AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSIS- TING OF 1.92 SQUARE MILES OF LAND, WHICH TERRITORY LIES AD- JACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TARES; PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH: PRO- VIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Chamber in the Municipal Office Building of Fort Worth, Texas, on the 25th day of June, 1973, which date is not more than twenty (20) days nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published in a newspaper having general circulation in the City of Fort Worth, Texas, and in the herein- after described territory on the 12th day of June, 1973, which date is not more than twenty (20) days nor less than ten (10) days prior to the date of such pub- lic hearing; and WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 390,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas, was 233.33 square miles on January 1, 1973; and WHEREAS, the hereinafter described territory lies within the exclusive extraterritorial ,jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and ad- joins the City of Fort Worth, Texas; and WHEREAS, the territory hereinafter described contains approximately 1.92 square miles of land; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the following described land and territory, lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the - 1 = City of Fort Worth, Texas, and said territory hereinafter described shall here- after be included within the boundary limits of the City of Fort Worth, Texas, and the boundary limits of said City, at the various points contiguous to the areas hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to wit: FIRST TRACT Being portions of the William R. Loving Survey, Abstract No. 944, J. F. Wheat Survey, Abstract No. 1695, R. Brown (alias Smith) Survey, Abstract No. 150 and Heirs of John Childress Survey, Abstract No. 251, situated about eleven (11) miles Easterly from the Courthouse of Tarrant County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at a point for corner in the east line of the 74 acre tract out of the William R. Loving Survey, Abstract No. 944, conveyed to Georgia Reeves Duncan and Mary Reeves Ellis by deed of record in Volume 3503 at page 275 of the Deed Records of Tarrant County, Texas, at its intersection with the South line of the C. R. I. & G. RR. THENCE South, along and with the East line of the Duncan and Ellis 74 acre tract approximately 2,200 feet to a stone on the South bank of the Trinity River for its Southeast corner, which corner is also the Northeast corner of the 20 acre tract out of the William R. Loving Survey, Abstract No. 944, Conveyed to M. G. Reeves by deed of record in Volume 4916 at page 647 of the Deed Records of Tarrant County, Texas. THENCE South, along and with the East line of the Reeves 20 acre tract, 348 varas to its Southeast Corner in the South line of the William R. Loving Survey and 950 varas from its Southeast Corner. THENCE East, along and with the South line of the William R. Loving Survey, Abstract No. 944, and along and with the North line of the Ruth Brown (alias Smith) Survey, Abstract No. 150, and along and with the North line of the 177.92 acre tract conveyed to Texas Industries, Inc., 535 varas to a point for the Northeast corner of the Texas Industries, Inc. 177.92 acre tract. THENCE South, along and with the East line of the Texas Industries, Inc. 177.92 acre tract approximately 1,150 feet to the Northwest corner of the 200 acre tract conveyed to the City of Fort Worth by deed of record in Volume 4762, at page 895 of the Deed Records of Tarrant County, Texas, being described therein as Parcel No. 1. - 2 - THENCE North 89 Degrees - 38 Minutes - 16 Seconds East, along and with the North line of the City of Fort Worth 200 acre tract, 2,951.86 feet to its North- east corner. THENCE South No Degrees - 58 Minutes - 02 Seconds East, along and with the East line of the City of Fort Worth 200 acre tract, 2,939.39 feet to its South- east corner. THENCE South 89 Degrees - 19 Minutes - 34 Seconds West, along and with the South line of the City of Fort Worth 200 acre tract, 2,975.41 feet to its South- west corner, in the East line of the 1.73 acre tract conveyed to the City of Fort Worth by deed of record in Volume 4762 at page 895 of the Deed Records of Tarrant County, Texas; and described therein as Parcel No. 2. THENCE West, along and with the South line of the City of Fort Worth 200 acre tract produced West, to a point for corner which is 450 feet East from the East line of the J. Armendaris Survey, Abstract No. 57. THENCE South, along and with a line 450 feet East from and parallel to the East line of the J. Armendaris Survey, Abstract No. 57; and continuing South along and with a line 450 feet East from and parallel to the East line of the J. L. Hallum Survey, Abstract No. 723, to a point for corner in the North line of the 75 feet wide easement to Texas Electric Service Co. THENCE North 88 Degrees - 41 Minutes West along and with the North line of the 75 foot wide easement to Texas Electric Service Company 450 feet to a point for corner in the present Fort Worth City limit line. THENCE North, along and with the present Fort Worth City limit line, to a point for corner at its intersection with the South right-of-way line of the C. R. I. & G. RR. THENCE East, along and with the South right-of-way line of the C. R. I. & G. RR. to the place of beginning and containing approximately 840 acres of land. SECOND TRACT BEING a portion of the J. A. Creary Survey, Abstract No. 269, situated about eight (8) miles Southeasterly from the Courthouse of Tarrant County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at a point for corner in the present Fort Worth City limit line, at an iron pin for the Northwest Corner of Lot 2 of Lake Arlington Industrial Park Addition. - 3 - THENCE South to a point for corner in the West shore line of Lake Arlington at normal pool elevation 550 feet mean sea level. THENCE in a generally Westerly direction, along and with the shore line of Lake Arlington at normal pool elevation 550 feet mean sea level, to a point for corner in the present Fort Worth City limit line. THENCE North, along and with the present Fort Worth City limit line, approxi- mately 1,300 feet to a point for corner. THENCE East, along and with the present Fort Worth City limit line, approxi- mately 2,000 feet to the place of beginning and containing approximately 53 acres of land. THIRD TRACT BEING portions of the J. A. Creary Survey, Abstract No. 269, the J. M. Daniel Survey, Abstract No. 395 and the David Strickland Survey, Abstract No. 1376, situ- ated about eight (8) miles Southeasterly from the Courthouse of Tarrant County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at a point for corner in the present Fort Worth City limit line at its intersection with the west shore line of Lake Arlington at normal pool eleva- tion 550 feet mean sea level; which point of beginning is at, or near, the North- east Corner of Lot 5 in Block 5 of Handley Heights South Addition. THENCE in a generally Southerly direction, along and with the West shore line of Lake Arlington, with its meanders, at normal pool elevation 550 feet mean sea level, to a point for corner at its intersection with the South right-of-way line of Interstate Highway No. I-20. THENCE West and Southwesterly, along and with the South right-of-way line of Highway I-20 to a point for corner at its intersection with the present Fort Worth City limit line. THENCE in a generally Northerly direction, along and with the present Fort Worth City limit line, with its meanders, to the place of beginning and containing approximately 338 acres of land. SECTION 2. THAT the foregoing-described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata share of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all - 4 - the citizens and shall be bound by the acts, ordinances, resolutions and regula- tions of the City of Fort Worth, Texas. SECTION 3. THAT this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumu- lative. SECTION 4. THAT if any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional, by a court of com- petent jurisdiction, such invalidity shall not affect the validity of the remain- ing sections, subsections, clauses, sentences, phrases, or words except as the same are inseparable from and indispensable to the remaining portions of the ordi- nance. SECTION 5. THAT this ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained. In accordance with the terms of the agreement, each City undertook to delete certain areas apportioned to the other City. The areas apportioned to Arlington were deleted by Ordinance No. 6796, adopted a second and final reading on February 12, 1973. Arlington's deletion ordinances required adoption on first reading, publication, and adoption on second and final reading not sooner than 30 days after publication, and have now been finalized. The Fort Worth City Plan Commission at its regular meeting on February 28, 1973, recommended that the areas apportioned to Fort Worth be annexed after final deletion by Arlington. It is proposed that pro- ceedings be started on June 4, and that annexation be final on August 6, 1973. The areas involved consist of 1) approximately 840 acres of land lying east of Arlington-Bedford Road, south of the Rock Island Railroad and north of the Dallas-Fort Worth Turnpike (including the 200 acre sludge drying beds owned by Fort Worth, and a 450 foot strip required for expansion of the Village Creek Wastewater Treatment Plant), and 2) approximately 391 acres of land on the west shore of Lake Arling- ton, lying between the present Fort Worth City limit line and the west shore line of Lake Arlington at normal lake pool elevation 550 feet mean sea level. REFERENCE SUBJECT: Arlington-Fort Worth PAGE NUMBER Common Boundary 2 at ,, 2/12/73 PZ-543 1 of r: 'The staffs of the cities of Fort Worth and Arlington have conducted extensive negotiations to establish a recommended common boundary line agreement between the two cities. An agreement on a proposal was reached between the two staffs at a meeting on January 25, 1973. At its regular meeting on Tuesday evening, February 6, 1973, the Arlington City Council adopted a Joint Resolution establishing a common boundary line between Fort Worth and Arlington. The Arlington Council, at the same meeting, initiated proceedings to discon- tinue certain territories to make them available for annexation by Fort Worth. It is recommended that the Fort Worth City Council adopt the Joint Resolution establishing the common boundary line as described herein and initiate action on the following to effectuate the proposed boundary adjustments. The significant features of the common boundary line agreement are: 1) Arlington will disannex areas necessary to Fort Worth for expansion of the Village Creek Wastewater Treatment Plant. 2) Arlington will discontinue a 200 acre tract purchased by Fort Worth and used for sludge drying beds. 3) Arlington will discontinue lake frontage property between the present Arlington-Fort Worth city limit line and the Arlington Lake Shore (at normal pool elevation 550 feet mean sea level) on the west side of Lake Arlington. 4) Fort Worth will discontinue the Greenman property south of the Village Creek Wastewater Treatment Plant and east of Village Creek. 5) Fort Worth will discontinue the area to be platted as Inter- lochen Addition to Arlington in the Village Creek flood plain between Meadowbrook Drive on the north and U. S. Highway 80 East on the south. 6) Fort Worth will discontinue all Lake Arlington water frontage below normal pool elevation 550 feet mean sea level. 7) A tract of land east of the Arlington-Bedford Road and north of the Trinity River will be subject to annexation by the City of Fort Worth. These steps will have the following results: 1) Permit the City of Fort Worth to acquire land necessary for the expansion of the Village Creek Wastewater Treatment Plant. Consummation of the agreement and the subsequent corporate area exchanges will increase the capability -of rendering services to its citizens by each city, alleviate existing policing, land use control and development problems and expedite the needed expansion of the Village Creek Plant. Recommendation It is recommended that the City Council: 1) Adopt the Joint Resolution, 2) Adopt an ordinance discontinuing territory from Fort Worth as pro- vided in the resolution, and 3) Instruct the staff to initiate annexation on the areas discontinued by Arlington.
