AN ORDINANCE PROVIDING THAT THAT PORTION OF OLD
BLAND¢N AVENUE, BETWEEN YUCCA AVENUE AND CLARY r
AVENUE, WHICH HAS BEEN SUPERSEDED BY THE NEW BLANDON
AVENUE AS DEDICATED BY THE KRT WORTH INDEPENDENT
SCHOOL DISTRICT ON APRIL 23, 1937, AND THAT PART OF
CLARY AVENUE, SITUATED WEST OF THE WEST LINE OF SAID
NEW BLAND*N AVENUE, IF SUCH LINE WERE EXTENDED SOUTH
ACROSS CLARY AVENUE, BE VACATED, ABANDONED AND CLOSED;
RESERVING AN EASEMENT FOR PUBLIC UTILITIES IN AND
ALONG THE LAND CONTAINED IN SAID STREETS; PROVIDING
FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION I.
That, in order to promote and protect the public safety and
particularly the safety of public school pupils and teachers attending
the Oakhurst Elementary School established by the Fort Worth Independent
School District in that part of the City of Fort Worth known as Riverside,
that portion of Old Bland" Avenue, between Yucca Avenue and Clary Avenue,
which has been superseded by the new Bland�n Avenue as dedicated by the
Fort Worth Independent School District on April 23, 1937, and that part
of Clary Avenue situated west of the west line of said new BlandAp Avenue,
if.such line were extended south across Clary Avenue, shall be and is
hereby vaoated, abandoned and closed.
SECTION II.
That the rights of all public utilities for the purpose of con-
structing and maintaining service lines shall not be disturbed, destroyed,
revoked or abrogated by any of the provisions of this ordinance, but said
rights as above set out shall remain in Rill force and effect.
SECTION III.
That the fee to the land in said streets shall revert as provided
by law.
SECTION IV.
That the Fort Worth Independent School District, a corporation,
shall fully indemnify and safe whole and harmless the City of Fort Worth
from all costs or damages arising out of any real or asserted claim or
cause of action against it, occasioned by the closing of the above described
parts of streets.
SECTION V.
All ordinances or parts of ordinances in oonflict herewith are
hereby repealed.
SECTION VI.
This ordinance shall take effect and be in full force and effect
from and after the date of its passage.
