AN ORDINANCE MAKING CERTAIN FINDINGS; PROVIDING FOR THE
EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT
WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY
CONSISTING OF 23.81 ACRES, MORE OR LESS, OF LAND, WHICH
SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT
BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS;
PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS
PRO RATA SHARE OF TAXES; PROVIDING THAT THE INHABITANTS
THEREOF SHALL HAVE ALL OF THE PRIVILEGES OF ALL THE
CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS
ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT
HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE
OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING
A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE.
WHEREAS, a public hearing before the City Council of Fort Worth,
Texas, wherein all interested persons were provided with an opportunity to
be heard on the proposed annexation of the territory hereinafter described,
was held at the City Council Chamber in th-e City Hall of Fort Worth, Texas,
on the 26th day of October, 1971, which date is not more than twenty (20) nor
less than ten (10) days prior to the institution of annexation proceedings;
and
WHEREAS, notice of such public hearing was published in a news-
paper having general circulation in the City of Fort Worth, Texas, and in the
hereinafter described territory on the 13th day of October, 1971, which
date is not more than twenty (20) nor less than ten (10) days prior to the
date of such public hearing; and
WHEREAS, the population of the City of Fort Worth, Texas, is in
excess of 390,000 inhabitants; and
WHEREAS, the corporate area of the City of Fort Worth, Texas was
212.5 square miles on January 1, 1971; and
WHEREAS, the hereinafter described territory lies within the
extraterritorial jurisdiction of the City of Fort Worth, Texas; and
WHEREAS, the hereinafter described territory lies adjacent to and
adjoins the City of Fort Worth, Texas; and
WHEREAS, the territory hereinafter described contains approximately
23.81 acres;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION I.
That the following described land and territory located approxi-
mately 10 miles northwesterly from the Courthouse of Tarrant County, Texas,
lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby
added to and annexed to the City of Fort Worth, Texas, and said territory
hereinafter described shall hereafter be included within the boundary limits
of the City of Fort Worth, Texas, and the boundary limits of said City, at
the various points contiguous to the area hereinafter described, are altered
and amended so as to include said area within the corporate limits of the City
of Fort Worth, Texas, to wit:
A portion of the M. Hunt Survey, Abstract No. 761, situated about
ten miles northwesterly from the Courthouse of Tarrant County, Texas and being
more particularly described by metes and bounds, using Texas Co-ordinate System
North Central Zone bearings and Co-ordinates as follows:
Beginning at a point for corner in the present Fort Worth city
limit line, said point for corner being the Northeast corner of the M. Hunt
Survey, Abstract No. 761, said point for corner having Co=ordinates X=2,006,341.88
and Y=423,392.24;
THENCE, South 01 Degrees-35 Minutes-02 Seconds West along and with
the present Fort Worth city limit line, and along and with the east line of
the said M. Hunt Survey, and along and with the west line of the J. Wilcox
Survey No. 34, Abstract No. 1717, a distance of 1510.70 feet to a point for
corner in the northeasterly line of pavement of the southwesterly frontage
road of Jacksboro Highway (State Highway No. 199), said point for corner also
being the Agreed Mutual Common Boundary Line between Fort Worth and The Town
of Lakeside, said point for corner having Co-ordinates X=2,006,300.12 and
Y=421,882.12;
THENCE, North 41 Degrees-54 Minutes-15 Seconds West along and
with the northeasterly line of pavement of said southwesterly frontage
road, and along and with the Fort Worth-Lakeside Agreed Mutual Common
Boundary Line to a point for corner in the present Fort Worth city limit
line, said point for corner also being in the north line of the M. Hunt
Survey, said point for corner also being in the south line of the J.
Wilcox Survey No. 35, Abstract No. 1718 and having Co-ordinates
X=2,004,967.35 and Y=423,367.31 ;
THENCE, North 88 Degrees-37 Minutes-39 Seconds east along and
with the present Fort Worth city limit line and along and with the north
line of the M. Hunt Survey and the south line of the J. Wilcox No. 35 Survey
to the place of beginning and containing 23.81 acres of land.
SECTION 2.
That the foregoing-described territory and the area annexed shall
be a part of the City of Fort Worth, Texas, and the property so added hereby
shall bear its pro rata share of the taxes levied by the City of Fort Worth,
Texas, and the inhabitants thereof shall be entitled to all of the rights
and privileges of all the citizens and shall be bound by the acts, ordinances,
resolutions and regulations of the City of Fort Worth, Texas.
SECTION 3 .
That this ordinance shall and does hereby amend every prior or-
dinance in conflict herewith, but as to all other ordinances or sections of
ordinances not in direct conflict herewith, this ordinance shall be and is
hereby made cumulative.
SECTION 4.
If any section, subsection, clause, sentence, phrase, or word
of this ordinance is for any reason held void or unconstitutional, by a court
of competent jurisdiction, such invalidity shall not affect the validity of
the remaining sections, subsections, clauses, sentences, phrases, or words
except as the same are inseparable from and indispensable to the remaining
portions of the ordinance.
SECTION 5.
This ordinance shall be in full force and effect from and after
the date of its passage on first reading and publication and its passage on
second reading as provided for in Section 40 of Chapter XXVIII of the
Charter of the City of Fort Worth and it is so ordained.

The Town of Lakeside and the City of Fort Worth have previously adopted a Joint
Resolution fixing and establishing a mutual common boundary line between the
two cities. (M&C PZ-416, January 4, 1971)
Under the terms of the Joint Resolution Fort Worth disannexed certain territory
(M4C PZ-449, January 26, 1971), which Lakeside has now annexed. Lakeside dis-
annexed certain territory by its Ordinance No. 42 on August 9, 1971.
Two tracts were disannexed by Lakeside-the first consists of 23.8 acres on the
northeast side of Jacksboro Highway and the second consists of 2.97 acres part
of which is the right-of-way of Silver Creek Road and part of which is private
property immediately adjacent on the west.
In accordance with the terms of the Joint Resolution the territory disannexed
by Lakeside is now available for annexation by Fort Worth.
Immediate annexation of the 23.8 acre tract on the northeast side of Jacksboro
Highway is recommended.
Annexation, at this time, of the 2.97 acre tract is not recommended. Annexation
of the Silver Creek Road right-of-way would create a right-of-way "island" re-
quiring Fort Worth maintenance, the private property adjacent on the west would
be very difficult to serve and annexation would require an awkward coupling
corridor to connect up with existing Fort Worth city limits.
Recommendation
It is recommended:
1) That the Council set a public hearing to consider annexation of the
23.8 acre tract northeast of Jacksboro Highway, and
2) That the staff be authorized and directed to arrange the necessary
publication.
A copy of a map showing the Lakeside-Fort Worth Mutual Common Boundary Line
and the 23.8 acre tract recommended for annexation and a copy of the City
Council Annexation Timetable are attached.
