ORDINANCE NO . AN ORDINANCE granting to the Northern Texas Traction Company, a corporation, and its assigns, the right and franchise to construct, maintain and operate certain lines of electric street railway over and upon certain streets in the City of Fort Worth, and to erect and maintain, in connection therewith, poles, trolley wires, and overhead wire equipment necessary to operate such electric railway; the same being extensions of, connections with, and branches of certain lines of electric street railway, at present owned and operated by said Northern Texas Traction Company in the city of Fort Worth. BE IT ORDAINED BY THE BOARD OF COMISSIONERS OF THE CITY OF FORT WORTH: SECTION I: The City of Fort Worth, a minicipal corpor- ation, in Tarrant County, Texas, doth hereby give and grant unto the Northern Texas Traction Company, a corporation, domiciled in Tarrant County, Texas, and organized for the purpose of opera- ting electric street railways, and its successors, and assigns, the right, privilege and franchises to construct, maintain and operate a line of electric street railway tracks, together with all necessary switches, side-tracks, and turnouts, for the operation of electric street cars thereon, as an extension of, connection with and branch of that present line of electric street railway now owned and operated by the said Northern Texas Traction Company, over East Third Street, Harding Street and East Fourth Street, and Hill Street to Chandler Avenue, along and over and upon the following named and described streets in said City of Fort Worth, to-wit: "Beginning at a point of intersection with the present lines of street railway track owned and operated by the Northern Texas Traction Company og Rill Street, at the intersection of Hill Street and C andler Avenue; thence in a Northerly direction over an along Chandler Avenue to and across East First Streetrand continuing North over proposed North extension © Chandler Avenue, to and across Pendleton Aver4te, and continuing North over proposed North extension of Chandler Avenue to the old Grapevine road, now a publio street, and continuing ffnrth over and along such street to Carthridge Avenue." And the like privilege and franchise is also granted unto the said Northern Texas Traction Company, and its assigns to erect and maintain, in connection with its said line of street railway track, poles, wires and overhead electrical construction necessary, use- ful or desirable for the propulsion of $aid cars by electric power. This franchise and grant of the right and privilege to extend said lines of street raiIN ay over the streets just above mentioned, to be subject to and runt'errent with the franchises and right heretofore granted to the Northern Texas Traction Company and its assigns, to maintain and operate a line of electric street railway over Commerce Street,,,Bast_ d'bird- Street, Harding Street and East Fourth Street and Hill Street in said City. 2• SECTION II. All tracks laid under the provisions of this Ordinance, shall be located, laid and maintained in such manner as shall be designated by the City Engire:er. SECTION III: shall. at Said LU orotk"rnownxas salercoat an& mexpeennse, p or ave and role pave, or otherwise surface and re-surface and keep constantly in good order and condition, with the same material with which the street on the outside is paved and surfaced, all that part of each street occupied by it or that which lies between the rails of said tracks, and for 18 inches on each side thereof, and said Northern Texas Traction Company or its assigns shall conform its or their tracks or any part thereof to theproper grade of each street and change the level of said tracks as often and whenever the grade of any such street is changed so that every ps:rt of each track shall always be kept at the duly established grade line or as near thereto as the surface of the grade of the street outside thereof will permit. SECTION IV: Said Northern Texas Traction Company, its successors and assns, do hereby agree to indemnify and holdethe said City of 'Fort Worth harmless because of, and promptly to pay off and discharge or repay to the said city, all damages, claims, judgments, attorneys' fees, and other costs and expenses rendered against, or incurred, or paid out by the said city by reason of injuries either to persons or property occasioned by the proximate result of anything done or permitted or in any way proximately arising out of the construction, operation, maintenance upon the above streets and thoroughfares of the tracks, poles or wires of said Company. SECTION V: ill of the conditions, limitations and provisions contained in the ordinances granting franchises now owned by the Northern Texas Traotion Company, for the operation of a line of street railway over Commerce Street, East Third Street, Harding Street, and East Fourth Street to Maple Avenue, and on in an Easterly direction over East Fourth Street as the same is now used as the hard surface passageway in such Easterly direction over and across the viaduct and bridge on the Trinity River and extending in an Easterly direction to Sylvania Avenue and across the same and over and along Hill Street to Chandler Avenue, shall continue in force and govern and control (in addition to the provisions of this Ordinance) , the operation and construc- tion of the contemplated extensions.of the present lines of street railway as herein and hereby granted respectively.
