HomeMy WebLinkAboutOrdinance 5881 ORDINANCE NO. _S.�RE AN ORDINANCE CLOSING AND VACATING THE TWENTY FOOT UTILITY EASEMENT ACROSS BLOCK 8, SHADY OAKS MANOR ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXASf AND PROVIDING FOR THE REVERSION OF THE IN- TEREST OF THE CITY OF FORT WORTH IN SAID LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the twenty foot utility easement across Block 8, Shady Oaks Manor Addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Vol. 388-43, page 20, of the Tarrant County Plat Records, be and the same is hereby ex- tinguished, vacated, closed and permanently abandoned as an easement for public utilities. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said easement above described is hereby re- leased and shall revert to the adjacent owners of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. J. Development Corporation, owner of all adjoining property, has requested the vacation of a 20 foot utility easement R across Block 8, Shady Oaks Manor Addition as recorded. in Volume 388-43, page 20 of Tarrant County plat records and shown on the attached map. Final engineering studies indicate that the sewer lift station and outfall line should be relocated, thereby eliminating the need for the easement in its present location. A replat has been filed which dedi- cates the easement in the correct location as required by the utility companies and the City. Private utility companies and City departments have reviewed the request and do not object to the proposed vacation. The City Plan Commission has reviewed the request and recommends adoption of an ordinance that has been prepared vacating the easement as requested.
