APPAOM AS TO FORM AND LEGALITY: ty Atterany City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE SUBJECT: Ordinance Granting Encroachment PAGE 5/31/65 NUMBER 6 on a Portion of West Berry Street 1 of � In order to clear title necessary for sale of the property, the owner of Lot 28 and the south one-half of Lot 29, Block 32, Ryan Place Addition, has requested that the City enact an ordinance permitting the encroachment of a building at that location onto the West Berry Street right-of-way. The property owner has provided a survey which shows that there is an encroach- ment of 3 feet by 22.2 feet by an existing one-story stone house. The Public Works Department has investigated the request and has determined that the location of the "bncroachment is behind the retaining wall at the Santa Fe Railroad underpass on West Berry near 6th Avenue. Long range plans for the improvement of West Berry do not include widening the underpass and therefore would not be affected by granting the encroachment for the life of the existing building. It is recommended that an ordinance be adopted granting a 3 feet by 22.2 feet encroachment for an existing building on Lot 28 and the south one-half of Lot 29, Block 32, Ryan Place Addition, for the remaining life of the building, subject to revocation at any time the City Council determines that the en- croached land is needed for public purposes .
