HomeMy WebLinkAboutOrdinance 7336TEXAS: ORDINANCE NO. lj-�Z AN ORDINANCE VACATING, ABANDONING AND CLOSING THAT PORTION OF THE EASEMENT AND STREET IN THE NORTH 45' OF THE NORTH SERVICE ROAD OF HIGHWAY 80 WEST IN THE 8200 BLOCK A LENGTH OF 165' AD- JACENT TO LOT C -R, BLOCK 1, EASTWARD FROM PHOE- NIX DRIVE AND THE 20' x 20' OPEN SPACE EASEMENT LOCATED IN THE SOUTHWEST CORNER OF LOT C -R, BLOCK 1, WESTERN HILLS ADDITION, SECTION 1, RETAINING EASEMENTS THEREIN FOR UTILITIES IN- CLUDING EXISTING SEWER, WATER, GAS AND TELE- PHONE FACILITIES: PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, SECTION 1. That the portion of the easement and street in the North 45' of the North Service Road of Highway 80 West in the 8200 Block a length of 165' adjacent to Lot C -R, Block 1, eastward from Phoenix Drive and the 20' x 20' open space easement located in the southwest corner of Lot C -R, Block 1, Western Hills Addition, Section 1, be and the same is hereby vacated, closed and permanent- ly abandoned as an easement and street, SAVE and EXCEPT that in said vacated right -of -way be and the same is hereby retained a utility easement for any and all existing utilities, including sewer, water, gas and telephone facilities located therein. SECTION 2. That the fee to the land in the above described vacated easement and street is hereby released and will revert to the adjacent owners as provided by law, save and except that ease- ments are reserved for any and all existing and prospective utilities as indicated. SECTION 3. All ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained. APPROVED AS TO FORM AND LEGALITY S. G. Subject right -of -way, acquired by dedication, is open, paved and contains storm drain, sanitary sewer, water, gas and telephone facilities. The agencies responsible for these public facilities requests sufficient right -of -way be retained for access to and maintenance of these facilities and the dedi- cation of a new easement. Reviewing City departments and private utility companies have no objections to this request provided: 1) The entire right -of -way to be vacated is retained as a utility easement; 2) Both ends of the vacated right -of -way are physically closed with standard curb and gutter or provided with a driveway approach; 3) The vacated right- of- way,,is re ] ted with abutting properties. 4) The dedication of a new easement. The City Plan Commission has reviewed this request and recomm that an ordinance be adopted vacating subject right -of -way and easement as requested. A satisfactory replat has been submitted to City Staff. Recommendation It is commend d that an ordinance be adopted vacating subject right -of -way and easement recommended by the City Plan Commission.
