AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE SEWER CAPITAL PROJECTS FUND IN THE
AMOUNT OF $70,545 FROM A WATER AND SEWER OPERATING FUND
TRANSFER, FOR THE PURPOSE OF EXECUTING A CONTRACT WITH
CONATSER CONSTRUCTION TEXAS, L.P. FOR PAVING, DRAINAGE, AND
WATER AND SEWER IMPROVEMENTS ON PHASE 1 OF KELLER-HICKS
ROAD, CITY PROJECT NO. 00653; PROVIDING FOR A SEVERABILITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES
IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2006-
2007 in the Budget of the City Manager, there shall also be increased estimated receipts and
appropriations in the Sewer Capital Projects Fund in the amount of $70,545 from a Water and
Sewer Operating Fund transfer, for the purpose of executing of contract with Conatser Construction
Texas, L.P. for paving, drainage, and water and sewer improvements on phase 1 of Keller-Hicks
road, City Project No. 00653.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly.repealed.

Authorize Execution of Contract with Conatser Construction Texas, L.P., for Paving, Drainage,
Water and Sewer Improvements on Phase 1 of Keller-Hicks Road from 750' West of Ridgeview thru
Alta Vista Intersection and Adopt Appropriation Ordinance (DOE 5317)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the transfer of $70,545.00 from the Water and Sewer Operating Fund to Sewer Capital
Projects Fund;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Sewer Capital Projects Fund in the amount of $70,545.00, from available funds; and
3. Authorize the City Manager to execute a contract with Conatser Construction Texas, L.P., in the amount
of $1,704,197.50 for Paving, Drainage, Sewer Improvements on Phase 1 of Keller-Hicks Road from 750'
west of Ridgeview through the Alta Vista Intersection.
DISCUSSION:
On April 24, 2006, the City executed a Community Facilities Agreement, City Secretary Contract No.
33444, with Keller Independent School District (KISD) for the construction of three lanes of an ultimate five-
lane roadway in front of its new intermediate and middle schools from just west of Ridgeview Circle to Alta
Vista Road.
On January 9, 2007, (M&C G-15571) the City Council authorized the sale of $42,325,000 Certificates of
Obligation for the purpose of funding part of the Critical Capital Needs Program. That amount included
$1,200,000 to supplement the KISD project and provide for the construction of the ultimate five-lane
roadway as a single project.
On May 25, 2007, (M&C C-22152) the City executed Amendment No. 1 to Community Facilities
Agreement, City Secretary Contract No. 33444, with Keller Independent School District (KISD) for
improvements to Keller-Hicks Road. This M&C increased estimated receipts and appropriations by $795,
247 for KISD's participation.
The project was advertised on April 19, 2007 and April 26, 2007. The following bids were received on May
17, 2007:

The new pavement will consist of 12-inch concrete over 6-inch stabilized subgrade with 7-inch concrete
curb.
Based on the bid, City participation costs will be $839,789.50 for paving and drainage improvements and
$69,161.00 for sewer improvements. KISD participation will be $795,247.
Funding in the amount of $1,384.00 is included for associated water and sewer inspection.
Funding in the amount of $186,259.00 is included for project management, material testing, and inspection
and project closeout. Contingency funds for change orders is $48,275.00
Conatser Construction TX, L.P. is in compliance with the City's M/VVBE Ordinance by committing to 4
percent M/WBE participation and documenting a good faith effort. Conatser Construction TX, L.P.
identified several subcontracting and supplier opportunities. However, the M/WBEs contracted in the
areas identified did not submit the lowest bids. The City's goal on this project is 20 percent.
This project is located in COUNCIL DISTRICT 2, Mapsco 22K.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations, and the adoption of the
attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, of
the Sewer Capital Projects Fund and the 2007 Critical Capital Projects Fund.
