HomeMy WebLinkAboutOrdinance 7157ORDINANCE NO. AN ORDINANCE PROVIDING THAT DASHWOOD STREET FROM SOUTH LAKE STREET EAST TO FIFTH AVENUE AND THE NORTH -SOUTH ALLEY IN BLOCK 2/8 OF J. A. LEE SUBDIVISION OF FIELDS WELCH ADDI- TION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, FROM DASHWOOD STREET SOUTH TO ROSEDALE STREET, BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CON- FLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following public rights -of -way be and the same are hereby closed, abandoned and permanently vacated as public thoroughfares of any kind or character whatever: Dashwood Street from South Lake Street east to Fifth Avenue; and The north -south alley in Block 2/8, J. A. Lee Subdivision of Fields Welch Addition to the City of Fort Worth, Tarrant County, Texas, abutting Lots 17 through 36 and ex- tending from Dashwood Street south to Rose- dale Street. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said street and alley is hereby released and shall revert to the adjacent owners of the fee as provided by law, save and except that easements are reserved for any and all existing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed, SECTION 40 That this ordinance shall take effect and be in full force and effect from and after the date of its passage. A. Lee Subdivision '�IPBELL of Fields - Welch, Block 2/8 (V- 74 -45) Dr. Carl A. Gibbe, with the consent of all abutting property owners, has requested that the City vacate Dashwood Street in the 1250 block, a width of 20 feet and a length of 214 feet from South Lake Street east to Fifth Avenue; and the north -south alley in Block 2/8 of J. A. Lee Subdivision of Fields -Welch Addition, a width of 10 feet and a length of 400 feet abutting Lots 17 -36 from Dashwood Street south to Rosedale Street as shown on the attached maps. The subject rights -of -way were acquired by dedication. Dashwood Street is open and paved and contains sanitary sewer facilities; while the subject alley is paved, partially open and contains electric, sewer and telephone facilities. The reviewing City departments and private utility companies have no objections to this request provided: I. The vacated rights -of -way are retained as utility easements or satisfactory relocation arrangements are made; 2. The vacated rights -of -way are replatted with adjoining land and the Dashwood Street right -of -way to be vacated is dedicated as a pedestrian access easement, and this vacated right -of -way is retained as an emergency access easement from the south terminus of the existing alley in Block 1/8 to a public street. 3. Cross - fencing, except at street property lines, is prohibited; 4. The vacated rights -of -way are physically closed with stand -up curb and gutter or provided with a driveway approach. The City Plan Commission has reviewed this request and recommends an ordinance be adopted vacating subject rights -of -way as requested. A satisfactory replat has been submitted to the City staff and arrangements have been made for easements and stand -up curb. Recommendation It is recommended that an ordinance be adopted vacating subject rights -of- way as recommended by the City Plan Commission.
