HomeMy WebLinkAboutOrdinance 6182 ORDINANCE NO_ AN ORDINANCE MAKING CERTAIN FINDINGS; FIXING AND ESTABLISHING CORPORATE BOUNDARIES OF THE CITY OF FORT WORTH; DISCONTINUING TERRITORY FROM WITHIN THE CITY OF FORT WORTH; RELINQUISHING TERRITORY FROM THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF FORT WORTH; CONSENTING TO THE ANNEXATION OF CERTAIN TERRITORY BY THE CITY OF SAGINAW, PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES AFFECTING BOUNDARIES; PRG,VIDING FOR SEVERABILITY AND NAMING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth and the City of Saginaw have executed a Joint Resolution fixing and establishing a common boundary line by mutual consent between the two cities and apportioning extraterritorial jurisdiction; and WHEREAS, such Joint Resolution is of record in Volume 4764, at pages 907 through 913 of the Deed Records of Tarrant County, Texas; and WHEREAS, the City of Fort Worth agreed to proceed with all ordi- nances necessary to effectuate the terms of such Joint Resolution; and WHEREAS, there are areas within the territory apportioned to Saginaw by Fort Worth which were annexed by Fort Worth on July 15, 1963. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That the corporate boundary line of the City of Fort Worth be, and the same is, hereby fixed and established; in relation to the City of Saginaw and its extraterritorial jurisdiction; as same is described in that certain Joint Resolution of the City of Fort Worth and the City of Saginaw adopted by the City of Fort Worth on July 21, 1969, adopted by the City of Saginaw on July 22, 1969 and recorded on August 8, 1969 in Volume 4764, at pages 907 through 913 of the Deed Records of Tarrant County, Texas, which corporate boundary line is described as follows: "BEGINNING at a point in the existing corporate limit line of the City of Saginaw, Texas, said point being the point of in:ersection of the Southerly right-of-way line of County Road No. 4001 (also known as East Industrial Avenue of the City of Saginaw) and the Easterly right- of-way line of U. S. Highway Nos. 81 and 287; THENCE Westerly in a straight line to the point of intersection of the Westerly right-of-way line of U. S. Highway Nos. 81 and 287 and the Southerly right-of-way line of County Road No. 4001; THENCE Westerly with the Southerly right-of-way line of County Road No. 4001 extended to its intersection with the Westerly right-of-way line of County Road No. 4107 (also known as the Old Decatur Road); THENCE Northerly with the Westerly right-of-way line of County Road No. 4107 to a point in said Westerly right-of-way line which is due West of the North- west corner of a 100-acre tract of land as described in a deed from K. M. VaNZandt and wife, Octavia VanZandt, to E. P. VanZandt, dated August 14, 1926,and re- corded in Vol. 926, at Page 472, of the Deed Records of Tarrant County, Texas. THENCE East to the Northwest corner of said E. P. VanZandt tract as de- scribed in said deed, and continuing East along the North boundary line of said E,P, VanZandt 100-acre tract to its Northeast corner as described in said deed recorded in Vol. 926,at Page 472, of the Deed Records of Tarrant County, Texas; THENCE East in a straight line, crossing U. S. Highway Nos. 81 and 287 and the Fort Worth and Denver Railroad Company right-of-way, and cantindinq East in a straight line to the Easterly right-of-way line of State Farm-to-Market Highway No. 156; THENCE Southerly with the Easterly right-of-way line of State Farm-to- Market Highway No. 156 to the Northeast corner of the presently existing cor- porate limit line of the City of Saginaw,Texas, in said Easterly right-of-way line of State Farm-to-Market Highway No. 156 and the Northerly right-of-way line of County Road No. 4020, as described in Saginaw Ordinance No. 116, recorded in Vol. 3668, at Page 314, of the Deed Records of Tarrant County, Texas; THENCE continuing along and with the corporate city limit line of the City of Saginaw, as said city limit line existed on the 3rd day of February 1969, to the place of beginning." SECTION 2 THAT all extraterritorial jurisdictional rights which the City of Fort Worth may have in all territory embraced within the area circumscribed by the hereinabove described mutual common boundary line are hereby expressly re- linquished to the City of Saginaw. -2- SECTION 3 THAT the City of Fort Worth hereby expressly consents to the annexa- tion of the area circumscribed by the hereinabove described mutual common boundary line by the City of Saginaw. SECTION 4 THAT the above referenced and described mutual common boundary line and the area circumscribed is shown on EXHIBIT "A", a map attached hereto and expressly incorporated herein by reference for the purpose of illustrating and depicting the mutual common boundary line and the circumscribed area. SECTION 5 THAT this ordinance shall and does amend every prior ordinance in direct conflict herewith and more especially this ordinance amends City of Fort Worth Ordinance Numbers 4048 and 4295, adopted on second and final reading on July 15, 1963, but as to all other ordinances or sections of ordinances not in direct conflict herewith, this ordinance shall be and the same is hereby made cumulative. SECTION 6 THAT if any section, subsection or provision of this ordinance shall be held invalid or unconstitutional by a court of competent jurisdiction, the same shall not affect any other part of this ordinance, which shall remain in full force and effect. SECTION 7 THAT this ordinance shall become effective and shall be in full force and effect from and after its passage and it is so ordained. Discontinuance Ordinance Under the terms of the Joint Resolution Fort Worth agreed to adopt the neces- sary ordinances to discontinue its territory within the area apportioned to Saginaw. The Fort Worth territory concerned consists of corridors which were established on July 15, 1963. An ordinance has been prepared providing for the discontinuance in accordance with the terms of the agreement. The attached map shows the agreed common boundary line and the corridors which would be discontinued by the ordinance. Approximately seventy (70) acres of land will be discontinued from Fort Worth. Recommendation It is recommended that the City Council adopt the ordinance discontinuing approximately seventy (70) acres of Fort Worth area from within the territory apportioned to Saginaw.
