AMENDMENT No. 2 CONTRACT NO. _ - 0—
TO CITY SECRETARY CONTRACT
WHEREAS, the City of Fort Worth (CITY) and James DeOtte
Engineering, Inc., (ENGINEER) made and entered into City
Secretary Contract No. 38511, (CONTRACT) which was authorized
by M&C C-23420 on the 31st day of March, 2009 in the amount
of $442,172.00; and
WHEREAS, the CONTRART was subsequently revised by
Amendment No. 1 in the amount of $19,475.00 which was
authorized administratively on December 22, 2011; and
WHEREAS,the CONTRACT involves engineering services for
the following project:
Sanitary Sewer Main 257 Upper and Middle Village Creek
Parallel Relief Main, Part 1; and
WHEREAS, it has become necessary to execute Amendment
No. 2 to the CONTRACT to include an increased scope of work
and revised fee.
NOW TIIEREFORE, CITY and ENGINEER, acting herein by and
through their duly authorized representatives, enter into the
following agreement, which amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the
additional engineering services specified in a proposal dated
September 30, 2013, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional
design services to be performed by Engineer totals
$95,687.00.

SUBJECT: Authorize Execution of Amendment No. 2 to City Secretary Contract No. 38511, an
Engineering Agreement with James DeOtte Engineering, Inc., in the Amount of $95,687.00
for a Revised Total Contract Amount of $557,334.00 for Design Services for Sanitary
Sewer Main 257 Upper and Middle Village Creek Parallel Relief Main, Part 1, Thereby
Increasing the Contract Amount to $557,334.00 (COUNCIL DISTRICT 8)
RECOMMENDATION:
It is recommended that the City Council authorize execution of Amendment No. 2 to City Secretary
Contract No. 38511, an Engineering Agreement with James DeOtte Engineering, Inc., in the amount
of $95,687.00 for Design Services for Sanitary Sewer Main 257 Upper and Middle Village Creek
Parallel Relief Main, Part 1, thereby increasing the contract amount to $557,334.00.
DISCUSSION:
On March 31, 2009, .(M&C C-23420) the City Council authorized an Engineering Agreement with
James DeOtte Engineering, Inc., in the amount of $442,172.00 for design services for Sanitary Sewer
Main 257 Upper and Middle Village Creek Parallel Relief Main, Part 1. The Agreement was
subsequently revised by Amendment No. 1 in the amount of $19,475.00 which was authorized
administratively on December 22, 2011.
Amendment No. 2 will allow for the design of a proposed junction structure and additional sanitary
sewer improvements on Mains 257 and 503 at the intersection of both mains near Salt Road.
James DeOtte Engineering, Inc., proposes to provide the additional services for a lump sum fee in
the amount of $95,687.00. Staff considers this fee to be fair and reasonable for the scope of services
to be provided.
M/WBE Office - James DeOtte Engineering, Inc., is in compliance with the City's MNVBE Ordinance
by committing to an additional 14 percent M/WBE participation on this Amendment No. 2. The City's
goal on the Amendment is 10 percent.
This project is located in COUNCIL DISTRICT 8, Mapsco 93X.
The Financial Management Services Director certifies that funds are= available in the current capital
budget, as appropriated, of the Sewer Capital Projects Fund.

Sub surface Utility investigation (Level C) — Research and locate utilities located in
the alignment corridor, approximately 449 feet. $ 2,000.00 (GAI)
