AN ORDINANCE MAKING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 2.80 SQUARE MILES, MORE OR LESS, OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA SHARE OF TAXES; PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL OF THE PRIVILEGES OF ALL THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was, held at the City Council Chamber in the City Hall of Fort Worth, Texas, on the 26th day of October, 1971, which date is not more than twenty (20) nor less than ten CIO) days prior to the institution of annexation pro- ceedings; and WHEREAS, notice of such public hearing was published in a news- paper having general circulation in the City of Fort Worth, Texas, and in the hereinafter described territory on the 13th day of October, 1971 , which date is, not more than twenty (20) nor less than ten (10) days prior to the date of such public hearing; and WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 390,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas was 212.5 square miles on January 1, 1971 ; and WHEREAS, the hereinafter described territory lies within the extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the territory hereinafter described contains approximately 2.80 square miles; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I. That the following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas,and said territory hereinafter described shall hereafter be included within the boundary limits of the City of/Fort Worth, Texas; and the boundary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to wit: FIRST TRACT Being portions of the W. C. Trimble Survey, Abstract No. 1521 and the William Morris Survey, Abstract No. 1166, situated about seven (7) miles northeasterly from the Courthouse of Tarrant County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at a point for corner in the present Fort Worth city limit line, said point for corner being 500 feet west from the center line of Interstate Highway I-820; said point for corner also being the southeast corner of the FIRST TRACT described in Ordinance No. 5603 adopted on August 8, 1966; which point for corner stands 2,240 feet east and 425 feet south from the northwest corner of the W. C. Trimble Survey, Abstract No. 1521. THENCE south, along and with the present Fort Worth city limit line which is 500 feet west from the center line of Interstate Highway I-820 a distance of 2,600 feet to a point for corner which is the most easterly northeast corner of a tract annexed for limited purposes by Ordinance No. 5080, adopted on December 16, 1963. THENCE along and with the lines of the tract annexed by Ordinance No. 5080-west 2,180 feet to a point for corner in the west line of the W. C. Trimble Survey, Abstract No. 1521 ; same being the east line of the H. F. Largent Survey, Abstract No. 960; and north 400 feet; and west 330 feet to a point for corner in the present Fort Worth city limit line established by Ordinance No. 6194 on • 11 1—n —A „+ -r- nrnar hPi nn in the THENCE north along and with the Fort Worth. ci,ty limit line established by Ordinance No. 6194 and along and with the east line of the Texas Electric Service Company right-of-way 2,575 feet to a point for corner in the present Fort Worth city limit line which is 10 feet south from and parallel to the south right-of-way line of Midway Road. THENCE east along and with the present Fort Worth city limit line 10 feet south from and parallel to the south right-of-way line of Midway Road 370 feet to a point for corner, the westerly northwest corner of the FIRST TRACT annexed by Ordinance No. 56Q3; THENCE south along and with the present Fort Worth city li.mi,t line, the westerly line of the tract annexed by Ordinance No. 5603 a distance of 390 feet to a point for corner. THENCE east along and with the present Fort Worth. city limit line and the south line of the tract annexed by Ordinance No. 5603 to the place of beginning and containing approximately 0.23 square miles of land. SECOND TRACT BEING portions of the A. S. Trimble Survey, Abstract No. 1528, John W. Sansom Survey, Abstract No. 1387, J. B. Johnson Survey, Abstract No. 855, W. C. Trammell Survey, Abstract No. 1509 and John A. Hust Survey, Abstract No. 702, situated about 10 miles northeasterly from the Courthouse of Tarrant County, Texas and being more particularly described as follows: BEGINNING at a point for corner in the present Fort Worth city limit line, in the west right-of-way line of Randol Mill- Hurst-.Precinct Line Road 3035; same being the east line of the tract annexed by Ordinance No. 3573 on March. 18, 1963, same being the most easterly northeast corner of the tract annexed for limited purposes by Ordinance No. 5081 on December 16, 1963. THENCE along and with the lines of the tract annexed for limited purposes by Ordinance No. 5Q81. West along and with a line parallel to and 700 feet south from the north line of the John A. Hust Survey,Abstract No. 702 to a point for corner 2,000 feet east from the west line of the John A. Hust Survey, and North along and with a line parallel to and 2,000 feet east from the west line of the John A. Hust Survey 700 feet to a point for corner in the north line of the John A. Rust Survey, and West along and with the north line of the John A. Hust Survey 2,000 feet to its northwest corner in the east line of the William H. Morris Survey, Abstract No. 1053, and North along and with. the east line of the William H. Morris Survey to its northeast corner, the southeast cor- ner of the John W. Sansom Survey, Abstract No. 1387, and West along and with the north line of William H. Morris Survey to a point for corner 4,000 feet east from the west line of the John W. Sansom Survey, and North along and with a line of 4,000 feet east from the west line of the John W. Sansom Survey to a point for corner 1 ,300 feet south. from the north- line of the John W. Sansom Survey, and West along and with a line 1 ,300 feet south from and paral- lel to the north- line of the John W. Sansom Survey 2,200 feet to a point for corner 1 ,800 feet east from the west line of the John W. Sansom Survey, and North along and with a line 1 ,800 feet east from and paral- lel to the west line of the John W. Sansom Survey 1 ,300 feet to a point for corner in the north line of the John W. Sansom Survey, and continuing north to a point for corner in the pre- sent Fort Worth city limit line established by Ordinance No. 3573, as amended by Ordinance No. 4865. THENCE easterly along and with the present Fort Worth city limit line to a point for corner in the west right-of-way line of Souder-hturst Road (County Road No. 3035). THENCE along and with- the present Fort Worth city limit line; South along and with the west right-of-way line of Souder, Hurst Road (County Road No. 30351 to a point for corner in the north right-of-way of Trammel,Dayis Road (County Road No. 3112); and West along and with the north right-of-way line of Trammel- Davis Road (County Road No. 3112) to a point for corner in the west right-of-way line of Randol Mill,hiurst-Precinct Line Road (County Road No. 3035); and Soutli along and with the west right-of-way line of Randol Mill-Hurst-Precinct Line Road (County Road No. 3035) to the place of beglnni,ng and containing 0.69 square miles of land. THLRD TRACT Being all or a portion of the John A. Hust Survey, Abstract No. 70.2, J. Overton Survey, Abstract No. 1191, W. P. Burns Survey, Abstract No. 121 , N. Bradshaw Survey, Abstract No. 136, S. Davis Survey, Abstract No. 416, S. Cotrail Survey, Abstract No. 329 and J. Armendaris Survey, Abstract No. 57, situated about 11 miles northeasterly from the Courthouse of Tarrant County, Texas, and being more particularly de- scribed by metes and bounds as follows: BEGINNING at a point for corner in the present Fort Worth city limit line, as established by Ordinance No. 3871 on March 18, 1963, said point for corner being in the east right-of-way line of Souder-Hurst Road (County Road No. 3104), said point for corner also being 2,000 feet southerly from the south right- of-way line of the C.R.I. and P.R.R. said point for corner also being a northwesterly corner of the tract discontinued from Fort Worth by Ordinance No. 4867 on March 18, 1963. THENCE along and with the Fort Worth city limit line as established by Ordinance No. 3871; ""***South along the east right of way line of Souder-Hurst Road (County Road No. 3104) to the south right of way line of the Trammel-Davis Road (County Road No. 3112). "THENCE west along the south right of wayy line of the Trammell-,Davis Road (County Road No. 3112� to the east right of way line of Randol Mill-Hurst- Precinct Line Road (County Road No. 3035). Davis Survey produced east, to its intersection with the present city limit line of the City of Fort Worth, the west right of way line of Bedford Arlington Road (County Road No. 3094)***"; THENCE, north along and with the present Fort Worth city limit line and along and with the west-right-of-way line of Bedford-Arlington Road (County Road No. 30941 to a point for corner, same being the most southerly southeast corner of the THIRD TRACT annexed by Ordinance No. 5603 on August 8, 1966. THENCE, along and with the present Fort Worth city limit line and along and with the line of the THIRD TRACT annexed by Ordinance No. 5603; West along and with the south line of Tract 2 (County Tax Records) of the J. Armendaris Survey, Abstract No. 57, a distance of 935 feet, more or less, to a point for corner in the west line of the J. Armendaris Survey, Abstract No. 57. THENCE north along and with the west line of the J. Armendaris Survey to a point for corner, the northeast corner of the S. Cotrail Survey, Abstract No. 329, also being the southeast corner of the A. B. Kowerton Survey, Abstract No. 677. THENCE west, along and with the-south. line of the A. B. Howerton , Abstract No, 677y. the.R. P, Barton, Abstract No, 176 and the So Cotrail, Abstract No. 330 Surveys, to a point for corner in the present Fort Worth city limit line in the east ri9ht-of4tay line of Souder, Hurst Road (County Road No. 31041. THENCE south along and with- the Present Fort forth city limit line to the place of beginning and contai.ni,ng 1.88 square miles of land. SECTION .2. That the foregoing described territory and the area annexed shall be a part of the City of Fort Worth,, Texas, and the property so added hereby shall bear its pro rata share of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. SECTION 3. That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as, to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall he and is Hereby made cumulative. SECTION .4. That if any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional, by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases, or words except as the same are inseparable from and indis- pensable to the remaining portions of the ordinance. SECTION 5. City of Dort Worth, Texas Mayor and Council Communication DATE REFERENCE SUBJECT: Proposed Annexation — PAGE NUMBER Enclaves in East Fort Worth 1 10/7/71 PZ-463 iof The Council has requested that all remaining enclaves in the eastern portion of Fort Worth which are not presently in the city limits be submitted for annexation consideration. Three such enclaves are shown. ,on the attached.map.. . Legal descript-ions of the areas proposed for annexation will be incorporated into the "Notice of Public Hearing on Contemplated Annexation" if the Council approves the annexation proposal. The City Plan Commission, in,June,_l969,_saviewed all of the enclaves at that time and recommended annexation in accordance-with. a proposed time schedule. These enclaves are ready for annexation consideration at this time in accordance with the Plan Commission's recommendation. All enclaves are within the exclusive extraterritorial jurisdiction of the City of Fort Worth and the total area proposed, which is 2.80 square miles, will be within the area limitation allowable for annexation by Fort Worth in calendar year 1971. A copy of the map showing the enclaves and a copy of the City Council Annexation Time Schedule are attached.
