AN ORDINANCE AMENDING ORDINANCE NOS. 3991, 4064, 4080
AND 4081, AS WELL AS ALL OTHER PROCEEDINGS TAKEN AND
HAD RELATIVE TO THE IMPROVEMENT OF CERTAIN PORTIONS
OF BEACH STREET EXTENSION IN THE CITY OF FORT WORTH,
TEXAS, FOR THE PURPOSE OF CORRECTING SAID ORDINANCES
AND PROCEEDINGS TO SHOW THAT SAID PORTIONS OF BEACH
STREET EXTENSION ARE ALSO KNOWN AS HAWKINS STREET IN
SAID CITY.
WHEREAS, by ordinance passed and approved by the City
Council of the City of Fort Worth, Texas, being Ordinance No.
3991, the City Council determined the necessity for and ordered
the improvement of three certain portions of Beach Street
Extension; and,
WHEREAS, subsequent to the passage and approval of said
ordinance, plans and specifications for said improvements were
approved and adopted by the City Council by Ordinance No. 4064;
and,
WHEREAS, notice to bidders was given as required by the
City Charter and the bid of Texas Bitulithie Company was found
to be the lowest and best bid for the making and construction
of the improvements theretofore ordered,and contract for the
making and constructing of said improvements was awarded to
Texas Bitulitbie Company pursuant to Ordinance No. 4081 passed
by the City Council, and said contract has been duly executed;
and,
WHEREAS, in view of the fact that the portions of Beach
Street Extension to be improved, covered by said contract and
the foregoing Ordinances, are shown on the City Map as being
portions of Hawkins Street and the street signs on said portions
of street bear the name of Hawkins Street, it is deemed advisable
to amend the aforementioned Ordinances so as to show that Beach
Street Extension and Hawkins Street is one and the same;
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH,TEXAS, THAT:
SECTION I.
Ordinance Nos. 3991, 064, 4080 and 4081 are hereby amended
so that said Ordinances as amended will redescribe and refer to
the portions of street to be improved as hereinafter set forth,
to wit:
BEACH STREET EXTENSION (A PART OF WHICH IS
ALSO PRESENTLY-KNOWN AS HAWKINS STREET): from;
the northeasterly line of Mitchell Boulevard
northerly across Lot 13, Block 61, to Avenue I;
thence northerly across Avenue I and continuing
northerly along the street presently known as
Hawkins Street to the northerly line of East
Rosedale, known and designated as Unit No. 2;

BEACH STREET EXTENSION (PRESENTLY KNOWN AS
HAWKINS STREET): from the Northerly line of East
Rosedale to the Northerly line of East Vickery
Boulevard, known and designated as Unit No. 3;
BEACH STREET EXTENSION (PRESENTLY KNOWN AS
HAWKINS STREET): from the northerly line of East
Vickery Boulevard to the Northerly line of Camilla
Avenue, known and designated as Unit No. 4.
SECTION II.
There exists a public necessity, and said City Council
does hereby determine that it is necessary to permanently
improve the hereinabove described portions of streets within
the City of Fort Worth, Texas, by raising, grading and filling
same and by constructing thereon a 10 inch crusher run crushed
limestone flexible base course with a 31 inch hot mix asphaltic
binder course and with a li inch hot mix asphaltic concrete
surface, together with combined concrete curbs and gutters and
other necessary incidentals and appurtenances.
SECTION III.
In providing for and making such improvements, said City
Council deems it advisable and hereby determines to proceed
under and in the exercise of the powers, terms and provisions
of Chapter 106 of the Acts of the First Called Session of the
Fortieth Legislature of the State of Texas, which is known and
shown as Article 1105b of the Revised Civil Statutes of Texas,
1925, as amended, and as adopted by the City of Fort Worth
as Section 17, Chapter XXIII of the Charter of said City.
SECTION IV.
The cost of said improvements shall be paid for as has
been more fully provided and set out in Ordinance No. 3991
heretofore passed by the City Council.
SECTION V.
The City Secretary is hereby directed to prepare a notice,
to be signed in the name of the City by its Mayor and to be
attested by its City Secretary, that a portion of the cost of
the improvements to be constructed is to be specially assessed
as a lien upon the property abutting upon each of the portions
of streets hereinabove described, and to file said notice with
the County Clerk of Tarrant County, Texas among the mortgage
records of said County.
SECTION VI.
Each and all of the terms and provisions of Ordinance Nos.
3991, 4064, 4080 and 4081, except as herein amended, shall remain
in full force and effect.
SECTION VII.
This ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so ordained.
