FOR THE CONSTRUCTION OF CERTAIN STREET IMPROVEMENTS TO CERTAIN STREETS WITHIN THE LIMITS AND IN THE UNITS CREATED AND DEFINED BY ORDINANCES ENACTED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH ON THE FOLLOWING DATES: FEBRUARY 14, 1958 AND JUNE 26, 1959; AND ACCEPT- ING THE BID OF FIRST OF TEXAS CORPORATION TO ACT AS FISCAL AGENT OF THE CITY IN CONNECTION WITH SUCH IMPROVEMENTS; AUTHORIZING AND INSTRUCTING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH R. W. GIBBINS, INC. FOR THE CONSTRUCTION OF SAID IMPROVEMENTS; AUTHORIZING AND INSTRUCTING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH FIRST OF TEXAS CORPORATION EMPLOYING SAID CORPORATION TO ACT AS FISCAL AGENT FOR THE CITY; APPROPRIATING FUNDS FOR THE PURPOSE OF SATISFYING SAID CONTRACTS; MAKING OTHER FINDINGS AND DETERMINATIONS AND ENACTING OTHER PROVISIONS INCIDENT AND RELATING TO THE SUBJECT; AND PROVIDING THAT THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY. WHEREAS, the City Council of the City of Fort Worth has heretofore by ordinances duly passed and enacted on February 14, 1958 and June 26, 1959, determinined and declared the necessity for and ordered the improvement of the hereinafter described streets and avenues or portions thereof of the City of Fort Worth, within the limits and in the units created and defined by said ordinances, and has determined to assess a portion of the cost of the improve- ments against the properties abutting the streets and avenues or portions thereof to be improved and against the real and true owners thereof, said streets and avenues or portions thereof being described as follows, to-wit: WHEREAS, the Public Works Director (City Engineer) has caused to be prepared plans and specifications for the construc- tion of the improvements to said streets and avenues or portions thereof; and WHEREAS, the City Council has by ordinances duly enacted approved such plans and specifications, and ordered the City Sec- retary to advertise for sealed bids; and WHEREAS, due advertisement has been made that sealed bids would be received in the office of the. City Secretary in the City Hall in the City of Fort Worth until 10:00 AM, July 30, 1959, for the construction of the aforementioned improvements and for the furnishing of certain fiscal agency services to said City in the event the City should determine to employ a fiscal agent; and WHEREAS, the date for the receipt of bids was reset for August 6, 1959, by Addendum No. 1 to the Specifications and Con- tract Documents; and WHEREAS, pursuant to such advertisement for bids, and pursuant to such Addendum No. 1 to the Specifications and Con- tract Documents, all bids were duly received in the office of the City Secretary of the City of Fort Worth, and at 10:00 AM, August 6, 1959, publicly opened and read aloud; and WHEREAS, after careful consideration of all bids re- ceived, the City Council now finds that the bid of R. W. GIBBINS, INC., a corporation duly incorporated under the laws of the State of Texas, with its principal place of business in the City of Fort Worth, Tarrant County, Texas, which submitted a bid on pro- posal No. 2, when taken into consideration with the proposal of FIRST OF TEXAS CORPORATION to act as the City's Fiscal Agent, is the most advantageous bid for the City to accept, and that R. W. GIBBINS, INC. and FIRST OF TEXAS CORPORATION are both responsible ,parties, and that R. W. GIBBINS, INC. is the lowest and best bid- der on the cash basis and that said bid is fair and reasonable, and that FIRST OF TEXAS CORPORATION, a corporation duly incorpor- ated under the laws of the State of Texas, with its principal place of business in the City of San Antonio, Bexar County, Texas, is the lowest and best bidder on the proposed fiscal agency con- tract and that its proposal is fair and reasonable; and that said company has satisfied both the City and R. W. GIBBINS, INC. of its financial responsibility; and that under such combined bids, the total cost of the improvements will be substantially less than the cost of such improvements would be if the lowest and best bid on the Bid No. 1 bid prices were to be accepted; and WHEREAS, it is now the desire of the City Council to accept the bid of R. W. GIBBINS, INC. at and for the prices bid under its Bid No. 2 proposal ,B A S E B VD); and to also accept the bid of FIRST OF TEXAS CORPORATION to act as Fiscal Agent of said City and to authorize the execution of contracts in conformity therewith, and to make and provide for the appropriation of funds to pay the City's costs arising under such contracts; and WHEREAS, said proposal of R. W. GIBBINS, INC. reads as follows, to-wit: Within ten (10) days of receipt of notice of acceptance of this Bid, the undersigned will execute the formal Fiscal Agent's contract. The attached Certified or Cashier's Check in the sum of $10,000.00 is to become the property of the City in the event the Contract is not executed within the time set forth as liquidated damages for delay and additional work caused thereby. GIBBINS, INC. on its Bid No. 2 proposal (casn basis)(Base Bid) is hereby accepted, and the City Manager of the City of Fort Worth is hereby authorized and directed to enter into a contract, and the City Secretary is authorized to affix the seal of the City thereto and attest same, with said R. W. GIBBINS, INC., based upon said bidder's Bid No. 2 proposal (cash basis)(Base Bid), which contract shall be in words and figures as set forth in the contract documents, heretofore approved.by the City Council of the City of Fort Worth. Section 2 That said contract, after it has been executed by the City Manager of the City and attested by the City Secretary, and after said R. W. GIBBINS, INC. nas executed same, shall be sub- mitted to this City Council, together with the 100% performance bond and payment bond furnished by said R. W. GIBBINS, INC. for ratification and approval. Section 3 That the City Manager of the City of Fort Worth is nereby authorized to enter into a contract, and the City Secretary is authorized to affix the seal of the City thereto and attest same, with FIRST OF TEXAS CORPORATION, which contract shall be in words and figures as set forth in the contract documents, neretofore approved by the City Council of the City of Fort Worth. Section 4 That it appearing that the Director of Finance has cer- tified to the City Council that the money hereinafter appropriated is in the Treasury to the credit of the funds set forth below and J has not been appropriated for any other purpose, the sum of *8o,000.oo shall be and it is hereby appropriated out of such unappropriated monies in the Street Improvement Fund for the pur- pose of satisfying all amounts which the City will be obligated to pay to said R. W. GIBBINS, INC. on said construction contract and the sum of $$o,000.00is hereby appropriated out of such un- appropriated monies in the Street Improvement Fund for the purpose of satisfying all amounts which the City will be obligated to pay to said FIRST OF TEXAS CORPORATION on said fiscal agency contract. _The appropriations hereby made shall be reflected on the proper books and records of the City and such appropriated monies shall be used for no other purpose until the final amounts due to R. W. GIBBIN$, INC. and to FIRST OF TEXAS'CORPORATION have been paid and satisfied and any balance of the money hereby appropriated then remaining may become and shall be available for further use and appropriation for the purpose for which said monies were originally budgeted into such fund. Section 5 That the Public Works Director (City Engineer) and the City's Fiscal Agent shall immediately begin the preparation of a property owners' roll and of an Engineer's estimate of costs of the street improvements in each unit, and an estimate of the cost of such improvements in each unit on a front foot basis, which said property owners' roll and estimate shall be submitted to the City Council as soon as reasonably possible. Section 6 That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. APPRO. (AP 59-17) , Project No. 94- 134-5 Mrs. McKnight and Gentlemen: The City Council on June 26, 1959, adopted Ordinance No. 4148 approving Specifications and authorizl.ng the receipt of bids for the assessment pav- ing of various residential -stre- ets at-28 locations over the city, and approved Appropriation Requests- totaling_$203,500 to provide fior the City's portion of the cost of the paving and storm drain construction. Gibbins, Inc., and First of Texas Corporation have satisfied the pre- quaiification requirements and it is 'recommended that an Ordinance be adopted awarding the following contracts: Construction of assessment paving on various streets at 28 locations, to R. W. Gibbins, Inc., on their low bid on Bid No. 2 basis of $316,704.05.
