AN ORDINANCE AMENDING ARTICLE III OF CHAPTER 33 OF THE FORT
WORTH CITY CODE OF 1950, REQUIRING TAXIMETERS IN ALL TAXI-
CABS OPERATED ON THE STREETS OF THE CITY OF FORT WORTH; PRO-
VIDING SEALING AND INSPECTION REQUIREMENTS FOR TAXIMETERS;
ADOPTING THE STANDARDS FOR TOLERANCES AND ACCURACY CONTAINED
IN THE APPLICABLE STATUTES AND REGULATIONS OF TEE STATE OF
TEXAS; PROVIDING PENALTIES; DECLARING THE ENFORCEMENT OF THIS
ARTICLE TO BE A GOVERNMENTAL FUNCTION; PROVIDING A SAVINGS
CLAUSE MAKING THIS ORDINANCE CUMULATIVE OF ALL OTHER ORDINANCES
REGULATING TAXIMETERS AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:

SECTION I.
That Section 32 of Article III of Chapter 33 of the Fort Worth City
Code of 1950 is hereby amended and after having been so amended shall here-
after read as follows:
Sec. 32. Required; Duty of Owner to Keep Accurate.
It shall be unlawful for any owner, operator, or
driver of any taxicab to operate or cause to be operated,
or cause to be driven any taxicab on the streets of the
City unless the same is equipped with a taximeter approved
by the Inspector of Weights and Measures of the City of
Fort Worth or his duly authorized representative. It shall
be the duty of every owner using any taximeter to keep the
same accurate at all times, and the failure so to do shall
constitute a violation of this chapter.
SECTION II.
That Section 35 of Article III of Chapter 33 of the Fort Worth City
Code of 1950 is hereby amended and after having been so amended shall here-
after read as follows:
Sec. 35. Inspection; Responsibility of Owner;
Records of Tests to be Kept.
All taximeters shall be subject to inspection and test
at any time by the Inspector of Weights and Measures of the
City or his duly authorized representative. It shall be a
violation of this Chapter for any person to delay, interfere
with or refuse to permit such inspection. Any taximeter found
not to conform to the standards and tolerances provided for in
this chapter shall not be approved by the Inspector of Weights
and Measures and shall be ordered out of service. Taxicab
owners shall make or cause to be made, at least once every six
months, inspections and tests of the taximeters to insure their
compliance with this chapter. A record of each test of a taxi-
meter shall be kept by the owner and shall be available for in-
spection by the Inspector of Weights and Measures of the City,
or his duly authorized representative, at any time. Each
taxicab owner shall furnish to the Inspector of Weights
and Measures of the City on Monday of each week a complete
list of all taximeters under his ownership or operation
which have been sealed or resealed during the preceding week,
including in such list the identifying number or symbols
of each such taximeter and the vehicle in which it is in-
stalled.
SECTION III.
That Section 36 of Article III of Chapter 33 of the Fort Worth City
Code of 1950 is hereby amended and after having been so amended shall here-
after read as follows:
Sec. 36. Standards.
The standards for tolerances and accuracy and all other
standards to be applied to taximeters shall be the same as
the standards applied thereto by the State of Texas under
its applicable statutes or regulations, all of which are
hereby adopted and declared to be the only legal standards
of tolerances or accuracy to be applied to the taximeters
within the corporate limits of the City of Fort Worth.
SECTION IV.
That Section 37 of Article III of Chapter 33 of the Fort Worth City
Code of 1950 is hereby repealed.
SECTION V.
Any person Who violates, refuses to comply with or resists the enforcement
of any of the provisions of this ordinance or of Chapter 33 of the Fort Worth
City Code of 1950 shall be fined not to exceed Two Hundred and no/100 Dollars
($200.00) for each such offense. Each day that a violation is permitted to
exist shall constitute a separate offense.
SECTION VI.
All of the regulations and provisions in this ordinance and in Chapter
33 of the Fort Worth City Code of 1950 are hereby declared to be governmental
and for the health, safety and welfare of the general public. Any member of
the City Council, any City official or employee charged with the enforcement
of this ordinance or of said Chapter, acting for the City of Fort Worth in the
discharge of his duties, shall not thereby render himself personally liable,
and he is hereby relieved from all personal liability from any damage that
might accrue to persons or property as a result of any act or omission required
or permitted in the discharge of his duties.
SECTION VII.
If any provision, section, subsection, sentence, clause or phrase of
this ordinance or the application of same to any person or set of circum-
stances is for any reason held to be unconstitutional, void or invalid, or
for any reason unenforceable, the validity of the remaining portions of this
ordinance or their application to other persons or sets of circumstances shall
not be affected thereby, it being the intent of the City Council of the City
of Fort Worth in adopting this ordinance that no portion hereof or provision
or regulation contained herein shall become inoperative or fail by reason of
any unconstitutionality or invalidity of any other portion, provision or re-
gulation and to this end all provisions of this ordinance are declared to be
severable.
SECTION VIII.
This ordinance shall be cumulative of all other ordinances of the City
of Fort Worth regulating taximeters except such ordinances as are expressly
repealed hereby, and except in those instances where such ordinances as are
not expressly repealed are in conflict herewith, in which instances the terms
of this ordinance shall prevail.
SECTION IX.
This ordinance shall take effect and be in full force and effect from
and after the date of its passage and publication as provided by law.

Members of the City Council Re: Amendment to Taxicab
City of Fort Worth Ordinance
Mrs. McKnight and Gentlemen:
On July 2, 1962, when considering M&C G-256 which described a proposed
ordinance pertaining to taxicabs, the City Council directed that the pro-
posed ordinance be changed so as (1) to allow the taxicab operators to
seal the measuring mechanisms of measuring devices and (2) to stipulate
that such sealings shall be' reported regularly to the Inspector of Weights
and Measures.
The attached ordinance complies with the two directives by providing that
the measuring mechanisms may be sealed by the taxicab operators and that
such sealings shall be reported to the Inspector of Weights and Measures
on a weekly basis, each Monday. Council action on the proposed ordinance
is requested.
