ORDINANCE NO. ° Q AN ORDINANCE VACATING, ABANDONING AND CLOSING A CERTAIN PORTION OF THE NORTH RIGHT-OF-WAY (ACCESS ROAD) FOR WHITE SETTLEMENT ROAD IN THE 2400-2500 BLOCKS, A WIDTH OF 60 FEET AND A LENGTH OF APPROXIMATELY 775 FEET ADJACENT TO LOTS 12 THROUGH 18 AND THE WEST 95 FEET OF LOT 11, BLOCK 17, BAILEYS INDUSTRIAL ADDITION, AND TO VACATE AN 8 FOOT UTILITY EASEMENT ABUTTING LOTS 1-7, 12-18 AND THE WEST 95 FEET OF LOTS 8 AND 11, BLOCK 17, A LENGTH OF APPROXIMATELY 825 FEET FROM VACEK TO RUPERT STREETS, SAVE AND EXCEPT THE WESTERN 110 FEET OF THE EASEMENT WHEREIN UTILITY LINES EXIST; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the City of Fort Worth vacate a certain portion of the north right-of-way (access road) for White Settlement Road in the 2400-2500 blocks, a width of 60 feet and a length of approximately 775 feet adjacent to Lots 12 through 18 and the west 95 feet of Lot 11, Block 17, Baileys Industrial Addition, and to vacate an 8 foot utility easement abutting Lots 1-7, 12-18 and the west 95 feet of Lots 8 and 11, Block 17, a length of approximately 825 feet from Vacek to Rupert Streets, save and except the western 110 feet of the easement wherein utility lines exist, as shown in Volume 388-C, Page 95, Deed Records of Tarrant County, Texas, be and the same is hereby vacated, abandoned and closed. SECTION 2. That the fee to the land in the above described right- of-way is hereby released and will revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are reserved therein for any and all existing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. The subject street right-of-way and easement were acquired by dedication according to a plat recorded in Volume 388-C, Page 95, Deed Records of Tarrant County, Texas, The subject right-of-way does not function as part of White Settlement Road, but rather as parking areas, It is an unimprtved parking and access area on the east end and gravelled on the west end, Easements are being retained for all existing utilities affected by this reque=st. The CILy Plan Commission has reviewed this request and recommends its approval subject to conditions which have now been met, Recommendation It is recommended that an ordinance be adopted vacating the subject right-of-way and easement.
