NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a scope of services proposal, a copy of which is attached hereto and incorporated herein (Attachment A) . The cost to City for the additional design services to be performed by Engineer totals $124,828. 00. 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $134,828. 00 (Attachment B, Project Compensation) . 3 . DISCUSSION: The purpose of this Mayor and Council Communication(M&C)is to authorize the execution of Amendment No. 1 with Pacheco Koch Consulting Engineers, Inc. (Pacheco Koch)to provide additional engineering design services for Fire Station Park Phase I Development(City Secretary Contract No.52234), in an amount not to exceed$124,828.00,for a total contract value of$134,828.00(City Project No.CO2638). Fire Station Park was dedicated in 1975 for the purpose of providing parkland for residents in the Southside and Fairmount neighborhoods. The original 1.69 acres park dedication limited the level of programming opportunities.On August 30,2016,the City Council authorized the acquisition of approximately 1.35 acres of land located at 1616 Hemphill Street,for the expansion of Fire Station Park(M&C L-15946). This acquisition and expansion of the park increased the programming options available to help meet the recreational needs in this sector of the City. In 2018,the existing zoning of Fire Station Park was changed from C(medium density multifamily)to NS-T4(Near South District).This zoning change allows on-street parking adjacent to the site to be counted into total required parking quantities.A Fire Station Park Master Plan has been prepared by consultant Project for Public Spaces and endorsed by the Park&Recreation Advisory Board on February 27,2019.The City allocated funding from Park Dedication Fees Funds to cover Phase I development of the site.The City also assumed the maintenance and operation of the property. Pacheco Koch has been under contract(City Secretary Contract No.52234)since April 2019 providing preliminary engineering design services for Fire Station Park Phase I Development. In December 2019,the City and Near Southside, Inc.reached an agreement to increase the total construction budget of Phase I Development up to$1,200,000.00. Near Southside, Inc. has committed to raise$600,000.00 for the project through private donations and other fundraising from December 2019 to December 2020.A City contribution of$600,000.00 from Fort Worth Park Dedication Fee funds will be earmarked for this project as 1:1 match in an effort to leverage Fire Station Park Phase I Development. By this amendment,the project scope for Fire Station Park Phase I Development is expanded from preliminary engineering to 100%engineering design of the newly acquired 1.35 acres and adjacent street and sidewalk improvement along W Maddox Ave and Hemphill St. Pacheco Koch Consulting Engineers is in compliance with the City's BDE Ordinance by committing to 13%SBE participation on this Amendment No. 1.The City's goal on this Amendment is 7%.Additionally, Pacheco Koch Consulting Engineers is a certified M/WBE firm. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are available in the current capital budget,as previously appropriated, in the PARD Dedication Fees Fund Fire Station Park Expansion project to support the approval of the above recommendation and execution of the amendment. Fernando Costa 6122 Originating Business Unit Head: David Creek 5704 Additional Information Contact: David Creek 5704 Attachment A Scope of Services PROJECT DESCRIPTION: The project consists of the preparation of phase I construction plans and bid documents for Fire Station Park.The site is located at 1616 Hemphill Street in Fort Worth.The project consists of approximately 1.35 acres of area.The anticipated project program includes: a market plaza, public dog zone,children's bike course, native wildflower garden,vehicular street parking, and skate plazam .The park design shall be based on the existing Master Improvement plan provided by the CITY to Pacheco Koch herein referred to as the CONSULTANT. Refer to Attachment E for limits of site improvements. The purpose of this project is to prepare Design Construction and Cost Opinion Documents for anticipated Phase I park improvements. Below are shown the assumptions and qualifiers for the landscape architecture scope of work found herein. Assumptions: ■ Area of work is as shown in "Attachment E" included,approximately 1.35 acres. ■ Project budget is estimated to be $1.2 million for phase 1, including up to $650,000 intended for the skate plaza area of up to 12,000 square feet. ■ CITY to provide Geotechnical Investigation report with recommendations appropriate for pedestrian improvements,skate plaza,and vehicular improvements. ■ ENGINEER to expend remaining fee associated with Contract #52234 (approximately $7,600)for design services and direct reimbursables pertaining to Fire Station Park. Exclusions: ■ Multiple design alternatives beyond those described herein, or significant site plan revisions following acceptance at each given phase of review documents. ■ Irrigation systems utilizing reclaimed water that require pumps, filters and associated controls. This can be provided as an additional service if needed. ■ Site signage and/or signs for buildings and circulation. ■ Site electrical and/or ornamental lighting beyond basic pedestrian lighting. ■ Footings for shade structures. ■ Site walls over 36" height and/or retaining walls less than 36" height with significant surcharge. ■ Regular owner/Contractor(OAC) project coordination meetings during construction. Anticipated improvements include: Planning Services SUBMITTALS & COORDINATION MEETINGS: A Landscape Architect from the CONSULTANT will attend meetings and or presentations to coordinate with other team members and the owner during the design and construction phase. Plans and specifications will be submitted as outlined for Owner and/or governmental review. Attachment A Scope of Services Fire Station Park Project Page 1 of 7 Included in this item: ■ Up to three(3)team coordination meetings during the design phase of the project, including: project kick-off meeting(two-hour duration)with the CITY to review project scope,schedule, deliverables, status reporting, communications, and expectations for the project. ■ Communicate regularly by phone and email with CITY staff. ■ Provide to the CITY a one-page project status report on the last business day of each month throughout the project. ■ One (1) public meetings to scheduled and organized by the city. ■ Official plan review submittals as follows: • Three(3) plan review submittals during the Construction Document phase of work. • One (1) "For Construction"set of drawings. CONSULTANT will provide/perform the following Construction Documents Phase Services: • Based upon the approved Master Plan,the CONSULTANT shall prepare, for approval by the CITY, Construction Documents consisting of Drawings and Specifications setting forth in detail the requirements for construction of the Project. • All completed and approved drawings and details will be produced in AutoCAD/PDF. All completed and approved specifications will be produced in Microsoft Word. • Prepare preliminary and final opinions of probable construction costs. • Submit plans and construction opinions of probable costs to the CITY for review at completion intervals at 30%, 60%, and 90%. • Prepare final bid documents, bid proposal forms, construction plans, and special conditions. • File bid documents for review by the Texas Department of Licensing and Regulation. The following products will be provided by CONSULTANT in completion of the Construction Documents phase: • Plan sheets illustrating plans, elevations, sections and details of construction. Sections where appropriate. The number of copies shall be as requested by the Owner. Printing cost shall be a reimbursable expense. • Standard CITY details incorporated into the plans, as required. • Project manual (four copies) containing technical specifications and bidding documents including CITY forms such as bid proposal, form of agreement between CITY and Contractor, and conditions of the contract. • Provide the CITY with Auto CAD(.dwg)files upon award of bid. • Provide graphic products in electronic file format(.pdf). • Provide project manual as one complete Microsoft Word (.doc)file. • All electronic file transfers shall be by email or in CD-Rom format. Not included in this item: ■ Creation of special renderings or documents required for a Planned Development, Special Exception, or Variance requests beyond the documents described above. ■ Design charrettes. ■ Submittals for multiple early release permit drawings exceeding the total plan submittals described above. Attachment A Scope of Services Fire Station Park Project Page 2 of 7 Landscape Architecture Services SITE DEMOLITION PLAN: CONSULTANT will prepare construction plans and details for the site demolition of existing structures and pavement as necessary for designed improvements. EROSION CONTROL PLAN: CONSULTANT will prepare an Erosion Control Plan for the referenced project. Included in this item: ■ Coordination of CITY review and approval of plans prepared as part of this item. ■ One (1) revision to the plan to reflect site plan changes as a result of Owner comments. Additional changes will be made on an hourly rate basis. ■ Location and construction details for erosion/sediment control devices to manage the discharge of storm water runoff from the site during construction activities. Not included in this item: Services associated with filing of the "Notice of Intent" form (NOI) to the Texas Commission on Environmental Quality(TCEQ)for the proposed construction activities DIMENSIONAL CONTROL PLAN: Based on an approved Site Plan provided by the Owner, CONSULTANT will prepare a detailed site horizontal Dimensional Control Plan which will define drives, parking spaces, building location,and landscape areas in relation to existing and proposed property boundary lines. This item is meant to be a tool for the Contractor to lay out the site during construction and is not meant to be a "Site Plan" for CITY review/approval purpose. It is our understanding that eitherthe CONSULTANT will provide sufficient surveying services to define the site boundaries, or the site boundary information will be provided by CITY. Included in this item: ■ Coordination of CITY review and approval of plans prepared as part of this item. ■ Three (3) revisions to the plan to reflect site plan changes as a result of Owner comments (30%, 60%, and 90%submittals).Additional changes will be made on an hourly rate basis. Not included in this item: ■ Survey to define site boundaries. HARDSCAPE PLAN SERVICES: CONSULTANT will provide a Landscape Architecture Design services that consists of hard surface elements of the site on the ground plane, excluding vehicular paving. Elements typically include pedestrian paving, selection and location of ornamental light fixtures, pedestrian handrails,exterior stairs and ramps,site furniture,fencing, mow curbs,shade structures and seat walls/retaining walls less than 36" in height. Included in this item: ■ Construction Documents: Plans to include layout,grading and detail plans to a level sufficient to demonstrate design intent and allow the construction thereof.Technical specifications will be prepared for each critical item in the Landscape Architectural Plans. Attachment A Scope of Services Fire Station Park Project Page 3 of 7 ■ Coordinate with the Civil Engineer to connect landscape drainage structures and features into the overall site drainage plan. ■ Coordination with Structural Engineer related to shade structures and footing, if required. ■ TDLR submittal for accessibility review. Cost of submittal and inspections will be submitted as a reimbursable expense. ■ Site lighting plan to include area security lighting,to coordinated with electrical engineer. ■ Children's Bike Course. ■ Dog zone. ■ Market Plaza. Not included in this item: ■ Planting/softscape design. ■ Retaining wall design for walls over 36" in total height, or with surcharges. ■ Stage/pavilion design. ■ Vehicular pavement design and grading. Paving enhancement design for vehicular areas, if any,will be provided to the civil engineer in the design development phase for incorporation into the vehicular paving plans. ■ Environmental clearance,wetland delineation, or jurisdictional waters issues. LANDSCAPE PLANTING PLANS:CONSULTANT will provide a Landscape Planting Plan that consists of selection and location of ornamental plantings, street or site shade trees, turf, mulches and associated items. Included in this item: ■ Coordination of CITY review and approval of plans prepared as part of this item. ■ Construction Documents: Plans to include planting and detail plans to a level sufficient to demonstrate design intent and allow the construction thereof, including materials and quantity schedules. Technical specifications will be prepared for each critical item in the Landscape Planting Plans. ■ Coordination with the Civil Engineer for any required grading of an ornamental nature to be included into the overall site grading plan. ■ Coordination with the Architect in relation to required sleeves for draining enclosed or raised planting structures. ■ Coordination with Structural Engineer related to allowable plantings and soil preparation adjacent to structural footings and slabs. Not included in this item: ■ Paving, structural planters,walls,furniture and other inorganic site elements. ■ Hardscape design,signage,site furnishings, lighting,fences, or water features. ■ 2D or 3D renderings, graphics or applications required to pursue a variance or special exception to the ordinance. ■ LEED pursuit. ■ Green roofs or terraces over structure. ■ Construction supervision or administration. Attachment A Scope of Services Fire Station Park Project Page 4 of 7 LANDSCAPE IRRIGATION PLANS:CONSULTANT will provide a Landscape Irrigation Plan that consists of a fully automated irrigation system to service plantings on the site as required. Included in this item: ■ Coordination of CITY review and approval of plans prepared as part of this item. ■ Schematic Design: One (1) schematic plan submittal for client review and coordination. Plan will depict only location of water source, routing of main water service line, proposed irrigation type for each location (i.e. drip, spray, rotor, temporary) and list of proposed manufacturer. ■ Construction Documents: Plans to include Irrigation Plans to a level sufficient to demonstrate design intent and allow the construction thereof, including materials and quantity schedules, pipe sizing, notes and technical installation details. Technical specifications will be prepared for irrigation components. ■ Coordination with the Civil Engineer to pass along requested tap location(s), meter placement and meter size required. ■ Coordination with Structural Engineer related to allowable irrigation adjacent to structural footings and slabs. ■ Coordination with the Civil Engineer to assure that sleeves for irrigation system are accounted for on the plans. ■ Coordination with the Electrical Engineer to provide electrical service to the irrigation controller. Not included in this item: ■ Pump systems and filters required for use of non-potable water and storm water recapture. These services can be provided as a Special Service. GRADING PLAN: CONSULTANT will prepare a Grading plan for the project. This plan will show existing grades, proposed contours and spot elevations as required, and existing and proposed finished floor elevations. Included in this item: ■ Coordination of CITY review and approval of plans prepared as part of this item. ■ One (1) revision to the plan to reflect site plan changes as a result of Owner comments. ■ Estimated cut& Fill quantities to balance earth work. Engineering Services DRAINAGE PLAN:CONSULTANT will prepare a Drainage plan for the project. Included in this item: ■ Coordination of CITY review and approval of plans prepared as part of this item. ■ One (1) revision to the plan to reflect site plan changes as a result of Owner comments. ■ Preparation of a site Drainage Area Map that will define storm water discharges and proposed drainage patterns for the site. ■ Design of on-site storm sewer, if required. SITE PAVING PLAN: CONSULTANT will prepare construction plans and details for site vehicular paving, and drive approaches. Paving section designs are to be based on recommendations included in the subconsultants Geotechnical Report. INTEGRATED STORM WATER MANAGEMENT SITE PLAN: CONSULTANT will prepare an Integrated Storm Water Management(iSWM)Site Plan for the proposed project. The iSWM Site Plan will be a comprehensive report that contains the technical information and analysis to meet the storm water regulatory requirements. The plan will include existing condition and post development hydrologic and hydraulic analysis and a storm water management system design. PRIVATE WATER PLAN: CONSULTANT will prepare plans for private on-site water improvements fire hydrants, meters, mains to serve the proposed development. These improvements will be designed from existing public mains located adjacent to the site. Included in this item: ■ Coordination of CITY review and approval of plans prepared as part of this item. ■ One (1) revision to the plan to reflect site plan changes as a result of Owner comments. Additional changes will be made on an hourly rate basis. Not included in this item: ■ Design of any public water or sanitary sewer improvements or extensions not described above. ■ Profiles for public or private systems. ■ Sanitary Sewer Improvements. STORM WATER POLLUTION PREVENTION PLAN: CONSULTANT will prepare a Storm Water Pollution Prevention Plan for construction activities in the project area including an Erosion Control Plan, Instructions to the Contractor and Contractor's Checklists. Included in the item: ■ Coordination of CITY review and approval of plans prepared as part of this item. ■ One (1) revision to the plan to reflect site plan changes as a result of Owner comments. Not included in this item: ■ Review and determination of any listed endangered or threatened species or designated critical habitats in the project area. ■ Construction administration or monitoring of contract activities during construction. ■ Assistance to the Owner and to the Contractor in filing the required Notice of Intent(NOI)and the Notice of Termination (NOT)form for the proposed construction activities. Special Services Attachment A Scope of Services Fire Station Park Project Page 6 of 7 SKATEPARK PLANS:CONSULTANT will contract with a sub-consultant for the design of the skatepark components for the project as required. ELECTRICAL ENGINEERING PLANS: CONSULTANT will contract with a sub-consultant for the design of the electrical components for the project as required. Plans will be signed and sealed by an Engineer licensed to perform work in the State of Texas. Included in this item: • Photometric analysis of the site to determine optional light standard locations for proposed photometrics. • Service,supply, and layout of lighting. STRUCTURAL PLANS:CONSULTANT will contract with a sub-consultant to design the foundations for the light standards required for the site. REIMBURSABLE EXPENSES: Included in this item are usual and customary expenses normally incurred during this type of project.These could include travel expenses,courier delivery charges, overnight delivery charges, copies of deeds, copies of existing plans and/or maps, photocopies, printing and reproduction(either in-house or by reproduction company). Application, review and filing fees are not included in this item. A copy of our "Standard Billing Rates for In-House Reimbursable Charges" is attached for your reference. Based on our understanding of the scope of services,the following items are not included in this proposal: 1. Environmental Assessment 2. Geotechnical Assessment 3. Cultural Resource Assessment 4. Record drawings Attachment A Scope of Services Fire Station Park Project Page 7 of 7 Attachment B Compensation The services described in Attachment A Scope of Services shall be provided for a total lump sum fee of$124,828(One Hundred Twenty Four Thousand Eight Hundred Twenty Eight Dollars). The overall fee total shown shall not be exceeded without prior written authorization from the CITY. Payment for the services described in Attachment A Scope of Services shall be invoiced to the CITY on a monthly basis, based upon percentage completed for each task.
