ORDINANCE NO.
An Ordinance providing for the selection and
appointment of a City Treasurer, prescribing his duties and
fixing the compensation therefor, and repealing all ordi-
nanceSin conflict theregith.
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF FORT WORTH.
S.ectlon.l.The Treasurer of the City of Fort
Worth shall be an adult male person not less than 21 years
of age and a resident citizen of the said City of Fort
Worth.
Section II. The said Treasurer shall be
selected by the Board of Commissioners, and he shall
hold his office for a period of one year, and until
his successor shall have been selected and qualified.
But nothing herein shall be construed to prevent the
Board of Commissioners from selecting a Treasurer for
part of an unexpired term.
Section MIT. Before entering upon the duties
of his office, the Treasurer shall take the oath of office
prescribed by the Constitution of the State of Texas, and
in addition thereto shall make and execute a bond with
two or more good sufficient sureties, or with a surety
company thereon authorized to do business in the State

of Texas, in the sum of $Jvov oopayable to the
City of Fort North, to be approved by the Board of Com-
missioners, conditioned for the faithful discharge of
his duties in accordance with the laws-of the State of
Texas, of the Charter of the City of Fort Worth and all
ordinances pursuant thereto. The Board of Commissioners
may at any time require of the Treasurer a new bond, when-
ever for any reason said Board of Commissioners may deem
it proper or expedient so to require it, without any reason
being assigned the-efor.

Igutered by thesaid Board of Commissioners requiring a new
or additional bond, then said Treasurer shall perform no
official act until the same shall have been given, and
failing for a period of five days after such order has
been made to comply with same to the satisfaction of the
said Board of Commissioners, evidenced by its approval
of such new or additional bond, then in such case the
office shall be and become vAcant, without further action,
and a new treasurer shall be elected by the said Board of
Commissioners for the unexpired term, and the former
Treasurer shall forthwith pay over and deliver to said new
Treasurer as soon as thelatter shall have qualified and
given bond all such funds and moneys with which said former
Treasurer is chargeable, and all papers, vouchers and books
belonging or pertaining to said office. Provided further
that whenever the City of Fort Worth shall have selected
a depository under the general State Law for the custody
Of its funds that then At any time after such selection
the bond of such Treasurer may be reduced to such sum
as the Board of Commissioners by resolution mgxy prescribe.
Section 5. The said Treasurer shall receive
and keep all moneys belonging to the City of Fort Worth,
and he shall be the official custodian of same and responsi-
ble to said city for the safe keeping of same, and shall
account to the city and be liable therefor, in respect to
all moneys and funds belonging to said city, that may come
into his hands, and all papers, documents, vouchers, books
and receipts that may come into his hands of which he is
chargeable by law. Provided, however, that when the City
of Fort Worth shall have selected a depository under the
general state law for the custody of its funds, it shall
be the duty of such City Treasurer, and he shall be requir-
ed to deposit in such depository all moneys, funds and

securities coming into his hands in virtue of his office
as such Treasurer.
Section 6. The said Treasurer shall pay out
money only when warrants are drawn therefor, executed by
the Mayor, and attested by the City Secretary under the
seal of the City, and countersigned by the City Auditor,
and shall pay out no money except upon such warrant, nor
shall any warrant be paid unless it shows upon its face the
purpose for which it was drawn, the fund out of which it is
to be paid, and that it had been directed or authorized to
be issued by the Board of Commissioners giving the date
of such order. Vhen the City shall have a regularly
selected and bonded depository the said Treasurer shall
countersign the warrants drawn as herein provided, and the
warrant so drawn acid countersigned when properly indorsed
by the payee shall be sufficient to authorize the deposit-
ory to pay same.
Section 7. The said Treasurer shall not honor
any draft upon the interest and sinking funds provided for
the bonds of the City of Fort Worth, noir pay out nor divert
same or any part thereof, except for the purpose of paying
the interest on such bonds or for redeeming the same or for
investment, in such securities as may be provided by law,
end only in such cases when expressly authorized to do so by
the Board of Commissioners of the City of Fort Worth.
Section 8. In the payment of warrants which
may be drawn upon said City Treasurer no one fund shall be
utilized in the payment of warrants drawn upon another fund,
and each and every fund shall be kept separate and
distinct from the other and an accurate and reliable x
kept thereof. When special funds are created or exist, same
may be disbursed upon warrants drawn as aforesaid, only for
the special purpose for which said fund was created. When
the City has a depository, it shall be the duty of such
Treasurer to furnish said depository such information with

reference to the various funds which under the law must
be kept separat>with such information as will Inable
said depository to segregate the various funds oil its
books, and in making deposits the said Treasurer shall
furnish such depository a slip showing the amount of the

deposit to be credit/to each fund. Failure on the part of
said Treasurer strictly to observe and keeptthis section
and provisions thereof or any part of same, shall make him
and the surety or sureties on his bond liable for the diver=
sion of said fund, or any part of same, so illegally or im-
properly paid out or disbursed as aforesaid.
Section 9. Said Treasurer shall keep and
maintain a full, true and correct account of all moneys
coming into his hands, roach fund under its proper and
separate head and subdivision, and shall render to the
City Auditor promptly and as -often as required a full
true and accurate statement of his receipts and disburs-
ments, and shall furnish promptly to the Board of Com-
missioners any and all information required of him, and
faithfully do andperform all other acts and things necessary,
proper and incident to his office.
Section 10. It shall be and is hereby made
the duty of all officers and employees of the City of Fort
Worth, other than the City Assessor and Collector, collecting
or obtaining money from any person, corporation or other
source belonging to the City of Fort Worth or of which the
City may be custodian, to promptly deliver to and deposit
with said Ad*pa #tery each day as same is obtained, collected
or procured, said Treasurer shall make prompt report thereon
to the City Auditor or to the Board of Commissioners as often
as may be by said Auditor or the Board of Commissioners
directed. The City Assessor and Collector shall on Monday
and Thrusday of each week pay over to the Treasurer all
moneys by him collected and shall furnish said Treasurer such

data andinformation with reference to the amount of
moneys belonging to each fund Re will Enable said Treasurer
to deposit the correct amount to each fund. Failure on
the part of any officer or employee of the City of Fort
Worth to comply with the provisions of this sedtion shall
render such officer or employee liable to be removed from
office.
Section 11. The salary of the Trba.surer . for

Section 12. All of the provisions of chapter
three title 1, the same being sections one to ten inclusive
as the same appears at pages 136, 137, 138, knd 139 of the
Revised Ordinances of the City of Fort Worth adopted January
26, 1915.be and the same are hereby repealed.
This Ordinance shall be in force from and after
its passage.

at a regular session of said Board held Tuesday August 24th,
