This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO.53372,EASEMENT
ENCROACHMENT LICENSE AGREEMENT is made and entered into by and between the CITY OF
FORT WORTH,a home rule municipal corporation of Tarrant County,Texas("City"),acting herein by and
through its duly authorized City Manager,Assistant City Manager,or Development Services Director,and
NexMetro Fossil Creek,LP,a(n)limited partnership ("Licensee"),acting herein by and through its duly
authorized Managing Director.
RECITALS
WHEREAS,City and Licensee made and entered into City Secretary Contract No.53372 on January 8,
2020(the"Agreement"),to authorize the use of the City's easement for the purposes of installing private
fencing and telecommunications;and
WHEREAS,the parties wish to amend the Agreement to include a retaining wall and private gates
in the drainage easement and add the installation of fencing and a water line to the sewer easement;and
WHEREAS,it is the mutual desire of City and Licensee to execute this Amendment to the Agreement
to revise"Exhibit A"in the Agreement to depict the revised encroachment area.
NOW,THEREFORE,City and Licensee,acting herein by and through their duly authorized
representatives,enter into the following that amends the Agreement:
1.
"Exhibit A"in the Agreement is hereby replaced with the attached revised description of the
encroachment area, labeled as"Revised Exhibit A."
2.
The effective date of this Amendment shall be the date of its execution by the City.
3.
All other provisions of the Agreement which are not expressly amended herein shall remain in full force
and effect.
