AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE SEWER CAPITAL PROJECTS FUND IN THE
AMOUNT OF $109,732 FROM A WATER AND SEWER OPERATING FUND
TRANSFER, FOR THE PURPOSE OF EXECUTING AN INTERLOCAL
AGREEMENT WITH THE CITY OF BENBROOK FOR THE RELOCATION OF
FORT WORTH SANITARY SEWER INTERCEPTOR MAIN M-259 WITHIN THE
MARY'S CREEK DRIVE RIGHT-OF-WAY (CITY PROJECT NO. 00729);
PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2006-
2007 in the Budget of the City Manager, there shall also be increased estimated receipts and
appropriations in the Sewer Capital Projects Fund in the amount of $109,732 from a Water and
Sewer Operating Fund transfer, for the purpose of executing an Interlocal Agreement with the City
of Benbrook for the relocation of Fort Worth sanitary sewer interceptor Main M-259 within the
Mary's Creek Drive right-of-way (City Project No. 00729).
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
ADOPTED AND EFFECTIVE: June 12, 2007
This ordinance shall take effect upon adoption.

Authorize an Interlocal Agreement with the City of Benbrook for the Relocation of Fort Worth
Sanitary Sewer Interceptor Main M-259 within the Mary's Creek Drive Right-of--Way and Adopt
Appropriation Ordinance
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the transfer of $109,732 from the Water and Sewer Operating Fund to the Sewer Capital
Projects Fund;
2. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the
Sewer Capital Project Fund in the amount of $109,732; and
3. Authorize the City Manager to execute an Interlocal Agreement with the City of Benbrook for the
relocation of Fort Worth sanitary sewer interceptor Main M-259 within the Mary's Creek Drive right-of-way.
DISCUSSION:
The City of Benbrook is undertaking a capital project that includes the replacement and enlargement of the
Mary's Creek Drive bridge culvert over Plantation West Creek within that right-of-way.
In order to replace Benbrook's bridge culvert at the new elevation, it is necessary to relocate a 407 feet
segment of City of Fort Worth Sanitary Sewer Interceptor Main M-259 that is in direct conflict with the
proposed bridge structure. This sewer main was constructed in 1956 and serves customers in Western Hills
Addition in west Fort Worth. The City of Fort Worth's cost for the relocation of M-259 based upon bids
received by the City of Benbrook is $94,745.
Under the terms of the proposed Interlocal Agreement, Benbrook agrees to include the relocation of M-259
(and increasing the pipe size from 15 to 18 inches in diameter) within its construction project for the
replacement and enlargement of the Mary's Creek Drive bridge culvert; Benbrook agrees to allow Fort
Worth to inspect the construction of the identified segment of M-259; and Fort Worth agrees to reimburse
Benbrook, the construction cost of the identified segment of M-259 based upon actual invoices Benbrook
receives from its contractor; provided that the maximum payment by Fort Worth to Benbrook shall not
exceed $100,000.
Staff considers the proposed Interlocal Agreement to be reasonable and recommends approval.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of
