AN ORDINANCE APPROVING THE REPORT OF THE PUBLIC WORKS DEPARTMENT, AWARDING THE CONTRACT OF THE IMPROVEMENTS OF VARIOUS STREETS AT TWENTY (20) LOCATIONS IN THE CITY OF FORT FORTH, TEXAS, AND AUTHORIZED ITS EXECUTION: AND DIRECTING THE CITY ENGINEER TO PREPARE ESTIMATES WHEREAS, by Ordinance Nos. 4258 thru 4277 passed and approved by the City Council of the City of Fort Worth, the City Council determined the necessity for and ordered the improvement of a portion of the following streets, to-wit: UNIT NO. 1, GOODMAN AVENUE: from the west line of Hervie street to the east line of Bourine Street UNIT NO. 2, GOODMAN AVENUE: from the west line of Hervie Street to the west line of Provost Street UNIT NO. 3, LIBBEY AVENUE: from the west line of Prevost Street to the east line of Hervie Street UNIT NO. 4, ELIZABETH LANE: from the east line of Lackland Road to the west line of Tex Boulevard UNIT NO. 5, N.W. 28TH STREET: from the north line of Titus Street to the south line of Sherman Avenue UNIT NO. 6, N.E. LOTH STREET: from the east line of Samuels Avenue to the west line of Railroad UNIT NO. 7, N.W. 25TH STREET: from the south line of Titus Street to the north line of McCandless Street UNIT NO. 8, YOSEMITE COURT: from the south line of Yosemite Court to the north line of Shelton Street UNIT NO. q, McKENZIE STREET: from the south line of Avenue "J" to the north line of Avenue "K" UNIT NO. 10, BRADLEY STREET: from the south line of the T&P R.R. to the north line of Rosedale Street UNIT NO. 11, BONNIE DRIVE: from the south line of Slocum Avenue tQ the north 19.ne of Elgaway 80 UNIT NO. 12, RIPY STREET: from the west line of May Street to the west line of South Main UNIT NO. 13, OWASSO STREET: from the north line of Byers Street to the south line of Lafayette Street UNIT NO. 14, BRYCE AVENUE: from the east line of Dorothy Lane to the west line of Owasso Street UNIT NO. 15, SAPPINGTON PLACE: from the south line of Calmont Street to the north line of Locke Street UNIT NO. 16, LLOYD STREET: from the south line of Avenue "H" to the north line of Avenue "M" UNIT NO. 17, SYDNEY STREET: from the south line of Tarrant Road to the north line of Forbes Street UNIT NO. 18, DEXTER STREET: from the east line of Dorothy Lane to the west line of Montgomery Street UNIT NO. 19, SHELTON STREET: from the east line of Canton Street to the west line of Oak Hill UNIT NO. 20, PECOS STREET: from the east line of Shackleford Street to the west line of Trentman Street WHEREAS, subsequent to the passage and approval of said Ordinance, Plans and Specifications for said improvements were submitted by the Public Works Director and said Plans and Specifications were approved and adopted by the City Council; and, WHEREAS, Notice to Bidders was given as required by the City Charter; and, WHEREAS, the bid of Texas Bitulithic Construction Company was found to be the lowest and best bid for the making and construction of said improvements, to-wit: Excavation of present streets, construction of various types of pave- ment with combined curb and gutter and necessary appurtenances, all as provided by said Plans and Specifications: NOW, THEREFORE, BE IT-ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS-- SECTION I That the work of making and constructing such improvements and contracts therefore is hereby awarded to Texas Bitulithic Construction Company, at and for the prices stated in the proposal of the said Company and as reported and recom- mended by the Public Works Department. The City Manager and City Secretary are hereby directed to execute the said contract in the name of the City of Fort Worth, Texas, and to impress the corporate seal of the City thereon, the said contract embracing therein, among other things, the prices for the work. SECTION II That to provide for the payment'of the indebtedness incurred by the City of fort Worth by said Contract, there is hereby appropriated out of available funds, which have been set aside for said purpose an amount sufficient to pay said indebtedness so incurred. r + s S SECTION III That the Public Works Director of the City of Fort Worth be, and he is hereb;v ordered and directed to file with the City Council estimates of the cost of such improvements in accordance with the terms of the powers and provisions of Chapted 106 of the Acts of the First called session of the Fortieth Legislature of the State of Texas, now shown as Article 1105b of Vernon's Civil Statutes of the State of Texas, Annotated, which law has been adopted as an amendment to and made a part of the Charter of the City of Fort Worth. The specifications provided for alternate types of pavement which are: Residential : (a) g#" Reinforced Concrete Pavement (b) 6" Hot Mix Asphaltic Concrete Pavement (c) l#" Hot-Mix Asphaltic Concrete Surface Course, 5" Reinforced Concrete Base (d) IP Hot-Mix Asphaltic Concrete Surface Course, 7" Cement Stabilized Gravel Base (e) 31" Hot-Mix Asphaltic Concrete Surface Course, 8" Crusher Run Crushed Limestone Base Course. The specifications called for bids on two basis: Bid No. ( 1) was to be on the assessment basis with the contractor performing the assessment pro- cedure as well as the outlined construction, and Bid No. (2) was tote on the cash bsis with a fiscal agent performing the assessment work, preparing rolls and accepting assessment certificates. Two bids were submitted on the basis of the contractor handling the assess- ment procedure (Bid No. 1) , with the combination of alternates as follows: CONTRACTOR LOW BID TYPE I . Surface $300,641 .51 Res: 1111 Surface, 2" Binder, 8" Limestone The First of Texas Corporation of San Antonio, Texas, submitted the only bid for furnishing the Fiscal Agent's services, as follows: City's Share of Cost Fiscal Agent's Fee 40% or more 13.0 of Contract 30% 16.250 of Contract 20% 19.500 of Contract It is estimated that the City's share of the cost will be 40 per cent or more of the contract cost. It is recommended that the City Council adapt an Ordinance awstding the con- tract to Texas Bitulithic Company, and it is also recommended that the report of the Director of Finance, stating that there are sufficient funds available for this project, be adopted.
