AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE GENERAL FUND iN THE AMOUNT OF $206,471.74, FROM AVAILABLE FUNDS,
FOR THE PURPOSE OF AMENDING AND EXTENDING THE PROFESSIONAL
SERVICES AGREEMENT WITH THE FORT WORTH PARTNERSHIP FOR COMMUNITY
DEVELOPMENT: PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1
That in addition to those amounts allocated to the various Gity departments far Fiscal Year 2008-2009, there
shall also be increased estimated receipts and appropriations in the General Fund in the amount of
X206,471.74, from available funds, for the purpose of amending and extending the Professional Services
Agreement with the Fort Worth Partnership for Community Development.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
hat this ordinance shall be cumulative of Ordinance No. 18283 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

OF FORT WORTH (the "City"}, a home rule municipal corporation organized under
the Laws of the State of Texas, acting by and through Toni Higgins, its duly authorized
Assistant City Iti~lanager, and FORT 6VORTH PARTNERSHIP FOR C"OiwllYltiNi`I`Y
llEVELOP:YIENT ("FF~'PCD"}, a Fexas nonpro"Y corporation in good standing with
the State of Texas, acting by and through Charlotte B. Sobel, its duty authorized
President'C'hief Executive Officer.
RECITALS
A. The City and FWPCD previously entered into that certain Professional Service,
Agreement, a public document on Pile in the City Secretary's Office as City Secretary
Contract No.:ifi864 (the "Agreement") pursuant to which FWPCD agreed to provide the
City's Housing and Economic Development Department wiflr professional consulting
services to assist certain Fort GL'orth community-based development organizations in
providing comprehensive community economic development and diverse, focused
activities that produce housing units and create and retain jobs, and to complete other
comprehensive projects that eeault in substantial, measurable impro3~ements in the quality
of life ir~r tow and mode.--rate income neighborhoods of the t"ity of Fart Werth {the
"Program"). Specifically, the Agreement pro~•ideel tin- FWPCD to cotnpletc the scope
of work outlined for the first year of the Program, as set forth in the initial Prof€,"siona]
Scnices Agn-ecment between the pat-tics (City Secretary Contract it`o. 3gH3c)) and to
complete additional ticork outlined for the vecond year of the Program, as set fcsrth in the
Agreement.

1. The Tenn of the A~eenient Is hc~eby extended to expire an July 28, 20(}R unless
terminated earliar in accordance with the Agreement. Should FlA%PC"I) ~t~t complete Ehe
Second Year's Scope of Work by July 28, 2!J09, the City and I~GVpCD may, by written
eonsent of both parties, extend the Tenn for up to six (6} months thereafter.
2. Ah capitalized terms used but not defined in this Amendment shall have the
meanings asc~ihed to them in the tgeement. All provisions of the .agreement that are
not speci6calty amended by this Amendment shall remain in full force and eTfect.

WTIEREAS, the City of Fart ~G'ordx {"City"} and fort Worth Partnership for
Community Development ("F~VPCD"}, a Texas non-profit carparation, have entered into that
certain Professional Services Agreement (City Ser;retary Contract No. 3&864) (the
"Agreement") pursuant to which fiWPCD has agreed to provide the City's Hauling and
Economic Deveiopment DeparUne??t wilt professional consulting services to assist certain Fort
Worth community-based deveIapmant organizations in providing comprehensive community
economic development and diverse, focused activities that produoe housing units and create and
retain jobs, and to complete other carnprehensive projects that result in substantial, measurable
improvements in the quality of life in low and moderate income neighborhoods of the City, as
mare specifically defined and outlined in the Agreement as the "Second Year's Scope of
Work"; and
WHEREAS, as of 7anuary 28, p009, which was the original expiration date of the
Agreement, the City was abIa to appropriate only $68;528.?6 of the maximum `S27S,000.00
funding commit?Went for FWPCD kx eampiete the Second Years Scope of Work; and
WHEREAS, the City has requesked that the Fort Worth Laca( Development t.arporatiott
(the "Corporation"; fund the remaining $2fl6,4?1.74 in order for the City to amend the
Agreement and extend its term so that FWYCD may complete the Second Year's Scope of Work;
and
WHEREAS, such request is consistent with the Corporation's purpose, which, as set
forth in t]?e C'.orparatian's Articles of lncorparation, is to prof=ide direct and indirect assistance
and benefit to the City, including, specifically, to make loans, grants ar other forms oftinancizxi

RECOMMENDATION:
It is recommended that the City Council:
1. Accept $246,471.74 from the Fort Worth Racal Development Corporation in order to fund the remainder
of the City's Year Two Funding Commitment under that contract with the Fort Worth Partnership far
Community Development; and
2. Adopt the attached supplemental Appropriation Ordinance increasing the estimated receipts and
appropriations by $206,471.74 in the General Fund from available funds: and
3. Approve an amendment to the Professional Services Agreement, City Secretary Contract No. 36864,
with the Fart Worth Partnership for Community Development extending its term to September 30, 2009.
DISCUSSION:
The City and Fart Worth Partnership for Community Development {FWPCD} previously entered into City
Secretary Contract No. 36864, a Professional Services Agreement (Agreement} under which FWPCD
agreed to provide the City's Noosing and Economic Development Department with professional consulting
services to assist certain Fart Worth community-based development organizations. Those organizations
provide comprehensive community economic development and diverse, focused activities that produce
housing units and create and retain jabs and other comprehensive projects that result in substantial,
measureable improvements in the quality of fife in Iow and moderate income neighborhoods of the City of
Fort 4North {Program}. FWPCD provides operating and technical assistance to the organizations.

Agreement by September 30, 2009. Should FWPCD not complete the work by September 30, 2009, the
City and FWPCD may, with written consent of bath parties, extend the term of the Agreement for a period
expiring not Iater than January 28, 2010.
The attached appropriation ordinance transfers funds from the FWC_DC increasing estimated receipts and
appropriations in the Special Trust Fund by X206,471.74 to ensure that funds are available for
disbursement to the FWPCD in accordance with the Agreement.

The Financial Management Services Director certifies that upon approval of the above recommendations
and adoption of the attached supplemental appropriation ordinance, funds will be available in the current
operating budget, as appropriated of the General Fund.
