HomeMy WebLinkAboutOrdinance 5882 ORDINANCE NO, AN ORDINANCE PERMITTING THE BRANTLEY-DRAUGHON BUSI- NESS COLLEGE, INC. , ITS SUCCESSORS AND ASSIGNS, TO LEAVE THE EXISTING WEST WALL AND FOUNDATION OF ITS BUILDING FOR A MAXIMUM DISTANCE OF ,2 FOOT AS SAME ARE NOW LOCATED IN HENDERSON STREET; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY, WHEREAS, the Brantley-Draughon Business College, Inc. , is the owner of an existing building on Lot Nos, 1, 2, 3, 4 and 5, Block No. 11, Texas and Pacific Railway Company Addition to the City of Fort Worth, Tarrant County, Texas, and, WHEREAS, the west wall of said building and foundation encroaches on Henderson Street a distance of .2 foot, on Lots 1, 2 and 3, of said Block 11, Texas and Pacific Rail- way Company Addition to the City of Fort Worth, Tarrant County, Texas; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1, That Brantley-Draughon Business College, Inc, , the owner of said land above described and the improvements situated thereon, and its successors and assigns, be permitted to leave the existing building and. foundation for a maximum distance of ,2 foot as said building and foundation now exist and are located in Henderson Street across its easterly line; and that said improvements now existing be allowed to stand during the life of said build- ing as the same are now constructed providing, however, that in the event such building and foundation be demolished or major alterations or repairs be made to said building and foundation in the future, said building and foundation shall be reconstructed. or repaired so as not to encroach upon Henderson Street and so as to be in compliance with the existing regulations, ordinances and rules of the City of Fort Worth, Texas, SECTION 2. Dorris Estate, has requested--the City to rn adopt an ordinance permitting the continuation of an encroachment into Henderson Street right-of-way. The encroaching structure is the old Dr. Pepper Bottling Company building, located on Lots 1, 2 and 3, Block 11, Texas and Pacific Railway Company's Addition. This building extends into the right-of-way of Henderson Street, .2 of a foot. Attached is a map indicating in red the wilding encroachment into the right-of-way of Henderson Street. City departments and private utility companies have reviewed the request and have no objections to the continuation of the encroachment. An administrative committee which reviews right-of-way encroachment requests; consisting of the Planning Director, the Public Works Director, the Building Official, and the City Attorney with the Traffic Engineering Director serving as an ex-officio member, has reviewed the request and has no objection to the adoption of an ordinance that has been prepared permitting continuation of the encroachment for as long as the structure is in place, provided future repairs or alterations comply with the existing regulations of the City of Fort Worth. City Council action on the proposed ordinance permitting the encroachment is requested.
