HomeMy WebLinkAboutOrdinance 555 ,.M-0 - 4 ORDINANCE NO. � AN ORDINANCE granting to the TEXAS & PACIFIC RAILWAY COMPANY the right to lay and construct an oil pipe line across Front Street, Seventeenth Street, Ninth Street, Fourth Street, Third Street, Second Street, First Street, Veatherfodd. nap Street, Peach Street and Park Street, and to extend same from Front Street so that same may be connected with a cer- tain supply pipe line extending from the South edge of Front Street in a Southwesterly direction to a certain oil storage tank to be erected on the premises of the Texas & Pacific Railway Company near its present Roundhouse. BE IT ORDAINED BY THE BOARD OF COIGMSSIONERS OF THE CITY OF FORT WORTH: Section 1. The Texas & Pacific Railway Company is hereby authorized and granted the privilege to construct and maintain a certain supply pipe line over and across certain streets in the City of Fort Worth, as follows: Beginning at the south line of Front Street and extending north over said Front Street to the north edge thereof; thence extending northerly along the Might of way and property of the Texas & Pacific Railway Company crossing Seventeenth Street and Ninth Street at under-grade, and extending thence north along the right of way of ss,id Company crossing Fourth Street at over- head, and thence northerly along and upon the right of way of said Company, crossing 'Third, Second, First, Weatherford, Belknap, Peach and Park Streets at under-grade; and thence extending norther- ly along its said right of may to the northern limits of the City of Fart Forth. Section 2. Said supply pipe line shall be 6f steel, six inches in diameter, and as same crosses Front and Fourth Streets it shall cross same over-head, and be located upon the bridges and trestles of said Texas & Pacific Railway Company as now con- atructed and to be constructed. Wherever �Md pipe line crosses the other streets hereinbefore mentioned same shall be undergrade, 2- and shall be placed at a depth of not less than twenty-four (24) inches. Section 3. Said pipe line, excep: where the same shall cross the streets herein named, shall be constructed and maintained upon the property and right of way of the Texas & Pacific Railway Com- pany. Section 4. Said pipe line, when so constructed, shall be used only for the purpose of conveying fuel oil from a point north of the City limits of Fort Worth along the line hereinbefore in- dicated, to the soith line of Front Street, and thence by a connec- tion with a supply pipe line of same material extending in a south- westerly direction across the private property of the Texas & Pacific Railway Company to a certain storage tank to be erected by The Texas & Pacific Railway,Company on its private property at a point north of Railroad Avenue and east of its present Roundhouse which fronts on South Main Street. Section 5. The Texas & Pacific Railway in constructing said storage tgnk, and in the use of same, shall have same of a height not exceeding thirty (30) feet and not exceeding forty (40) feet in diameter, and shall locate, construct, equip and use same in accord- ance with the rules and requirements of the National Board of Fire Underwriters for the storage and use of fuel oil as recommended by The National Fire Protection Association, in accordance with its printed pamphlet issued in the year 1913, which is on file in the office of the Chief of Fire Department of Fort Worth, ,Texas, and in accordance and subject to all of the ordinances and regulations of the City of Fort Worth. Section 6. In accepting xis the provisions of this ordinance the said Texas & Pacific Railway Company shall be construed as i having agreed to and bound itself to indemnfy and safe harmless the City of Port Worth from all damages and injuries of any kind and character whatsoever which may result from the negligent construction, operation or maintenance vf-sa.id pipe line across, over and4ong the 3- streets hereinbefore named. Section 7. All streets disturbed by the laying or maintenance of said pipe line shall be, by said Texas & Pacific Railway Company, restored in such condition as the same may have been prior to the laying of said pipe line. Section 8. Said pipe line shall be constructed, maintained and operated in strict accordance with the provisions of this ordinance, and shall be used exclusively for the purpose herein setforth, and the construction thereof shall be under the supervi- sion of, and shall be approved,by, the City Engineer for the City of Fort Worth. This ordinance shall be in force and effect from and after its passage. Approved as to form; Golxp oration ounsel .
