of borrow ditches
and two (2) concrete box culverts.
It is anticipated that permanent patching, spot sealing, asphalt level -up and
gutter pulling will be required during the first year of annexation. The
estimated cost of the necessary work is:

New Streets - A cost estimate reflecting City costs according to City
Policy for both sides of County Road 4040 is as follows:
County Road 4040, (North- South) $ 16,625
County Road 4040, (East -West) 275,670
The estimate above does not include storm drain costs which are total City
cost on border streets. Nor does the estimate include City cost for
drainage facilities within Twin Mills Addition. An estimate of approxi-
mately $50,000 would seem to be reasonable for these facilities.

Water and Sewer
The City of Fort Worth is in the process of receiving written approval from the
City of Saginaw agreeing to provide water and sewer service to the Twin Mills
Development in accord with existing contracts between the two cities. Verbal
approval has been granted with water and sewer service expected to be
accomplished through the extension and connection of water and sewer lines
through the City of Saginaw facilities.
The entire cost of the extensions would be borne by the developer of Twin Mills
Addition at no cost to the City of Fort Worth.
Fire
Although the proposed annexation is located on the urban fringe of Fort Worth,
the response time is comparable to similar situated areas in Fort Worth.
The area will be between 4.5 and 5.5 miles from first -in pump coverage, future
Station 13, with travel time of7 to 9 minutes. Second -in pump will be from
present station 15, with 6.5 miles, 10 to 12 minutes response time.
Library
The Library Department does not now provide service in the area of the proposed
Twin Mills Addition.
With an estimated population potential of less than 4,000, bookmobile service
could be considered on a limited basis as the area approaches ultimate
development. The present cost for bookmobile service to the area is
approximately $4,500 per year for 4 hours of service one day per week. A
bookmobile is not recommended for fewer than 1,500 population in such remote
areas, especially since some service is available through Blue Mound and Saginaw
libraries, which can provide access to the Fort Worth Public Library collection of
materials through Interlibrary Loan.
Park and Recreation
The City will acquire approximately 6.5 acres of park in this annexation. Park
development will be funded by CIP Developing Areas funds, federal matching
grants or future bond programs. It may be expected that there will be little
initial development of these park sites with park facilities being installed as
sufficient population occurs in the neighborhoods being served.
It is estimated that it would cost approximately $70,000 to adequately develop
this acreage to current neighborhood park standards at 1979 prices. Park
maintenance equipment would require an initial capital investment of approxi-
mately $400. At 1979 prices, the total park acreage in question would require an
increase in the annual budget of approximately $3,000.
Transportation
Initial costs related to annexation of this area would be limited to installing
about 5 stop and speed limit signs for about $175.

Development of Section I of this addition will require an outlay of approximately
$1,610 for stop, street name, and speed limit signs. It is assumed that street
lighting will be 100% developer cost.
Development of the remainder of the project will require an additional outlay (in
1979 dollars) of approximately $15,930 for stop, street name, and speed limit
signs and perhaps half of one traffic signal installation ($12,500).
Tax
The following is an estimate of the expected tax yield in the annexation area:
Estimated value of one house - $47,500 per unit
Estimated value of one vacant lot 6, 000 per lot
Estimated value of vacant large tracts - 5,000 per acre
Estimated value of vacant agricultural tracts - 600 per acre
Estimated housing value is based on average housing unit of 1,500 sq.ft.
