HomeMy WebLinkAboutOrdinance 5452 ORDINANCE NO. S'Y�2- AN ORDINANCE PROVIDING THAT PORTIONS OF GALVESTON STREET AND MADDOX AVENUE AND THE NORTH-SOUTH ALLEYS LYING BETWEEN ST. LOUIS AVENUE AND GALVESTON STREET AND BETWEEN GALVESTON STREET AND SOUTH MAIN STREET BE ABANDONED, VACATED AND CLOSED; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the portion of Galveston Street from the north right of way line of West Allen Avenue north to the south right of way line of Maddox Avenue be and the same is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character whatever. That the portion of Maddox Avenue from a point seven feet west from the west right of way line of South Main Street west to the east right of way line of St. Louis Avenue be and the same is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character whatever. That the north-south alleys lying between St. Louis Ave- nue and Galveston Street and Galveston Street and South Main Street from the north right of way line of West Allen Avenue north to the south right of way line of Maddox Avenue be and the same are hereby vacated, closed and permanently abandoned as alleys or public thoroughfares of any kind or character what- ever. SECTION 2. That the interest of the City of Fort worth in the fee to the land in said portions of streets and alleys is hereby re- leased and shall revert to the adjacent owner of the fee as provided by law, save and except that temporary easements are reserved for any and all existing utilities, the private utility companies and the Water Department of the City of Fort Worth being given the right to construct, operate and maintain the existing facilities in their present location until such time as they are no longer needed. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. APPROVED AS TO FORM AND LEGALITY: City Attorney City of .Fort Worth, Texas Mayor and Council Communication DATE REFERENCE SUBJECT: Proposed Closing - Portions of PAGE NUMBER Maddox Avenue, Galveston Street and 10/11/65 PZ-153 Interior Alleys Tarrant County Hospital District, owner of all adjoining property, has requested the closing of portions of the following streets in order to provide off-street parking and reduce traffic congestion in the vicinity of John Peter Smith Hospital. 1) Galveston Street from the north right-of-way line of West Allen Avenue, north, to the south rtght-of-way line of Maddox Avenue; 2) Maddox Avenue from a point seven feet west from the west right-of-way line of Main Street, west, to the east right-of-way line St. Louis Street; and, 3) The north-south alleys lying between St. Louis and Galveston and between Galveston and Main from the north right-of-way line of West Allen north to the south right-of-way line of Maddox Avenue. A map showing the proposed street and alley closing is attached to this communication. Private utilities and the Water Department have reviewed the request and do not object to the abandonments provided temporary easements are reserved for existing facilities until relocated at hospital expense. The Public Works and Traffic Engineering Departments have requested that additional right-of-way be provided for widening South Main Street and West Allen Avenue bordering the hospital property, and that an easement be provided to facilitate drainage at the intersection of Galveston Street and West Allen Avenue. The hospital has agreed to provide additional right-of,way and the drainage easement dedication and also will widen Main and Allen by five feet adjacent to the parking facilities in connection with the building permit. The City Plan Commission has reviewed the request and recommended adoption of the ordinance which has been prepared abandoning the streets and alleys as requested, but reserving temporary easements and subject to final replotting of the property providing additional right-of-way and the drainage easement. A replat of the property acceptable to the City has been submitted and will be filed for record upon adoption of ordinance abandoning the streets and alleys.
