AN ORDINANCE AMENDING SECTIONS 9 AND 10 OF
ORDINANCE, NO. 3011, BEING AN A1v MENT TO THE
ZONING ORDINANCE OF THE CITY OF FORT WORTH,
PRESCRIBING A SAVINGS CLAUSE; PROVIDING A PEN-
ALTY FOR THE VIOLATION OF ANY SECTION OF THIS
ORDINANCE OF NOT LESS THAN FIVE DOLLARS 45.00)
NOR MORE THAN TWO HUNDRED DOLLARS ($200.00);
PROMING EACH DAY THE VIOLATION CONTINUES
SHALL HE A SEPARATE OFFENSE; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That SECTION 9, "E" COMMERCIAL DISTRICT, USE REGULATIONS, be amended
to include the following use:
19-A. Dog and cat hospitals, or small animal hospitals, if conducted
wholly within a completely enclosed sound proofed and air-conditioned building,
provided, that noise or odors created by activities within the building shall
not be perceptible beyond the property line, and that no animals are kept
outside the building at any time.
SECTION 2.
That PARAGRAPH 7 OF SECTION 10, "F" CO113ERCIAL DISTRICT, USE REGULATIONS
providing "Dog and Cat Veterinary Clinics, if entirely within a building and
no animals are kept over night" is hereby expressly repealed and deleted from
such section.
SECTION 3.
If any section, subsection, sentence, clause of phrase of this ordinance
is for any reason held to be unconstitutional, void or invalid, the validity of
the remaining portions of this ordinance shall not be affected thereby, it
being the intent of the City Council in adopting this ordinance that no portion
hereafter or provision or regulation contained herein shall become inoperative
or fail by reason of any unconstitutionality or invalidity of any section, sub-
section, sentence, clause, phrase, portion, provision or regulation of this
ordinance.
SECTION 4.
Any person, fixm, or corporation who violates, disobeys, omits, neglects
or refuses to comply with this ordinance, or who resists the enforcement of any
of the provisions thereof, shall be fined not less than Five Dollars ($5.00)
nor more than Two Hundred Dollars ($200.00) for such offense. Each day that
a violation is permitted to exist shall constitute a separate offense.
SECTION 5.
The zoning regulations and districts, as herein established, have been
made in accordance with a comprehensive plan for the purpose of promoting health,
safety, morals and the general welfare of the community. They have been designed
to lessen congestion in the streets; to secure safety from fire, panic and other
dangers; to provide adequate light and air; to prevent the overcrowding of land;
and avoid undue concentration of population; to facilitate the adequate provision
of transportation, tauter, sewerage, parks and other public requirements. They
have been made with reasonable consideration, among other things, of the character
of the district and its peculiar suitability for the particular uses and with a
view of conserving the value of buildings and encouraging the most appropriate
use of land throw the community.
SECTION 6.
This ordinance shall take effect and shall be in full force and effect
from and after its passage and publication as provided by law.
