ORDINANCE NO. 40 70
AN ORDINANCE AMENDING SECTION 2 OF ORDINANCE NO. 4045
ADOPTED BY THE CITY COUNCIL ON THE 13TH DAY OF FEBRU-
ARY, 1959, AND BEING AN ORDINANCE APPROVING CERTAIN
SPECIFICATIONS FOR THE IMPROVEMENT OF A PORTION OF THE
EAST BERRY STREET EXTENSION AND SETTING A DATE FOR THE
ADVERTISEMENT OF BIDS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
Section 1.
That Section 2 of Ordinance No. 4045 adopted by the City Council
on the 13th day of February, 1959, be, and is hereby amended to read as
follows:
That the City Secretary is hereby directed to advertise
for Bids for the construction of said improvements in
accordance with the said Specifications, Which advertise-
ment shall be inserted one or more times in the Fort Worth
Star Telegram, a newspaper of general circulation in the
City of Fort Worth, and shall call for sealed Bids for the
said work, to be filed with the City Council on or before
the 24th day of March, 1959, at 10;00 A.M. upon which date
shall be opened and read as prescribed by the City Charter.
That the first publication of said advertisement shall be
not less than ten (10) days before the date herein set for
opening of Bids.
Section 2.
That Ordinance No. 4o45 shall be in all other respects remain in
full force lind effect.
Section 3.
That this ordinance shall take effect from and after the date
of its passage.

Dear Sir:
The City Council on February 139 1959, adopted Ordinance No. 4045, approving
the Specifications and setting March 17, 19599 as the date for the receipt
of bids for the paving of the Last Berry Street Extension from Glen Garden
Drive to Mitchell Boulevard, both the North and South legs. The project was
advertized on March 3, 1959, but on March 16, 1959, the day preceeding that
set for the receipt of bids, a difficulty arose concerning excavation quan-
tities for the alternate types of pavement in the project, which necessitated
a change in the proposal. All bidders were notified of the change that was
to be made and that the date for the receipt of bids was postponed.
The Proposal for the project has been revised, and copies have been sent to
the prospective bidders. Attached is a proposed Ordinance amending the above
Ordinance No. 4015, re-setting to March 24, 1959, the date for the receipt of
bids, which we recommend for adoption so that the project may proceed without
further delay.
