AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE NO. 3011, AS
AMENDED; SAME BEING AN ORDINANCE REGULATING AND RESTRICTING THE LOCATION
AND USE OF BUILDINGS, STRUCTURES AND LAND FOR TRADE, INDUSTRY, RESIDENCE,
AND OTHER PURPOSES; BY AMENDING SECTION 8, °E-R° RESTRICTED COMMERCIAL
DISTRICT, AND SECTION 19, CFF-STREET PARKING AND LOADING REGULATIONS;
PROVIDING FOR INTERPRETATION, PURPOSE, AND CONFLICT; PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES AFFECTING ZONING; PROVIDING
A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR
VIOLATION THEREOF; AND NAMING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH:
SECTION ONE
THAT SECTION 8, 11E-R11 RESTRICTED COMMERCIAL DISTRICT, of the Comprehensive
Zoning Ordinance No. 3011, as amended, be and the same is hereby amended,
changed, and modified by amending Paragraph A. "Use Regulations", sub-
paragraph 2, so that it shall hereafter read as follows:
2. Auto parking areas, when in full and complete compliance
with the following conditions:
a) Limited to passenger automobiles only;
b) The restrictions for Auxiliary Parking (Sec. 19. A. 12)
shall apply;
c) A curb or bumper shall be placed along the perimeter
of the parking area at locations which will prevent
vehicles from extending into the required front yard,
into an abutting alley, beyond the property line, or
from damaging the walls or shrubs screening it from
residential property;
d) The required front yard shall not be gravelled or hard-
surfaced but shall be maintained as open or landscaped
green space; and
e) A sidewalk shall be constructed to city specifications
abutting the front line of the parking lot and between
the lot and the property line of the nearest intersecting
commercial street.
SECTION TWO
THAT SECTION 19, OFF-STREET PARKING AND LOADING REGULATIONS, of. the
Comprehensive Zoning Ordinance No. 30 1, as amended, be and the same is
hereby amended, changed, and modified by amending Paragraph A. "General
Requirements", 'subparagraph 12. ItAuxiliary Parking'f, Item (3), so that
it shall hereafter read as follows:
(3) A minimum five foot (51) high screen type fence or
planting must be provided on all sides for the protection
of the adjacent properties zoned for residential use.
SECTION THREE
THAT the zoning regulations and districts, as herein established, have
been made in accordance with the comprehensive plan for the purpose of
promoting health, safety, morals and the general welfare of the community.
They have been designed to lessen congestion in the streets; to secure
safety from fire, panic, flood and other dangers; to provide adequate
light and air; to prevent over-crowding of land; to avoid undue
concentrations of population; to facilitate the adequate provisions of trans-
portation, water, sewerage, parks and other public requirements. They have

been made after a full and complete public hearing with reasonable
consideration, among other things, of the character of the district and
its peculiar suitability for the particular uses and with a view of
conserving the value of buildings and encouraging the most appropriate
use of land throughout the community.
SECTION FOUR
THAT this ordinance shall be cumulative of all other ordinances of the
City of Fort Worth effecting zoning and shall not repeal any of the
provisions of said ordinances except in those instances where provisions
of those ordinances are in direct conflict with the provisions of this
ordinance.
SECTION FIVE
THAT all rights or remedies of the City of Fort Worth, Texas, are
expressly saved as to any and all violations of Ordinance No. 3011 or of
any amendments thereto, of said City of Fort Worth, Texas, that have
accrued at the time of the effective date of this ordinance; and as to
such accrued violations, the court shall have all the pavers that
existed prior to the effective date of this ordinance; and that all
existing violations of Ordinance No. 3011, as amended, which would
otherwise become non-conforming uses under this ordinance, shall not
become legal non-conforming uses under this ordinance but shall be
considered as siolations of this ordinance in the same manner that they
were violations of Ordinance No. 3011, as amended, of said city.
SECTION SIX
THAT it is hereby declared to be the intention of the City Council that
the sections, paragraphs, sentences, clauses and phrases of this
ordinance are severable, and if any phrase, clause, sentence, paragraph
or section of this ordinance shall be declared void, ineffective, or
unconstitutional by the valid judgment or final decree of a court of
competent jurisdiction, such voidness, ineffectiveness, or unconstitu-
tionally shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections hereof, since the same would have been enacted by
the City Council without the incorporation herein of any such void,
ineffective or unconstitutional phrase, clause, sentence, paragraph or
section.
SECTION SEVEN
THAT any person, firm or corporation who violates, disobeys, omits,
neglects, or refuses to comply with or who resists the enforcement of
any of the provisions of this ordinance shall be fined not less than
Five and No/100 Dollars ($5.00) nor more than Two Hundred and No/100
Dollars ($200.00) for each offense. Each day that a violation is
permitted to exist shall constitute a separate offense.
SECTION EIGHT
THAT this ordinance will take effect and be in full force and effect from
and after its passage and publication as required by law.
