HomeMy WebLinkAboutContract 38562-A2 AMENDMENT NO. 2 STATE OF TEXAS S CITY SECRETARY CONTRACT NO." a-Ala (M&C Required) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and Rimley-Horn and Associates, Inc. , (Engineer) made and entered into City Secretary Contract No. 38565, (the Contract) which was authorized by the City Council by M&C C-23518 on the 12th day of May 2009 and subsequently revised by one previous amendment; and WHEREAS, the Contract involves engineering services for the following project: Water and Sanitary Sewer Main Relocations for the SH121T Crossing west of the Hulen Street Bridge with the Union Pacific Railroad Davidson Rail Yard. WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work au%-- revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, of the Contract is amended to include the additional engineering services specified in M&C C-24737, adopted by the City Council on the 15th day of February 2011, and further amplified in a proposal letter dated December 15, 2010, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $184,400.00. 2 . Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $849,765.00. CODE: C TYPE: CONSENT PUBLIC NO HEARING: SUBJECT: Authorize Execution of Amendment No. 2 in the Amount of$184,400.00 to City Secretary Contract No. 38565 with Kimley-Horn and Associates, Inc., for Water and Sanitary Sewer Main Relocations for the State Highway 121T Crossing West of the Hulen Street Bridge Within the Union Pacific Railroad Davidson Rail Yard (COUNCIL DISTRICTS 3 and 9) RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute Amendment No. 2 in the amount of$184,400.00 to City Secretary Contract No. 38565 with Kimley-Horn and Associates, Inc., for Water and Sanitary Sewer Main Relocations for the SH121T crossing west of the Hulen Street Bridge within the Union Pacific Railroad Davidson Rail Yard, thereby increasing the contract amount to $849,765.00. DISCUSSION: On May 12, 2009, (M&C C-23516)the City Council authorized an engineering agreement in the amount of$585,365.00 with Kimley-Horn and Associates, Inc., for Water and Sanitary Sewer Main Relocations for the SH121T Crossing west of the Hulen Street Bridge within the Union Pacific Railroad Davidson Rail Yard. The agreement was subsequently revised by one previous amendment (M&C C-24048, January 26, 2010) in the amount of$80,000.00 that provided for the relocation of the inaccessible segment of a 48-inch water main that was located within Colonial Park Apartments. Amendment No. 2 will provide for the following construction assistance services to facilitate timely construction of the project in order to accommodate NTTA's schedule for SH121T and on-going improvements within Union Pacific property and will include: Shop drawing reviews Construction coordination meetings with City staff and contractors. Project Management meetings with City staff, Union Pacific and NTTA Material substitution reviews A waiver of the M/ BE Ordinance was granted for this amendment due to the fact that no M/WBE subcontracting opportunities are available on the scope of services proposed to be provided. The project is located in COUNCIL DISTRICTS 3 and 9. FISCAL INFORMATION/CERTIFICATION: The Financial Management Services Director certifies that funds are available in the current capital budgets, as appropriated, of the Water Capital Projects Fund and the Sewer Capital Projects Fund. (Kimley-Hom)to perform additional services for the construction services for the Water and Sanitary Sewer Main Relocations for SH121 T Crossing West of the Hulen Street Bridge within the Union Pacific Railroad Davidson Rail Yard (UPRR)project. Kimlcy-Horn will conduct project management meetings with City staff twice per month. • Clarifications and Interpretations,Shop Drawings,Substitutes,and Site Visits: 1. Clarifications and Interpretations. Kimley-Horn will respond to reasonable and appropriate Contractor requests for information and issue necessary clarifications and interpretations of the Contract Documents to City as appropriate to the orderly completion of Contractor's work. Shop drawings. Kimley-Horn will review and recommend appropriate action in request to Shop Drawings for the Contractor is required to submit,but only for conformance with the information given in the Contract Documents and compatibility with the design concept of the completed Project as a functioning whole as indicated in the Contract Documents. Such review and approvals or other action will not extend to means,methods,techniques,equipment choice and usage,sequences,schedules,or procedures of construction or to related safety precautions and programs. 3. Substitutes and"or-equal." Evaluate and determine the acceptability of substitute or"or-equal"materials and equipment proposed by Contractor in accordance with the Contract Documents,but subject to the provisions of applicable standards of state or local government entities. 4. Site Visits. Kimley-Horn will perform site visits in accordance with the Engineering Agreement for this project. • Change Orders—Consultant may recommend Change Orders to Client, and will review and make recommendations related to Change Orders submitted or proposed by the Contractor. • Project Management—Perform project management services including coordination with City staff,Contractor,Union Pacific Railroad,and NTTA representatives.
