AN ORDINANCE AMENDING THE CODE OF THE CITY OF
FORT WORTH (1964), AS AMENDED, BY ADDING A NEW
CHAPTER THERETO DESIGNATED AS CHAPTER 42, DE-
PARTMENT OF PUBLIC WORKS, PROVIDING FOR THE
ESTABLISHMENT AND REGULATION OF A DEPARTMENT
OF PUBLIC WORKS, PROVIDING FOR A DIRECTOR THERE-
OF TO BE APPOINTED BY THE CITY MANAGER AND FIX-
ING THE FUNCTIONS AND DUTIES OF SAID DEPARTMENT
AND ITS DIRECTOR; AND NAMING AN EFFECTIVE DATE.
WHEREAS, on April 8, 1975, a majority of the elec-
torate of the City of Fort Worth voting in a Charter
Amendment election found and determined that Sections
1 through 5, inclusive, of Chapter XIII, Department of
Engineering, of the Charter of the City of Fort Worth
should be amended so that said chapter shall hereafter
read and be as follows:
"CHAPTER XIII.
DEPARTMENT OF PUBLIC WORKS.
"The City Council shall provide by ordi-
nance for the establishment and regulation
of a Department of Public Works, which de-
partment shall be in lieu of the 'Depart -
ment of Engineering' formerly provided for
in Chapter XIII of the Charter of the City
of Fort Worth. ";
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That the Code of the City of Fort Worth (1964), as
amended, be and the same is hereby amended by adding
thereto a new chapter designated as Chapter 42, Depart-
ment of Public Works, which chapter shall read and be as
follows:
"CHAPTER 42.
DEPARTMENT OF PUBLIC WORKS
"Sec. 42-1. Department Established and
Organized. A Department of Public Works is
hereby established, which department shall be
under the supervision of the Director of Pub-
lic Works, who shall be subject to appoint-
ment and removal by the City Manager. The
salary of the Director of Public Works shall
be in accordance with the compensation plan
of the City.
"Sec. 42-2. Qualifications and Duties '
of the Director of Department of Public Works.
The Director of the Department of Public Works,
also known as the "City Engineer," shall be a
Professional Engineer registered and licensed
to practice his profession in the State of
Texas.
"He shall be the custodian of and responsi-
ble for maintaining all maps, plans, profiles,
field notes, grid coordinates, and other records
and memoranda belonging to the City pertaining
to his office and the work thereof, all of
which he shall keep in proper order and condi-
tion, with full indexes thereof. All maps,
plans, profiles, field notes, grid coordinates,
estimates and other memoranda of professional
work made or done by him, or under his direction
and control, shall be the property of the City.
"Sec. 42-3. Further Powers and Duties of
Director of Public Works. The Director of Pub-
lic works shall have charge of the opening,
construction, paving, maintenance, reconstruc-
tion and repair of all streets, boulevards,
alleys, sidewalks, thoroughfares and public
ways other than water and sanitary sewer facil-
ities. He shall have charge of the planning,
design, construction, maintenance and repair of
all public buildings and facilities belonging
to or used by all departments of the City; of
the design, construction, installation, mainte-
nance and repair of all communication systems
and facilities owned or operated by the City,
and the enforcement of all rules and regulations
pertaining thereto; and of the inspection of
all buildings, both public and private, and the
issuance or revocation of permits in connection
with the enforcement of the Electrical, Plumbing,
Building, Mechanical and other applicable Codes
of the City. He shall also be responsible for
the enforcement of the zoning ordinances of the
City and in connection therewith shall appoint
the Building official.
"The Director of Public works shall also
be responsible for the proper and efficient
disposal of solid waste and shall perform
such other duties relating to his department
as may be required of him by the City Manager
or by City ordinance.
"Sec. 42-4. Appointment of Employees.
The Director of Pudic works shall have the
power to appoint, eraploy and remove such of-
ficers, assistants, employees and personnel
as he may deem necessary for the efficient ad-
ministration of the affairs of the Department
of Public works, an(d to prescribe and fix their
duties, scope of authority and qualifications."
SECTION 2.
That this ordinance shall be in full force and effect
from and after the date of its passage, and it is so or-
dained.

Ordinance for the Department

On April 8, 1975, a majority of the electorate of.the City of Fort
Worth voted in a Charter Amendment Election to amend Sections 1•
through 5, inclusive, of Chapter XIII, Department of Engineering,
of the ,City Charter.
Such amendment called for the Department of Public Works to be.
regulated by ordinance. Attached is an ordinance prepared by the
City Attorney.
Recommendation
It is recommended that the City Council approve the ordinance as
prepared by the City Attorney.
