AN ORDINANCE WITH RESPECT TO CERTAIN BUILDING
ENCROACHMENTS OF THE TWO-STORY FRAME BUILDING
LOCATED ON THE REAR OF LOT 1, BLOCK 19, HILL-
CREST ADDITION TO THE CITY OF FORT WORTH, TARRANT
COUNTY, TEXAS; PERMITTING BEALE DEAN, HIS HEIRS
AND ASSIGNS, TO LEAVE THE EXISTING BUILDING
ENCROACHMENT BY THE NORTH WALL OF SAID BUILDING
OF 9 INCHES ON BRYCE AVENUE, AND BY THE WEST WALL
OF THE ATTACHED GARAGE OF SAID BUILDING OF 1 FOOT
ON THE ALLEY OF SAID BLOCK 19; AND PROVIDING THAT
SAID BEALE DEAN, NOR HIS HEIRS OR ASSIGNS, SHALL
NOT BE CHARGED ANY AMOUNT FOR SUCH USE OF SAID
PORTION OF SAID BRYCE AVENUE AND SAID ALLEY
COVERED BY SAID ENCROACHMENTS; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH AND SPECIFYING
AN EFFECTIVE DATE.
WHEREAS, Beale Dean of 2100 Thomas Place, Fort Worth, Texas,
is the owner of Lot 1, Block 19, Hillcrest Addition to the City
of Fort Worth, Tarrant County, Texas (situated at the southwest
corner of the intersection of Thomas Place and Bryce Avenue in
said City of Fort Worth, Texas), together with the two-story
frame house located on the rear of said lot, and the one-story
brick house located on the front of said lot; and
WHEREAS, the north side of said• two-story frame house
encroaches one foot on Bryce Avenue; and Whereas, the west side
of the attached garage to said two-story frame house encroaches
a foot on the alley in said block;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS:
SECTION 1.
That Beale Dean, the owner of said land above described and
the improvements thereon, his heirs and assigns, be permitted to
leave the existing building encroachment of said two-story frame
house above referred to, to-wit: the encroachment by the north
wall of said building of one foot on said Bryce Avenue, and the
encroachment by the attached garage of said build�.ng of one foot
on the alley in said Block 19; and that said Beale Dean, nor his
heirs or assigns, shall not be charged any amount for such use
of the portion of Bryce Avenue and of the alley so encroached upon
as above set out; and that said encroachments on said above
described land be allowed to stand during the life of said two-
story frame building as same is now constructed; provided, however,
that in the event said building be demolished or major alterations
or repairs be made in the future, that such encroachments be
eliminated.
SECTION 2.
That all ordinances or parts of ordinances in conflict
with the provisions of this ordinance are hereby expressly
repealed.
SECTION 3.
That this ordinance shall take effect and be in full force
and effect from and after the date of its passage, and it is do
ordained,Passed and adopted this 4 day of June, 1951.
