AN ORDINANCE AUTHORIZING THE EXECUTION OF CONTRACT
FOR THE IMPROVEMENT OF A PORTION OF NORTH MAIN
STREET IN THE CITY OF FORT WORTH; MAKING APPROPRIA-
TION FOR THE INDEBTEDNESS INCURRED THEREBY; AND
DIRECTING THE CITY ENGINEER TO PREPARE ESTIMATES.
WHEREAS, on the 21st day of August, 1946, by ordinance passed and
approved by the City Council, being Ordinance No. 2343, the City determined
the necessity for and ordered and provided for the improvement of a portion
of North Hain Street therein described; and,
WHEREAS, subsequent to the passage and approval of said ordinance,
plans and specifications for said improvements were submitted by the City
Engineer, and said plans and specifications were approved by the City Coun-
cil; and,
1HEREAS, notice to bidders was given as regaired by the City Charter;
and,
I EREAS, the bid of Texas Bitulithic Company, a corporation, was
found to be the lowest and best bid for the making and construction of said
improvements, to wit, permanently repairing a portion of North Main Street
by the placing of a Hot Mix Asphaltic Concrete Leveling-up Course and a one
and one-half (1*) inch Hot Mix Asphaltic Concrete Surface upon the existing
pavement, together with incidentals and appurtenances, all as provided by
said plans and specifications; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT IORTH, TEAS:
SECTION 1.
That the work of making and constructing such improvements and con-
tract therefor is hereby let to Texas Bitulithic Company, a corporation,
which said contract is dated the day of A. D. 1946,
and is on file with the City and executed by Texas Bitulithic Company, and
the Mayor and City Secretary are hereby directed to execute the said contract
in the name of the City of Fort Worth, Texas, and to impress the corporate
seal of the City thereon, the said contract embracing therein, among other
things, the prices for the work.
SECTION 2.
That to provide for the payment of the indebtedness incurred by the
City of Fort Worth by said contract, there is hereby appropriated out of
available funds which have been set aside for said purpose an amount suf-
ficient to pay said indebtedness so incurred.
SECTION 3.
That the City Engineer of the City of Fort Worth be and he is hereby
ordered and directed to file with the City Council estimates of the cost of
such improvements in accordance with the tome of the powers and provisions
of Chapter 106 of the Acts of the First Called Session of the Fortieth Legis-
lature of the State of Texas, now shown as Article 1105b of Vernon's Civil
Statutes of the State of Texas, Annotated, which law has been adopted as an
amendment to and made a part of the Charter of the City of Fort Worth.
