AN ORDINANCE AMENDING SECTION 9 OF ORDINANCE
NO. 3011, BEING AN AMENDMENT TO THE ZONING
ORDINANCE OF THE CITY OF FORT WORTH, TEXAS,
PRESCRIBING A SAVINGS CLAUSE; PROVIDING A
PENALTY FOR THE VIOLATION OF ANY SECTION OF
THIS ORDINANCE OF NOT LESS THAN FIVE DOLLARS
($5.00) NOR MORE THAN TWO HUNDRED DOLLARS
($200.00); PROVIDING EACH DAY THE VIOLATION
CONTIM SHALL BE A SEPARATE OFFENSE; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That Section 9 of Ordinance No. 3011 be and the same is hereby amended.
SECTION 2.
That Section 9, "E" COMMERCIAL DISTRICT, USE REGULATIONS, be and is
hereby amended so that hereafter it shall include the following uses:
39-b. Commercial Swimming Pools subject to the following conditions:
1. Such swimming pool shall not exceed 5,000 square
feet in area measured at the scum gutter.
2. No pool shall be closer than 100 feet from a
Dwelling District.
3. The area of all accessory buildings shall not
exceed 50 per cent of the pool area, with a
minialm of 600 square feet allowable.
4. Off-Street parking spaces shall be provided in
the minimum ratio of one (1) off-street parking
space to each 200 square feet of pool area or
fraction thereof, and the parking arrangement
shall have the approval of the City Traffic
Engineer.
SECTION 3.
If any section, subsection, sentence, clause or phrase of this ordi-
nance is for any reason held to be unconstitutional, void or invalid, the
validity of the remaining portions of this ordinance shall not be affected
thereby, it being the intent of the City Council in adopting this ordinance

that no portion hereafter or provision or regulation contained herein shall
become inoperative or fail by reason of any unconstitutionality or invalidity
of any section, subsection, sentence, clause, phrase, portion, provision or
regulation of this ordinance.
SECTION 4.
Any person, firm, or corporation who violates, disobeys, omits, neg-
lects or refuses to comply with this ordinance, or who resists the enforcement
of any of the provisions thereof, shall be fined not less than Five Dollars
($5.00) nor more than Two Hundred Dollars ($200.00) for such offense. Each
day that a violation is pezmitted to exist shall constitute a separate
offense.
SECTION 5.
This ordinance shall take effect and shall be in full force and
effect from and after its passage and publication as provided by law.
